1 TITLE VI PROGRAM
1.1 PLAN STATEMENT
The City of Union City operates Union City Transit and Union City Paratransit services within the city limits of Union City. As a condition of receiving Federal Transit Administration (FTA) financial assistance from the U.S. Department of Transportation (USDOT) to operate these services, transit agencies must ensure that their programs, policies, and activities comply with USDOT’s Title VI regulations. The following program was developed to guide the City of Union City in its administration and management of Title VI-related activities, and details how the City of Union City meets the requirements as set forth in FTA Circular 4702.1B.
Section 601 under Title VI of the Civil Rights Act of 1964 states the following:
“No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”
1.2 POLICY
City of Union City is committed to ensuring that no person on the basis of race, color, or national origin will be excluded from participation or subjected to discrimination in the level and quality of transit services or related benefits provided by the City of Union City’s employees, affiliates, and contractors.
1.3 GOVERNING BOARD
The governing board for City of Union City’s transit system is made up of five (5) elected members of the Union City City Council. The four (4) council members are elected by district and the mayor is elected at large.
1.4 GENERAL REPORTING REQUIREMENTS
Chapter III of FTA Circular 4702.1B addresses the general reporting requirements for recipients and sub-recipients of FTA funding to ensure that their activities comply with USDOT Title VI regulations. Below are summaries of each requirement and how the City of Union City’s Title VI Program fulfills each of those requirements.

TITLE VI PROGRAM| MARCH 2026
1.4.1 Requirement to provide Title VI assurances
Requirement
In accordance with 49 CFR Section 21.7(a), every application for financial assistance from FTA must be accompanied by an assurance that the applicant will carry out the program in compliance with USDOT’s Title VI regulations. This requirement shall be fulfilled when the applicant/recipient submits its annual certifications and assurances to FTA.
Response
City of Union City annually submits its Certifications and Assurances to FTA. Appendix A is the City of Union City’s last submittal for Federal Fiscal Year (FFY) 2025.
1.4.2 Requirement to prepare and submit a Title VI Program Requirement
The Federal Transit Administration (FTA) mandates that all direct and primary recipients demonstrate compliance with USDOT Title VI regulations. This involves submitting a formal Title VI Program to the designated FTA Regional Civil Rights Officer every three (3) years, or as otherwise requested. All programs—including those for sub-recipients—must receive formal approval from the recipient’s board of directors or the governing body responsible for policy decisions before being submitted. Sub-recipients are required to submit their individual programs to their primary funding recipient to support overall regional compliance.
Response
The City of Union City City Council will formally adopt this Title VI Program via a signed resolution. The program's effective date will coincide with the official approval date provided by the FTA Region IX Office of Civil Rights. A copy of the executed resolution is provided in Appendix A
1.4.3 Requirement to notify beneficiaries of protection under Title VI
Requirement
The Title VI Program shall include recipient’s Title VI notice to the public that indicates the recipient complies with Title VI, and informs members of the public of the protections against discrimination afforded to them by Title VI. Include a list of locations where the notice is posted.
Response
City of Union City has developed a public Title VI Notice to Beneficiaries following the guidelines of Circular FTA C 4702.1B, Appendix B. Copies of the procedures, the brochures, and the evidence of postings are found in Appendices C and D.
1.4.5 Requirement to record and report transit related
Title VI investigations, complaints, and
lawsuits
Requirement
In order to comply with the reporting requirements of 49 CFR Section 21.9(b), FTA requires all recipients to prepare and maintain a list of any of the following that allege discrimination on the basis of race, color, or national origin: active investigations conducted by entities other than FTA; lawsuits; and complaints naming the recipient. This list shall include the date that the investigation, lawsuit, or complaint was filed; a summary of the allegation(s); the status of the investigation, lawsuit, or complaint; and actions taken by the recipient in response, or final findings related to, the investigation, lawsuit, or complaint.
Response
City of Union City will maintain a list of all investigations, lawsuits and complaints naming City of Union City according to the guidelines of Circular FTA C 4702.1B, Appendix E. A copy of this list is provided in Appendix F of this Title VI Program. In addition, the City will maintain permanent records of all related documents. The City of Union City has not received any Title VI complaints of discrimination and therefore does not have any investigations or lawsuits to report; however the processes are in place in the instance that complaints are made.

