RESOLUTION NO. 2026-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
APPROVING AND ADOPTING THE SIDE LETTER TO THE
MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF
UNION CITY AND THE OPERATING ENGINEERS LOCAL 3 –
PROFESSIONALS GROUP (OE3-PEG) TO ADDRESS LEAVES FOR
THE PERIOD OF JULY 1, 2024 THROUGH JUNE 30, 2025, AND
AUTHORIZING THE CITY MANAGER TO EXECUTE THE SIDE LETTER
ON BEHALF OF THE CITY REGARDING LEAVE ADMINISTRATION
WHEREAS, the City of Union City (City) and the Operating Engineers Local 3 – Professionals Group (OE3-PEG) have entered into a Memorandum of Understanding effective January 1, 2025, through December 31, 2027 (the MOU); and WHEREAS, the City staff have entered into negotiations for a side letter to the MOU; and
WHEREAS, pursuant to the provisions of the Meyers-Milias-Brown Act (Government Code Section 3500, et seq.) and the Union City Municipal Code, the City Manager or her designee, as authorized by the City Council, has met and conferred in good faith with representatives of OE3-PEG on matters related to Section 3.0 Leaves of the MOU; and
WHEREAS, the City and OE3-PEG were previously parties to an MOU that included the period of July 1, 2024, through June 30, 2025, and established provisions related to maximum accruals related to administrative leaves or floating holidays; and WHEREAS, the representatives of the City and OE3-PEG have reached a tentative agreement for a side letter to the MOU on Section 3.0 Leaves, attached hereto and incorporated herein by this reference as Exhibit A; and WHEREAS, the City Council finds that the terms and conditions of the Side Letter are proper and in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby approves and adopts the Side Letter to the MOU between the City of Union City and the OE3-PEG; and
BE IT FURTHER RESOLVED that the City Council of the City of Union City hereby authorizes the City Manager to execute the Side Letter to the MOU’s on behalf of the City and to take such further actions as may be necessary to implement the Side Letter, including any necessary non-substantive modifications.
