RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
APPROVING THE AWARD OF A CONSTRUCTION CONTRACT TO
RNR PAVING, INC., IN THE AMOUNT OF $271,923, AND APPROVING A TOTAL CONSTRUCTION BUDGET IN THE AMOUNT OF $326,308,
FOR THE KENNEDY PARK IMPROVEMENTS, PHASE I PROJECT,
CITY PROJECT NO. 24-15
WHEREAS, Charles Kennedy Park (“Kennedy Park”), located on the eastern side of the City, is a large park located in the Decoto neighborhood near the Union City BART Station. The park features several playground areas, picnic areas, large open expanses of grass, a shaded concrete amphitheater, and the Kennedy Youth Center; and
WHEREAS, to maintain Kennedy Park as a vibrant hub for City residents, several improvements have been included in the Five-Year Capital Improvement Plan for Fiscal Years 2025-2026 to 2029-2030; among them, Kennedy Park Improvements, Phase I (“Project”), seeks to rehabilitate the Kennedy Park parking lot; and WHEREAS, the Project will address the deteriorating pavement, while also creating improved drainage, achieving ADA compliance, and implementing landscaping improvements to better integrate with the existing infrastructure; and WHEREAS, on June 14, 2022, City Council approved Resolution No. 5956-22, approving the 2022-2023 Community Block Development Grant Annual Action Plan in order to secure funding from the U.S. Department of Housing and Urban Development.
This specific grant funding is provided to states, cities, and counties for community development, affordable housing, and infrastructure projects that focus on public facility upgrades, economic development, and neighborhood revitalization; and WHEREAS, on November 24, 2024, the City executed a Consulting Services Agreement with CSG Consultants, Inc., in the amount of $73,684, for engineering design of improvements to the Kennedy Park parking lot; and WHEREAS, on February 6, 2026, the City of Union City released a Notice Inviting Bids for the Kennedy Park Improvements, Phase I Project, City Project No. 24- 15; and
WHEREAS, on February 25, 2026, the City received fifteen bids (see Exhibit A), with the lowest responsive and responsible bid of $271,922.91 submitted by RNR Paving, Inc., of San Ramon, California; and
WHEREAS, the low bid is approximately 36% under the engineer’s estimate of $425,000, which is mainly attributable to the off-peak construction period; and WHEREAS, although the City has no prior experience with RNR Paving, Inc., a reference check was found satisfactory; and
WHEREAS, the recommended Total Construction Budget, in the amount of $326,308, includes the construction contract ($271,923), a contingency amount of 15% Resolution No. 2026-XXX
Award Construction Contract for the Kennedy Park Improvements, Phase I Project
of the construction contract ($40,789), and engineering support at 5% of the construction contract ($13,596); and
WHEREAS, the Kennedy Park Improvement Project, Phase I, City Project No. 24-15, in the amount of $326,308, will be funded with Community Development Block Grant funds (Account Number 231-92415-57127), as identified in the Five-Year Capital Improvement Plan (CIP) for FY 2025-2026 through FY 2029-2030.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby awards the construction contract for the Kennedy Park Improvements, Phase I Project, City Project No. 24-15, to RNR Paving, Inc., in the amount of $271,923; and
BE IT FURTHER RESOLVED that the City Council of the City of Union City hereby approves a Total Construction Budget, with contingencies and engineering support, in the amount of $326,308, for the Kennedy Park Improvements, Phase I Project, City Project No. 24-15.