1.4.6 Requirement to promote inclusive public participation Requirement
The content and considerations of Title VI, the Executive Order on Limited English Proficiency (LEP), and the USDOT LEP Guidance shall be integrated into each recipient’s established public participation plan or process (i.e., the document that explicitly describes the proactive strategies, procedures, and desired outcomes that underpin the recipient’s public participation activities).
Response
City of Union City’s public participation policy is shown in Appendix G of this Title VI Program.
The City of Union City ensures that minority and LEP populations, as with all members of the public, will be empowered to participate in decisions involved with the City of Union City’s transit system.
1.4.7 Requirement to provide meaningful access to LEP
persons
Requirement
Consistent with Title VI of the Civil Rights Act of 1964, USDOT’s implementing regulations, and Executive Order 13166, “Improving Access to Services for Persons with Limited English Proficiency” (65 FR 50121, Aug. 11, 2000), recipients shall take reasonable steps to ensure meaningful access to benefits, services, information, and other important portions of their programs and activities for individuals who are LEP.
Response
The City of Union City Language Assistance Plan (LAP) was developed as part of the 2014 Title VI Program update. The City of Union City’s Four (4) Factor Analysis and action plan were approved as part of that plan’s concurrence. No additional updates to the plan have been required since.
1.4.8 Minority representation on planning and advisory
bodies
Requirement
Title 49 CFR Section 21.5(b)(1)(vii) states that a recipient may not, on the grounds of race, color, or national origin, “deny a person the opportunity to participate as a member of a planning, advisory, or similar body which is an integral part of the program.” Recipients that have transit-related, non-elected planning boards, advisory councils or committees, or similar committees, the membership of which is selected by the recipient, must provide a table depicting the racial breakdown of the membership of those committees, and a description of efforts made to encourage the participation of minorities on such committees.

TITLE VI PROGRAM| MARCH 2026
1.4.11 Determination of site or location of facilities
Requirement
Title 49 CFR Section 21.9(b)(3) states, “In determining the site or location of facilities, a recipient or applicant may not make selections with the purpose or effect of excluding persons from, denying them the benefits of, or subjecting them to discrimination under any program to which this regulation applies, on the grounds of race, color, or national origin; or with the purpose or effect of defeating or substantially impairing the accomplishment of the objectives of the Act or this part.” Title 49 CFR part 21, Appendix C, Section (3)(iv) provides, “The location of projects requiring land acquisition and the displacement of persons from their residences and businesses may not be determined on the basis of race, color, or national origin.” For the purposes of this requirement, “facilities” does not include bus shelters, as these are transit amenities and are covered in Chapter IV, nor does it include transit stations, power substations, etc. as those are evaluated during project development and the National Environmental Policy Act (NEPA) process. Facilities included in this provision include, but are not limited to, storage facilities, maintenance facilities, operations centers, etc.
Response
The City of Union City has not constructed any new facilities, as defined by the requirement, for the reporting period of this Title VI Program.
In the event a new facility, as defined by the requirement, is required, the City of Union City will ensure that both environmental analysis and Title VI environmental justice requirements are incorporated into the scope of work for all facilities projects.
1. City of Union City will complete a Title VI equity analysis during the planning stage with regard to where a project is located or sited to ensure the location is selected without regard to race, color, or national origin. City of Union City will engage in outreach to persons potentially impacted by the siting of facilities. The Title VI equity analysis will compare the equity impacts of various siting alternatives, and the analysis will occur before selection of the preferred site.
2. When evaluating locations of facilities, City of Union City will give attention to other facilities with similar impacts in the area to determine if any cumulative adverse impacts might result. Analysis will be done at the Census tract or block group where appropriate to ensure that proper perspective is given to localized impacts.
3. If City of Union City determines that the location of the project will result in a disparate impact on the basis of race, color, or national origin, City of Union City will only locate the project in that location if there is a substantial legitimate justification for locating the project there, and where there are no alternative locations that would have a less disparate impact on the basis of race color or nation origin. City of Union City will show how both tests are met and will consider and analyze alternatives to determine whether those alternatives would have less of a disparate impact on the basis of race, color, or national origin, and then implement the least discriminatory alternative.
City of Union City – Union City Transit | 1-7
TITLE VI PROGRAM| MARCH 2026
1.4.12 Requirement to Provide Additional Information
Upon Request
Requirement
The FTA reserves the right to request, at its discretion, any information beyond the standard requirements of this Circular. Such requests are typically made to facilitate the investigation of discrimination complaints or to address and resolve potential concerns regarding noncompliance with USDOT’s Title VI regulations.
Response
The City of Union City is committed to full transparency and will cooperate entirely with any FTA investigation or request for supplemental data. The City will provide all necessary documentation and information required by Title VI regulations to ensure the timely resolution of discrimination complaints or compliance reviews.
1.5 REQUIREMENTS FOR FIXED-ROUTE TRANSIT PROVIDERS
1.5.1 Requirements for Transit Providers Operating 50+
Fixed-Route Vehicles in Peak Service (UZA Population
200,000+)
Requirements
Transit providers that meet the threshold of operating fifty (50) or more fixed-route vehicles in peak service and are located in an Urbanized Area (UZA) with a population of 200,000 or more are subject to enhanced reporting. These requirements include the collection and reporting of demographic data, performing service and fare equity analyses, and monitoring transit service performance to ensure equitable distribution.
Response
The City of Union City qualifies for a reduced level of Chapter IV reporting. The City is not included on the FTA’s official list of recipients in urbanized areas with a population of 200,000 or greater that operate at least fifty (50) vehicles in fixed-route peak service. This status is verified via the FTA’s published list of qualifying grantees: FTA Grantees by Region in UZA Pop 200k with 50 Vehicles.
1.5.2 Requirement to Set System-Side Service Standards
and Policies
Requirement
Chapter IV of FTA Circular 4702.1B outlines additional reporting requirements for FTA funding recipients (and their sub-recipients) that operate fixed-route transit service. These standards ensure that service is provided equitably, without regard to race, color, or national origin.
City of Union City – Union City Transit | 1-8
TITLE VI PROGRAM| MARCH 2026
Per Circular 4702.1B, "fixed-route" refers to public transportation service operated along predetermined routes according to a fixed schedule. These requirements do not apply to demandresponse services.” Response
The City of Union City has established the following service standards and policies to ensure equitable transit delivery across the service area
Vehicle Assignment Policy
The City of Union City operates one (1) central bus yard for vehicle dispatching. The fleet consists of 35-foot revenue vehicles with an average age not exceeding 14 years. To ensure modern vehicles are distributed fairly:.
Fleet Renewal: Eight (8) new buses are scheduled for service in Spring 2026, with seven (7) additional buses on order for delivery in Winter 2028/29. Assignment Strategy: Vehicles are rotated through multiple routes daily using scheduled route interlining and mixed operator assignments. This process ensures that both newer and older vehicles are utilized across the entire service area rather than concentrated in specific neighborhoods.
Transit Amenities Policy
The City installs and maintains a "complete bus stop package" (one illuminated shelter and one bench) along major arterial roadways. Installation is prioritized based on:
1. High ridership at existing stops.
2. High customer demand regarding safety or comfort.
3. Availability of sidewalk space for ADA-compliant wheelchair access.

