EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution approving an increase in the Fiscal Year 2025-2026 Annual Clean Water Program Contribution by $126,200 in the Clean Water Fund (Fund 258) to pay the City of Fremont for the services of Larry Walker Associates and authorizing the City Manager to sign the associated letter agreement.

STRATEGIC PLAN ALIGNMENT
This agenda item is aligned with the following:

Goal D: Create a healthy, sustainable community and maintain and improve the City’s Infrastructure.

BACKGROUND
On January 24, 2012, the City Council adopted Resolution No. 4257-12 approving an Agreement Providing for Implementation of the Alameda Countywide Clean Water Program (Agreement). The original agreement was first adopted in 1991 by the cities in Alameda County, County of Alameda, the Alameda County Flood Control and Water Conservation District (District), and the Zone 7 Water Agency. The Agreement allows the cities and agencies to work collaboratively to implement several activities required under the Municipal Stormwater National Pollutant Discharge Elimination System (NPDES) permit. The City of Fremont serves as the Fiscal Agent for the Alameda Countywide Clean Water Program, which Larry Walker Associates currently supports. Program operational costs, including support from Larry Walker Associates, are paid through cost allocations to each participating city or agency as adopted in the Agreement.

Agenda Item No. 3.3

On May 11, 2022, the San Francisco Bay Regional Water Quality Control Board adopted Order No. R2-2022-0018, which replaced the previously reissued countywide Municipal Regional Stormwater NPDES Permit (MRP). The reissued permit, MRP 3, was subsequently amended in October 2023 with Order No. R2-2023-0019.

Under MRP 3, the City of Union City was required to achieve 100 percent trash reduction by June 30, 2025. A Full Trash Capture Feasibility Study completed in 2023 identified implementation of full trash capture devices in the public right-of-way and on private property. City Project No. 25-11, the Citywide Trash Capture Device Installation Project, installed 80 connector pipe screen (CPS) devices and 7 hanging basket devices within the public right-of-way. No devices were installed on private property. Instead of installing full trash-capture devices on private property, the City committed to the San Francisco Bay Regional Water Quality Control Board to conduct Private Land Drainage Area (PLDAs) inspections for 115 private sites using On-Land Visual Trash Assessments (OVTAs) by June 30, 2026.

DISCUSSION
Private Land Drainage Areas (PLDAs) are trash-generating private properties that drain directly to the City’s storm drain system without any treatment measures or trash control devices prior to discharge into the City’s system. The Clean Water Program manages PLDA data and reporting through its ArcGIS online application.

Before the City can track and manage the PLDAs, the 115 identified locations must be verified and entered into the Program’s ArcGIS. Additional tasks include confirming each site’s drainage infrastructure, preparing for and conducting the PLDA inspections using the OVTA method, and establishing a scheduled program and maps to support three inspections per year.

Given the timeframe and number of PLDA sites that must be addressed to achieve compliance by June 30, 2026, staff require additional support. Larry Walker Associates, which serves as the Program Manager for implementation of the Alameda Countywide Clean Water Program for the Alameda County cities and agencies under the Agreement, can provide this support to the City of Union City. Costs associated with the PLDA verification, OVTA inspections, and compliance planning will be additional costs to the City’s annual contributions for Program operations, which are paid to the City of Fremont.

The estimated additional cost is $126,200.

FISCAL IMPACT
The funding for the City’s annual Program contributions is budgeted under the Clean Water Program (Fund 258). The additional support provided by Larry Walker Associates, in the amount of $126,200, will also be funded through the Clean Water Program (Fund 258).

There is no impact on the General Fund.
