WHEREAS, the Environmental Consultant has prepared the First Addendum to the previously certified East West Connector Project 2009 Final EIR for the Quarry Lakes Parkway, Phases (Segments)1-4 in Union City, dated April 2026 (“First Addendum”) (see Exhibit A). The First Addendum describes and analyzes the environmental impacts of the proposed changes to Phases 1-4 of the Quarry Lake Parkway as compared to the project and impacts analyzed in the 2009 Final EIR to determine if future environmental review was required under the CEQA subsequent review standards outlined in Public Resources Code section 21166 and CEQA Guidelines section 15162; and WHEREAS, Section 3.3, Design Changes Since the EWC EIR (referred to herein as the 2009 Final EIR) in the First Addendum identifies the project changes in detail, and below is a summary of these changes. The complete description in the First Addendum of all the proposed changes to the project analyzed in the 2009 Final EIR is incorporated herein by reference.
1) Roadway Changes
The roadway changes have been made to improve bicycle and pedestrian access and include the modification of the Quarry Lakes Drive alignment, the removal of the short street connection from Osprey Drive to Quarry Lakes Parkway, modifications to the Alvarado-Niles Road/Lotus Pond Common intersection, and new multi-use trails along 7th Street and Mission Boulevard. 2) Drainage Infrastructure Changes
The proposed water-quality stormwater treatment basin is located on Quarry Lakes Drive and Old Alameda Creek, and the proposed hydromodification basin is utilizing Old Alameda Creek, which is underutilized. These stormwater basins were not identified in the EWC EIR. The planned 84-inch bypass pipeline from the Line M Flood Control Channel to Old Alameda Creek, identified in the EWC EIR, has been redesigned as a 60-inch overflow pipeline. 3) Mitigation for Waters/Wetlands/Riparian Effects
The planned mitigation area identified in the EWC EIR was located within the project limits as onsite migration within the area of Old Alameda Creek adjacent to Quarry Lakes Drive. When the design and cost of onsite mitigation were determined to be infeasible, offsite mitigation sites were evaluated, including the Eagle Ridge East and Manning Ranch sites in Livermore, as identified in the Habitat Mitigation & Monitoring Plan (“HMMP”) dated April 2026, which the regulatory agencies have conditionally approved.

WHEREAS, the roadway design changes in the First Addendum described above to improve bicycle, pedestrian, and transit access and connections have been presented to the Bicycle and Pedestrian Advisory Committee (BPAC) since 2019 for comments and discussion with the BPAC members, bike advocates, and the general public (see Exhibit B for List of BPAC Meetings); and
WHEREAS, project changes in the First Addendum described above have been presented to the City Council for comments and discussion with the City Council and the general public (see Exhibit C for List of City Council Meetings); and Resolution No. 2026-XXX
Adopt First Addendum of EWC EIR for Quarry Lakes Parkway, Phases 1-4

WHEREAS, the City Council is considering the Addendum in connection with the proposed approval of the work relating to the new proposed off-site mitigation for biological impacts under an agreement with Rocky Ridge, LLC.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby certifies, finds, and declares as follows:

A. The foregoing recitals are true and correct and made a part of this resolution.

B. The First Addendum to the certified East West Connector Project Final Environmental Impact Report for Quarry Lakes Parkway, Phases (Segments) 1-4, City Project No. 18-04, attached hereto as Exhibit A, has been prepared as required by CEQA. The document reflects the independent judgment and analysis of the City of Union City, which has exercised overall control and direction of its preparation.

C. Based on the evidence and analysis in the First Addendum and the record as a whole relating to the First Addendum, the City Council finds that no supplemental environmental review under Public Resources Code section 21166 and CEQA Guidelines section 15162 is required for the proposed changes to Phases 1-4 of the Quarry Lakes Parkway Project described in the First Addendum. In particular, the City Council finds there is substantial evidence showing that none of the following standards for supplemental environmental review are met relating to Phases 1-4 of the Quarry Lake Parkway Project (“Project”):

1. Substantial changes to the Project that require major revisions to the 2009 Final EIR because of the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; or

2. Substantial changes will occur with respect to the circumstances under which the Project is undertaken, which will require major revisions to the 2009 Final EIR because of the involvement of new significant environmental effects or a substantial increase in the severity of previously identified effects; or

3. New information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the 2009 Final EIR was certified as complete, shows any of the following:
• The project will have one or more significant effects not discussed in the 2009 Final EIR; or
• Significant effects previously examined will be substantially more severe than shown in the 2009 Final EIR; or
• Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the project proponents declined to adopt the mitigation measure or alternative; or
• Mitigation measures or alternatives that are considerably different from those analyzed in the 2009 Final EIR would substantially reduce one or more significant effects on the environment, but the project proponents declined to adopt the mitigation measure or alternative.

Resolution No. 2026-XXX
Adopt First Addendum of EWC EIR for Quarry Lakes Parkway, Phases 1-4

Page 5 of 5 ends

D. Pursuant to State CEQA Guidelines Section 15164(e), the First Addendum contains an explanation of the decision not to prepare a subsequent or supplemental EIR, pursuant to CEQA Guidelines Section 15162 and Public Resources Code Section 21166. Therefore, the City Council finds that no subsequent or supplemental EIR is required under CEQA for the proposed changes to the Project; and
BE IT FURTHER RESOLVED, the City Council of the City of Union City approves the First Addendum to the certified East West Connector Project Final Environmental Impact Report for Quarry Lakes Parkway, for Phases (Segments) 1-4, City Project No. 18-04, attached hereto as Exhibit A.