2 LANGUAGE ASSISTANCE PLAN
2.1 INTRODUCTION
This Language Assistance Plan (LAP) has been prepared to address the responsibilities of Union City Transit and Paratransit as a recipient of federal financial assistance as they relate to the needs of individuals with Limited English Proficiency (LEP). The plan has been prepared in accordance with Title VI of the Civil Rights Act of 1964, 42 U.S.C. 2000d, et se, and its implementing regulations, which state that no person shall be subjected to discrimination on the basis of race, color or national origin.
Executive Order 13166, titled Improving Access to Services for Persons with Limited English Proficiency, indicates that differing treatment based upon a person’s inability to speak, read, write or understands English is a type of national origin discrimination. It directs each federal agency to publish guidance for its’ respective recipients clarifying their obligation to ensure that such discrimination does not take place. This order applies to all state and local agencies which receive federal funds, including Union City Transit which receives federal assistance through the U.S.
Department of Transportation (USDOT).
2.2 LANGUAGE ASSISTANCE PLAN SUMMARY
Union City Transit and Paratransit has developed an LAP to help identify reasonable steps for providing language assistance to persons with limited English proficiency who wish to access services provided by Union City Transit. As defined in Executive Order 13166, LEP persons are those who do not speak English as their primary language and have limited ability to read, speak, write or understand English.
This plan outlines how to identify a person who may need language assistance, the ways in which assistance may be provided, staff training that may be required, and how to notify LEP persons that assistance is available.
2.3 LIMITED ENGLISH PROFICIENCY FOUR FACTOR ANALYSIS
Union City Transit’s commitment to Title VI compliance is supported by the completion of the USDOT Four-Factor LEP Analysis. This framework examines the following criteria to ensure equitable transit access::
1. The number or proportion of LEP persons in the service area who may be served or are likely to encounter Union City Transit fixed-route or paratransit service.
2. The frequency with which LEP persons come in contact with Union City Transit fixedroute or paratransit service.
LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-2
3. The nature and importance of services provided by Union City Transit to the LEP population.
4. The resources available to Union City Transit and overall cost to provide LEP assistance.
A summary of the results from the four (4) factor analysis are in the following section.
2.3.1 The number or proportion of LEP persons in the
service area who may be served or are likely to
encounter Union City Transit services
2.3.1.1 Top Languages Spoken in Union City
Union City is home to a diverse population with residents from across the globe. As a recipient of Federal Transit Administration (FTA) funding, Union City Transit and Paratransit are required to ensure that no individual is denied access to public transportation due to a limited ability to speak or understand English.
Data Methodology and Changes
To identify these populations, the city utilizes the American Community Survey (ACS). This report uses composite estimates from 2019 to 2023. It is important to note two significant changes in how this data is reported:
• Reporting Structure: Prior to 2021, ACS Table B16001 tracked over 1,000 language classifications. Between 2015 and 2019, Union City identified 35 distinct languages spoken in local households.
• Current Categories: Following 2021, the Census Bureau consolidated these into 11 broad language categories (excluding English), as reflected in Figure 2.1 below.
FTA Safe Harbor Thresholds
The FTA establishes "Safe Harbor" thresholds to determine when a transit agency must provide translated materials or specialized outreach. A language group is considered significant if it meets either of the following criteria:
1. It constitutes 5% of the total population.
2. It includes at least 1,000 persons.
In Union City, three (3) unique non-English language groups(†) meet these criteria, representing 43% of the total surveyed population.

