FEES PURSUANT TO GOVERNMENT CODE SECTION 66000, ET SEQ.,

WHEREAS, at the time the Fees were adopted, the City adopted a report for each Fee that demonstrated a reasonable relationship between the Fee and the purpose for which it is assessed; and
WHEREAS, the Fees are imposed on new development in the City based on, and in proportion to, the impacts generated by such development, and therefore there is a reasonable relationship between the Fees and the purposes for which they are assessed; and
WHEREAS, pursuant to California Government Code Section 66000, et seq. (“AB 1600”), the City is required to prepare an annual report providing the following information about each Fee:
• A brief description of the type of fee
• The amount of the fee
• Beginning and ending fund balances, including total fees collected and investment earnings, if applicable
• Identification of the public improvement(s) the fees were used for • Identification and timeline of public improvements, any unexpended fees will be used for
• Description and uses for transfers or loans of fees, if applicable • Amount of refunds made pursuant to Section 66001(e), if applicable • Amount of allocations pursuant to Section 66001(f), if applicable; and WHEREAS, California state law obligates local authorities to compile an annual report on the state of their Development Impact Fee (DIF) Program, with further assessments mandated every fifth year; and
WHEREAS, the City has prepared the annual report for Fiscal Year 2024-2025, which includes the required information for each Fee and which has been made available to the public and which is attached hereto as Exhibit A; and WHEREAS, the City Council must adopt a Resolution making specific findings if any Development Impact Fees remain unexpended for more than five years, and thus this Resolution serves to meet that requirement; and
WHEREAS, notice of the meeting at which this Resolution is to be considered by the City Council was provided to those on record with the City Clerk requesting such notice.
