Agenda Item No. 3.5
DATE: April 14, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Joan Malloy, City Manager
SUBJECT: Adopt a Resolution Authorizing the City Manager to Execute the First Amendment to the Consulting Services Agreement with Douglas Herring & Associates for CEQA Mitigation Monitoring Services for the Lazuli Landing Project
EXECUTIVE SUMMARY
Staff recommends that the City Council adopt the attached Resolution authorizing the City Manager to execute the First Amendment to the Consulting Services Agreement with Douglas Herring & Associates (Agreement No. C26ECD1247) for mitigation monitoring services in conformance with the California Environmental Quality Act (CEQA) for the Lazuli Landing Project (Project) in the amount of $99,713, for a total not-to-exceed contract amount of $182,286, and to extend the agreement term from June 30, 2027, to December 31, 2027.
STRATEGIC PLAN ALIGNMENT
This agenda item is aligned with the following:
Goal C, Strategy 5: Promote housing development for all income levels in the community by implementing the Housing Element, updating the zoning ordinance to include objective standards for new multi-family residential development to streamline the review of applications for housing developments, and other measures.
BACKGROUND
The Lazuli Landing Project is an 81-unit affordable housing development by MidPen Housing Corporation (“MidPen”) on 1.65 acres owned by the City that will be leased to MidPen for 99 years. The project received its major entitlements in the 2019-2021 timeframe, and approvals for amendments to the Disposition, Development, and Loan Agreement, the Financing Plan, and the Final Parcel Map were granted on October 28, 2025. Construction began in mid-December 2025, with completion planned for mid-2027.
A Mitigation Monitoring and Reporting Plan (MMRP) was included with the Mitigated Negative Declaration approved for the Project under the California Environmental Quality Act (CEQA) on February 11, 2020. The MMRP includes several mitigation measures that Agenda Item No. 3.5

require monitoring throughout construction.
The City Council approved the Consulting Services Agreement with Douglas Herring & Associates on December 16, 2025, via Resolution No. 2025-169 in an amount not to exceed $82,573.
DISCUSSION
The mitigation monitoring and reporting program implementation includes, among other things, archeological monitoring due to the high likelihood of encountering archaeological resources associated with ground-disturbing activities. As construction progressed, more days have been added for grading and trenching activities due to site constraints and the difficulty of having multiple trades working simultaneously. In addition, some Saturday work was added. The increase in days associated with ground disturbance work and associated monitoring requires an amendment to the existing consulting services agreement.
The amendment amount is $99,713 and includes a contingency for additional unforeseen days of grading to avoid returning to the City Council for approval of a second amendment. The additional amount of $99,713, added to the original contract amount of $82,573, results in a new total not-to-exceed contract amount of $182,286. The amendment also extends the agreement term from June 30, 2027, to December 31, 2027.
FISCAL IMPACT
There is no impact on the General Fund. MidPen will pay for the agreement with Douglas Herring & Associates.
RECOMMENDATION
Staff recommends that the City Council adopt the attached Resolution (Attachment 1) authorizing the City Manager to execute the First Amendment to the Consulting Services Agreement with Douglas Herring & Associates (Agreement No. C26ECD1247) for mitigation monitoring services for the Lazuli Landing Project to increase the agreement by $99,713, for a total not-to-exceed contract amount of $182,286, and to extend the agreement term to December 31, 2027.