Summary of Findings
Chinese speakers represent the largest Limited English Proficient (LEP) group at 5.41%, exceeding both the 1,000-person and 5% FTA thresholds. While Spanish, Tagalog, and "Other Indo-European" groups also exceed the 1,000-person threshold, their percentage of "Less Than Well" English speakers is lower relative to the total population. These figures guide the city's prioritization of translated vital documents and bilingual staffing.
2.3.1.2 English Learner Data: New Haven Unified School District Annual student enrollment data from the California Department of Education provides a granular look at the English Learner (EL) population within the New Haven Unified School District. This data in Figure 2.2 serves to corroborate the Census Bureau’s ACS findings, offering a contemporary snapshot of the diverse languages spoken in Union City households.
Comparison to ACS Data
The school district’s data closely aligns with the linguistic trends identified in Figure 2.1. Notably, the top five language groups (†) identified by the ACS—excluding English—account for approximately 72.68% of all English Learners in the district.
While the ACS often groups related dialects, the school district data provides more specific breakdowns (for example, separating Cantonese and Mandarin). This level of detail allows Union City Transit to better understand the nuances of the community’s communication needs.

Key Observations
• Spanish Dominance: Spanish remains the most significant non-English language in the school system, representing over half (53.66%) of the English Learner population. • Secondary Groups: Punjabi and Persian (Farsi) are prominent secondary groups, consistent with the "Other Indo-European" category in the ACS data. • Asian Dialects: When combined, Mandarin and Cantonese speakers represent 12.02% of English Learners, reinforcing the need for Chinese-language transit materials.
2.3.1.3 Priority Languages for Transit Accessibility
Identifying the Threshold
In accordance with American Community Survey (ACS) methodology, residents are categorized based on whether they speak English "not well" or "not at all." Individuals in the latter category are considered Limited English Proficient (LEP). Union City Transit focuses its outreach and translation efforts on groups that exceed the 5% population threshold for LEP status.

Analysis and Next Steps
As shown in the data, Asian and Pacific Island is the only language group that currently comes close to the 5% threshold, representing 4.91% of the surveyed population. While Spanish (1.98%) account for less than 2% of those who speak English “not well: of “not at all”, he Chinese-speaking LEP population remains the highest priority for formalized language assistance plans.
2.3.1.4 Language Proficiency Among Public Transportation Commuters To refine its outreach and service delivery, Union City Transit analyzes the linguistic profiles of residents who utilize public transportation for their daily commute. While the American Community Survey (ACS) identifies general transit commuters rather than specific Union City Transit riders, this data provides a vital proxy for understanding the proficiency levels of the local ridership.
LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-6
Commuter Profile and LEP Analysis
Of the estimated 1,708 residents who use public transportation to commute, nearly 72% (1,231 individuals) speak a language other than English at home. However, the primary demographic for language support services consists of the 383 commuters (22.42%) who identify as Limited English Proficient (LEP), meaning they speak English "less than very well." As detailed in Figure 2.4, the vast majority of these LEP commuters fall within the "Other Languages" category, which includes Chinese and Punjabi speakers.

Key Findings
• High Multilingual Ridership: Less than 1% (0.68%) of commuters speak exclusively English, highlighting the multicultural nature of the city's transit user base (3.51%). • Significant LEP Presence: While Spanish speakers represent nearly 10% of riders, the vast majority of Spanish-speaking commuters report high English proficiency. • Focus on "Other" Languages: The most significant portion of the LEP ridership falls within the "Other Languages" category (which includes Chinese and Punjabi).
Roughly 22% of all transit commuters speak these languages and have limited English proficiency.
Conclusion
These findings emphasize that language assistance efforts should not only be available but should be specifically tailored toward the non-Spanish, multilingual groups that represent over one-fifth of the total commuting population.
2.3.1.5 Languages Recognized and Spoken by Staff Providing Union City Transit Services
A survey was conducted among 72 personnel—including city employees and contractors—who provide Union City Transit and Paratransit services and interact directly with the public. The findings from thirty-five (35) respondents demonstrate a high level of "linguistic awareness," as staff can often recognize the language or geographic origin (such as Asia or India) of a customer even when they are not fluent in that specific language. Figure 2.5 LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-7
Key Findings: Recognition and Proficiency
The survey results shown in Figure 2.5 align closely with the U.S. Census Bureau’s American Community Survey (ACS) data for Union City:
• Recognition: Staff frequently identified Spanish (65.71%), Chinese (37.14%), and Punjabi (22.86%) as the most common languages spoken by customers. • Proficiency: More than half of the respondents (51.43%) are proficient in Spanish, enabling direct assistance to Spanish-speaking riders. Furthermore, 11.43% of the workforce is proficient in Chinese, with an equal percentage (11.43%) fluent in Punjabi.
Demographic Alignment
The high recognition of Spanish, Chinese, and Indic languages (such as Punjabi and Hindi) confirms that staff capabilities are consistent with local demographics. Interestingly, the high frequency of these encounters suggests that the actual transit-using population may differ from the broader "Limited English Proficient" (LEP) groups identified in the ACS. This indicates that current outreach efforts are successfully reaching these key linguistic groups.

