RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
ACCEPTING COMPLETION OF THE ANNUAL SIDEWALK, CURB &
GUTTER, AND RAMP REPAIR PROJECT, CITY PROJECT NO. 25-03 AND APPROVING THE APPLICATION $36,422 IN BUDGET SAVINGS
IN AN EQUALLY PROPORTIONAL DISCOUNT TO EACH PROPERTY
OWNER’S PORTION OF THE COST OF CONSTRUCTION
WHEREAS, on August 12, 2025, the City Council adopted Resolution No. 2025- 116, awarding a construction contract to Rosas Brothers Construction, in the amount of $539,954, and approving a construction budget, with contingency, in the amount of $647,945, for the Annual Sidewalk, Curb & Gutter (C&G), and Ramp Repair Project, City Project No. 25-03; and
WHEREAS, the contractor has completed the project in accordance with the project plans and specifications (Exhibit A); and
WHEREAS, the project scope included making improvements at approximately 117 locations citywide, all of which were in front of private property, work comprising repairing uplifted or damaged sidewalks and curbs & gutters, upgrading ramps, and removing trees uplifting sidewalks throughout the City (Exhibit B); and WHEREAS, the project was substantially completed in November 2025, and all final project punch-list items have now been resolved with the contractor; and WHEREAS, this project is funded by a combination of State Gas Tax funds (Fund 250), SB 1 Road Maintenance & Rehabilitation funds (Fund 251), and Measure BB Bike & Pedestrian funds (Fund 267), totaling $611,523, which is within the final project construction budget for the action of accepting the project, with a remaining project balance of $36,422; and
WHEREAS, the City portion of the construction contract includes tree and stump removal, curb and gutter repairs, and ramp upgrades, with costs estimated to be $277,776, and the remaining portion of the contract costs are the responsibility of the property owners (sidewalk repair, driveway repair, and landscape strip paver removal) and are estimated to be $333,747; and
WHEREAS, due to the unprecedented economic environment and rising material and labor costs, project costs were 75% higher than when this project was last completed in 2022, and throughout the duration of this project, City staff received over 35 phone calls and emails from residents expressing financial hardship in being able to cover their portion of the repair work; and
WHEREAS, to better serve the affected Union City residents, staff has extended the monthly payment option from twelve (12) months to eighteen (18) months to lower each resident’s monthly payment amount for their portion of the cost and recommends that the City Council authorize the City Manager to allow the use the remaining project balance, in the amount of $36,422, to reduce the costs for affected residents; and WHEREAS, the proposed discount on the resident portion of the construction costs for affected Union City residents will be funded by the City, with the remaining Resolution No. 2025-XXX

project balance of $36,422, to be applied in equal proportion to affected resident accounts. Essentially, the City will now pay $314,198 ($277,776 + $36,422) as its share of the project costs, and the Union City residents will pay $297,325 ($333,747 - $36,422).
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby accepts the Annual Sidewalk, Curb & Gutter, and Ramp Repair Project, City Project No. 25-03.
BE IT FURTHER RESOLVED that the City Council of the City of Union City hereby authorizes the City to make a final retention payment, in the amount of $30,576.12, to Rosas Brothers Construction for the completion of improvements of City Project No. 25- 03 in accordance with the plans and specifications on file at the Office of the Public Works Director.
BE IT FURTHER RESOLVED that the City Council of the City of Union City hereby authorizes the City Manager to apply an equally proportional discount on the property owner portion of the construction costs for affected Union City residents from the remaining project balance of $36,422.
