DISTRICT
WHEREAS, the Union Landing shopping center is the City’s primary regional shopping center and a significant source of sales tax revenue; and WHEREAS, on July 8, 2025, the City Council adopted Resolution No. 2025-096 to renew the Union Landing Property and Business Improvement District (“ULPBID”) to levy and collect assessments for Fiscal Year 2025–2026 in accordance with the provisions of the Property and Business Improvement District Law of 1994, California Streets and Highways Code section 36600 et seq.; and
WHEREAS, the ULPBID Management District Plan identified the Union Landing Property Owners Association (“ULPOA”) as the owner’s association for the ULPBID and established the duties and responsibilities of the ULPOA with regard to the management of the ULPBID; and
WHEREAS, the mission of the ULPOA is to create and promote a high-quality entertainment and shopping environment in the Union Landing center, to protect the safety of its visitors, and to provide businesses within the shopping center with valuable marketing efforts; and
WHEREAS, ULPBID provides funding to support the operation of a dedicated police substation within the shopping center. Fear of crime has a significant influence on where people choose to shop, socialize, and spend time, as these decisions are often guided by their perceptions of safety. Research shows that police substations are highly effective in reducing the fear of crime within their immediate surroundings, helping create a safer and more welcoming environment for visitors and businesses alike; and WHEREAS, through ULPBID the Union City Police Department has been occupying a police substation rented from Dyer Triangle LLC, and the previous agreement with Dyer Triangle LLC, adopted through Resolution No. 5616-20, expired on June 30, 2025, and has since continued on a month-to-month basis; and WHEREAS, Inverness Management, LLC has offered to provide new office space for the Union Landing police substation, and the proposed lease agreement attached hereto as Exhibit A (the “Lease Agreement”) formalizes this arrangement; and Resolution No. 2025-XXX
Union Landing Police Substation Lease
WHEREAS, the Lease Agreement allows the City to utilize the Union Landing police substation pursuant to the terms of the Lease Agreement for the amount of $3,266.00 per month, with an annual increase of 4%, and will remain in effect for the remainder of the ULPBID term beginning December 10, 2025; and WHEREAS, the ULPBID includes an annual assessment for the police substation lease payments, including the annual increases; and
WHEREAS, adoption of this Resolution will have no adverse effect on the General Fund because the City maintains all funds collected pursuant to the ULPBID assessment and ensures that such funds are accounted for separately from the City’s General Fund.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby authorizes the Lease Agreement with Inverness Management, LLC for a police substation located at 31079 Courthouse Drive for $3,266.00 per month, with a 4% increase on the anniversary of each year, to deliver police services on behalf of ULPBID.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute the Lease Agreement with Inverness Management, LLC on behalf of the City of Union City in substantially the same form attached hereto as Exhibit A; to make any revisions, amendments, corrections, and modifications to the Lease Agreement, subject to the approval of the City Attorney, as deemed necessary to carry out the intent of this Resolution and which do not materially alter or increase the City’s obligations thereunder; and to take all actions necessary to effectuate the intent of this Resolution.