2.3.2 Frequency of Contact with LEP Individuals
A six-question survey was administered to 72 personnel involved in Union City Transit and Paratransit services, including city employees and contractors. Among the 35 respondents, the study evaluated the frequency of interactions between frontline staff and Limited English Proficient (LEP) individuals.
Interaction Frequency Analysis
The results indicate that the vast majority of staff interact with LEP customers on a regular basis.
Specifically, 91.43% of respondents encounter an LEP customer at least once per week. The most common frequency reported was 1–5 interactions per week, accounting for 65.71% of the workforce.

Linguistic Awareness vs. Assistance
The survey highlights a high level of linguistic awareness among staff. Most employees can recognize a customer's language and provide basic assistance even without being fluent in that language. Notably, the data revealed a specific challenge: a significant percentage of staff can identify a language they are personally familiar with but still feel unable to provide the technical or detailed assistance required for a specific transit transaction.

2.3.3 The nature and importance of services provided by Union City Transit to the LEP population
To ensure equitable access, Union City Transit evaluates how its services intersect with the needs of Limited English Proficient (LEP) residents. This involves comparing demographic data against specific transit service points where communication is critical.
Identifying the LEP Population
The primary language groups requiring assistance are consistently identified across three data sources:
• Census Data (ACS): Identifies Chinese, Spanish, Tagalog, and Vietnamese as the largest LEP concentrations.
LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-10
• Educational Data (CDE): Highlights Spanish, Filipino (Tagalog), Punjabi, and Chinese (Cantonese/Mandarin) as the most frequent languages among English learners. • Staff Observations: Personnel report regular interactions with speakers of Spanish, Chinese, Tagalog, and Punjabi.
High-Contact Service Points
Union City Transit identifies the following service areas as critical "touchpoints" where language barriers may impact a rider's ability to utilize the system:
Verbal Communication Requirements:
• Fixed-Route Bus Service: Interactions with drivers regarding routes, stops, and fare payment.
• Paratransit Service: Specialized communication for eligibility, scheduling, and door-todoor assistance. • City Hall Cashier’s Window: Vital transactions involving the purchase of transit and paratransit fare products.

Analysis of Existing Translation Tools
While the presence of bilingual staff provides a significant benefit for real-time translation, their availability across all shifts and service locations is not guaranteed. To supplement internal staff capacity, the City currently utilizes the following:
• Public Safety Model: The Union City Police Department currently employs a professional telephonic interpretation service for non-English callers, providing a framework that could be expanded to transit services.
• Web Accessibility: The City’s official website includes an automated translation feature for all digital content.
• Community-Led Translation: The September 2022 Map and Schedules brochure was translated into Spanish and Chinese through a collaborative effort involving city staff, contractors, and community volunteers.
Future Requirements
To maintain high standards of accuracy and reliability for "vital documents," Union City Transit recognizes the need to transition from volunteer-based translation to professional written translation services. Future priorities for formalized translation include:
• Standardized System Maps and Route Schedules.
• Paratransit program brochures and eligibility materials. • Official service announcements and rider alerts.
2.4 LEP IMPLEMENTATION PLAN
Based on the four (4) factor analysis, Union City Transit developed its LEP Plan into five (5) areas as follows:
Identifying LEP individuals who need language assistance Language assistance measures
Training staff
Providing notice to LEP persons
Monitoring and updating the LEP Plan
2.4.1 Identifying LEP Individuals and Language Assistance Measures
How Union City Transit may identify an LEP person who needs language assistance Data Collection and Tracking: Union City Transit will begin documenting language assistance requests received via telephone and during public meetings. This data will be used to identify emerging linguistic trends and determine the necessary accommodations for future public outreach events.
LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-12
Active Participant Engagement: During transit-sponsored events, staff will be stationed at entry points to greet participants. These informal interactions allow personnel to gauge the English proficiency of attendees in real-time and provide immediate, low-level navigation assistance if required. Self-Identification Tools: Census Bureau Language Identification Flashcards (see Appendix G) will be made available at registration tables during all public events. While immediate translation may not be available for every language identified on-site, this "self-identification" process is vital for documenting specific language needs and planning professional interpretation for future engagements.
2.4.2 Language Assistance Measures
Union City Transit is committed to providing meaningful access to its services through a variety of oral and written language assistance measures. These strategies ensure that staff can effectively respond to LEP individuals in person, over the phone, or through written correspondence.
Implementation Strategies for LEP Assistance
To support Limited English Proficient (LEP) individuals, Union City Transit will implement the following measures:
Community Partnership & Outreach:
• Senior Centers: Collaborate with local senior centers to disseminate vital information regarding transit programs and services directly to LEP populations. • Human Service Organizations: Network with local organizations serving LEP individuals to identify opportunities for joint outreach and information sharing.
Public Meetings & Legal Notices:
• Interpreter Statements: Include formal notices in all public publications stating that interpreter services are available for public hearings upon advanced request. • Direct Support Services:
• Professional Interpretation: When a language barrier is encountered in person or via telephone, staff will utilize professional translation services or qualified staff. • Language Identification Tools: Provide Language Identification Flashcards (Appendix G) at City Hall, on all transit vehicles, in Road Supervisor vehicles, and at administrative offices to help staff quickly identify a customer's primary language.
Digital & Administrative Resources:
• Online Accessibility: Maintain the Title VI Program and Language Access Plan (LAP) on the official website (www.uctransit.org) and continue offering an online translation tool for all web content.
• Staff Monitoring: Conduct an annual survey of transit personnel to document their experiences and the frequency of their contacts with LEP individuals over the previous year.
LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-13
2.4.3 Staff Training and Education
To ensure the effective delivery of the Language Access Plan (LAP), Union City Transit will implement a comprehensive training program for all frontline staff, supervisors, and contractors. This training is designed to standardize the agency's response to Limited English Proficient (LEP) individuals and ensure "meaningful access" across all service points.
Training Program Components
The curriculum will include the following core elements:
• Regulatory Framework: Education on Title VI of the Civil Rights Act and specific FTA requirements regarding non-discrimination and language access for LEP populations.
• Service Overview: A detailed orientation on the full suite of language assistance services offered by Union City Transit, including digital tools, telephonic interpretation, and translated materials.
• Standard Operating Procedures (SOPs): Clear, step-by-step instructions on the protocols to follow when encountering an LEP individual. This includes:
• Initial engagement and language identification.
• Accessing professional translation or interpretation resources. • Reporting and documenting the interaction.
• Complaint Handling: Guidance on identifying and processing potential Title VI/LEP grievances to ensure all customer concerns are handled according to federal guidelines.
• Identification Tools: Practical instruction on the use of Language Identification Flashcards (Appendix G) to facilitate quick and accurate communication in the field.
2.4.4 Providing Notice to LEP Persons
Union City Transit employs a multi-channel approach to ensure that Limited English Proficient (LEP) individuals are informed of available services and their rights. Notifications are delivered through both oral and written communications, with a focus on Spanish and Chinese—the primary languages identified in the demographic analysis.
Oral Communication and Interpretation Services:
To facilitate real-time interaction and verbal notification, the agency implements the following:
• Telephonic Interpretation: As of January 2026, the Administrative Services Department is evaluating a renewed professional phone-based interpretation service. Union City Transit is integrated into this system to provide immediate assistance to non-English speaking callers.
• Public Meeting Accommodations: All notices for public hearings and community meetings include a clear statement affirming that Union City Transit will provide interpreters upon request, provided advance notice is given.
LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-14
• Vital Document Verification: The agency utilizes professional translation providers to ensure the oral explanation and written accuracy of "vital documents"—those essential for accessing transit benefits or services.
Written Communication and Translated Materials:
Union City Transit prioritizes the translation of key informational assets into Spanish and Chinese to maintain consistency with local LEP needs:
• Rights and Compliance: Non-discrimination policies and instructions for the local/federal complaint process (Title VI) are available in both Spanish and Chinese. • Passenger Guides: The general information section of the system maps and schedules—covering fares, hours of operation, pass sales, and accessibility—is fully translated. • Service Alerts and Interior Signage: * Rider Alerts: Onboard flyers and posted notices regarding route changes, fare increases, or public hearings are provided in Spanish and Chinese. • Interior Bus Cards: Onboard fare displays and informational cards include bilingual translations.
• Digital Access: The official website (www.uctransit.org) features an integrated webpage translation tool.
• Data Collection: All onboard passenger surveys are distributed in Spanish and Chinese to ensure diverse rider feedback is captured.
2.4.5 Monitoring and Updating the Language Assistance
Plan
This plan is designed to be flexible, and should be viewed as a work in progress. As such, it is important to consider whether new documents and services need to be made accessible for LEP persons, and also to monitor changes in demographics and types of services.
How Union City Transit will examine and update the LAP
Union City Transit will update the LAP as required by USDOT. At a minimum, the LAP will be reviewed and updated when a Title VI Program update is due every three (3) years; if time and resources permit, the LAP will be reviewed annually when it is clear that higher concentrations of LEP individuals are present in the Union City Transit service area. The following details the methodology that will be used:
Record and report the number of LEP persons encountered annually as documented by Union City and Union City Transit staff;
LAP PROGRAM| MARCH 2026
City of Union City – Union City Transit | 2-15
Determine how the needs of LEP persons have been addressed; Determine the current LEP population in the service area and whether the need for translation services has changed;
Determine whether local language assistance programs have been effective and sufficient to meet the need;
Determine whether transit system’s financial resources are sufficient to fund language assistance resources needed;
Determine whether the Union City Transit and its Contractor have fully complied with the goals of this LAP;
Determine whether complaints have been received concerning the agency’s failure to meet the needs of LEP individuals.
Dissemination of the Union City Transit Language Assistance Plan The Union City Transit LAP will be disseminated to customers and the community as follows:
A link to the Union City Transit Title VI Program and Language Assistance Plan will be included on the Union City Transit website, www.uctransit.org. Any person or agency with internet access will be able to access and download the plan from the Union City Transit website, www.uctransit.org. Alternatively, any person or agency may request a copy of the plan via telephone, fax, mail, or in person (at Union City City Hall), and shall be provided a copy of the plan at no cost. LEP individuals may request a translated copy.

This tool allows visitors to instantly translate all website content into multiple languages, supporting the agency's commitment to serving Limited English Proficient (LEP) individuals.
Alternative Outreach and Digital Engagement Strategies
To ensure equitable representation, Union City Transit actively seeks to engage residents who may be unable to attend or typically do not participate in traditional public meetings and board hearings. In coordination with the Union City Marketing and Communications group, the agency utilizes various social media platforms to expand its outreach. This digital presence fosters continuous two-way communication between formal meetings, strengthening the ongoing dialogue with the community and supporting the agency’s commitment to transparency.
Furthermore, Union City Transit utilizes project-specific email blasts to facilitate direct communication and solicit feedback from a targeted range of stakeholders. These distributions reach community-based organizations, advocacy groups, merchant associations, neighborhood groups, and other interested individuals. In addition to project-specific lists, the agency maintains a general email database for residents who wish to receive broad updates on transit news and outreach activities. Members of the public can subscribe to these updates via the website, by phone, in person, by mail, or during public meetings.
3.2.5 Language Assistance and Information Delivery
Union City Transit ensures that vital information is accessible to the city’s diverse population by developing and publishing schedules, informational sheets, and brochures in English, Spanish, and Chinese. Beyond standard transit materials, the agency produces project-specific resources— such as fact sheets, Frequently Asked Questions (FAQs), and flyers—tailored to current or upcoming programs. To remain responsive to community needs, these documents are periodically updated based on direct feedback and questions received from the public.
Distribution and Digital Access
Translated materials are disseminated across multiple platforms to maximize reach. These resources are regularly posted on the official website (www.uctransit.org), distributed during community events, and displayed prominently within the transit environment, including vehicle interiors, transit centers, and bus shelters.
Translation and Interpretation for Public Forums
For community meetings and public hearings, Union City Transit provides translation and interpretation assistance to facilitate meaningful participation. Depending on the specific language needs and the nature of the event, support is provided through:
• Bilingual Personnel: Qualified Union City Transit staff members. • Professional Services: Contracted external translators and interpreters. • Community Partners: Knowledgeable community members who assist with linguistic bridge-building.

PUBLIC PARTICIPATION| MARCH 2026
To ensure the availability of these specialized services, stakeholders are requested to provide at least 84 hours' advance notice prior to the scheduled meeting or hearing.
3.3 MONITORING AND UPDATING
To maintain an effective and equitable engagement strategy, Union City Transit treats its public participation process as a dynamic system that requires regular assessment and refinement.
3.3.1 Evaluation and Continuous Improvement of Outreach Union City Transit is committed to a data-driven approach for public engagement. The agency will systematically evaluate all project-specific outreach efforts to determine the efficacy of its engagement methods, specifically regarding their success in reaching minority and Limited English Proficient (LEP) populations.
To facilitate this assessment, comment cards and demographic surveys will be distributed at all public meetings. These tools are designed to capture both specific project feedback and suggestions for improving the agency's overall outreach delivery.
Performance Metrics and Evaluation Criteria
To move beyond anecdotal evidence, Union City Transit will utilize the following evaluation framework:
• Quantitative Metrics: Evaluation will be based on measurable data, including the total number of participants from targeted LEP-census tracts, the volume of comments received in languages other than English, and the documented diversity of stakeholders at community forums.
• Qualitative Assessments: Staff will document qualitative feedback, such as verbal suggestions regarding cultural barriers or the clarity and cultural relevance of translated materials. This ensures a nuanced understanding of community needs that data points alone may miss.
• Annual Review and Adaptation (The Feedback Loop): The results of these evaluations will be reviewed annually by the transit management team. If specific outreach methods—such as traditional evening hearings—demonstrate low participation among LEP or minority groups, the agency will pivot to alternative strategies. These may include "pop-up" events at high-traffic community hubs (e.g., grocery stores, religious centers) or weekend workshops to better accommodate the schedules and preferences of all community members.
3.3.2 Updating Public Participation Activities
Union City Transit views its Public Participation Plan (PPP) as a "living document" that requires periodic updates to remain effective and compliant with Title VI regulations. To ensure the agency’s outreach remains relevant and inclusive, Union City Transit will update its participation strategies as necessary based on the following shifting factors:
PUBLIC PARTICIPATION| MARCH 2026
• Demographic Shifts: Periodic review of U.S. Census and American Community Survey (ACS) data to identify changes in the size or concentration of minority and Limited English Proficient (LEP) populations within the service area. • Technological Advancements: Integration of new digital communication tools, social media platforms, and translation technologies that lower barriers to participation. • Regulatory Guidance: Incorporation of updated Federal Transit Administration (FTA) circulars, Department of Transportation (DOT) orders, and best practices for environmental justice and non-discrimination.
• Internal Lessons Learned: Refinement of strategies based on the annual evaluation of previous outreach efforts to determine which specific methods yielded the most diverse and meaningful community input.
By maintaining this iterative process, Union City Transit ensures a continued commitment to reaching all communities. This ongoing evolution is critical to maintaining the agency's relevance and ensuring that no population is excluded from the transit planning and decision-making process.

Public Transportation Agency Safety Plans (PTASP). The deadline for certification was July 20, 2020, however, in light of the extraordinary challenges presented by the COVID-19 public health emergency, FTA issued a Notice of Enforcement Discretion for the PTASP regulation (49 CFR Part 673). FTA will refrain from taking enforcement action until July 21, 2021 for applicants and recipients unable to certify compliance with the PTASP regulation before July 20, 2021. While applicants and recipients are encouraged to certify compliance as soon as reasonably practicable under the current circumstances caused by the COVID-19 public health emergency, those who do not certify compliance until July 20, 2021 remain eligible for Chapter 53 grant funds.

Citizen Rights Under
Title VI of the Civil Rights Act of 1964
This document outlines the Title VI complaint procedures related to providing programs, services, and benefits. These procedures are printed in English, Spanish and Chinese in the Union City Transit Route Guide & Timetables brochure. These procedures are printed in English, Spanish and Chinese in the Union City Transit Route Information displays at the Union City BART Station and Union Landing Transit Center. These procedures are printed in English in the Union City Paratransit Rider’s Guide and are available in Spanish and Chinese upon request.
Title VI of the Civil Rights Act of 1964 requires that no person in the United States, on the grounds of race, color or national origin be excluded from, be denied the benefits of, or be subjected to discrimination, under any program or activity receiving federal financial assistance. Two Executive Orders extend Title VI protections to Environmental Justice, which also protects persons of low income, and Limited English Proficiency (LEP).
Title VI Complaint Procedure
1. Any person who believes that they have been subjected to discrimination may file a written complaint with Union City Transit. Federal and State law requires complaints be filed within one-hundred eighty (180) calendar days of the last alleged incident.
2. The complainant may download the complaint form from www.uctransit.org or request the complaint form from the Title VI coordinator.
3. The complaint will include the following information:
a. Name, address, and telephone number of the complainant. b. Name, address, and telephone number of the person being discriminated against (if different from the complainant).
c. The basis of the complaint (race, color, national origin). d. The date or dates on which the alleged discrimination took place. e. A description of the alleged discrimination in the words of the complainant and an explanation of what happened and who is believed to be 2 responsible.
f. Other agencies or courts where the complaint may have been filed. g. Name, address, and telephone number of the contact person at the agency/court where the complaint was filed.
h. Complainant’s signature and date.

(510) 675-5446
(510) 675-9885 (fax)
Complainants also have the right to complain directly to the appropriate federal, state, or local agency and/or court. Should a complaint be filed with an external entity simultaneously, the external complaint shall supersede the Union City Transit complaint and the Union City Transit’s complaint procedures will be suspended pending the external entity’s findings. Complaints must be filed within one-hundred eighty (180) calendar days of the last alleged incident.
Title VI Investigation Procedure
1. Union City Transit will begin an investigation within fifteen (15) working days of receipt of a complaint.

If the complainant fails to provide the requested information in a timely basis, Union City Transit may administratively close the complaint.
3. Union City Transit will complete the investigation within ninety (90) working days of receipt of the complaint. If additional time for investigation is needed, the complainant will be contacted. A written investigation report will be prepared by the investigator. This report shall include a summary description of the incident, findings and recommended corrective action.
4. A closing letter will be provided to the complainant. The respondent will also receive a copy of the closing letter. Each party will have five (5) working days from receipt of the report to appeal. If neither party appeals, the complaint will
