SUBJECT: Adopt a Resolution Approving a Twelve-Month Extension of Tentative Parcel Map 11429 (TPM-24-001) at 32415 Winchester Drive (APN 475-0175-082-02)

EXECUTIVE SUMMARY
On June 27, 2024, the City of Union City Planning Commission adopted Resolution No. 10-24 approving Tentative Parcel Map 11429 (TPM-24-001), which authorizes the subdivision of an existing 32,540-square-foot parcel into three parcels located at 32415 Winchester Drive. The tentative map expires on June 27, 2026.

Pursuant to the Subdivision Map Act and Union City Municipal Code Section 17.28.140, the City Council may approve extensions of tentative maps. The subdivider is requesting a 12-month extension to complete the installation of required storm drain facilities serving all three parcels, consistent with the conditions of approval under Resolution No. 10-24, before the recordation of the final parcel map.

STRATEGIC PLAN ALIGNMENT
This agenda item is aligned with the following:

Goal C, Strategy 5: Promote housing development for all income levels in the community.

BACKGROUND
At its regular meeting on June 27, 2024, the Planning Commission held a public hearing to consider Tentative Parcel Map 11429 (TPM-24-001). Subsequently, it adopted a resolution approving the subdivision of an existing 32,540-square-foot parcel into three parcels. Pursuant to the Subdivision Map Act, a tentative map expires if a final map is not recorded within 24 months of its approval or conditional approval.

Tentative Parcel Map 11429 was approved subject to conditions, including a requirement that the subdivider install storm drain facilities to serve the three parcels and record an instrument providing for the ongoing maintenance of those facilities before filing the final parcel map with the City Clerk.

The subdivider has since submitted improvement plans to the Public Works Engineering Division for review and approval of the required storm drain facilities. Approval of the grading and encroachment permits is anticipated in the near term; however, construction of the storm drain improvements is not expected to be completed before June 27, 2026, when the tentative map is scheduled to expire.

DISCUSSION
Pursuant to the Subdivision Map Act and Union City Municipal Code Section 17.28.140, the City Council may grant extensions to the expiration date of an approved tentative map. The subdivider has submitted a request for a 12-month extension of Tentative Parcel Map 11429 (TPM-24-001) to allow additional time to complete the required storm drain improvements and satisfy the conditions of approval.

The requested extension would extend the tentative map's expiration date from June 27, 2026, to June 27, 2027. There are no proposed changes to the project, and all existing conditions of approval would remain in effect. Granting the extension would enable the subdivider to proceed with the necessary permitting and construction activities and ultimately record the final parcel map in compliance with the approved conditions.

The proposed extension is not subject to the provisions of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3), because the extension of time will not result in any changes to the previously approved project or its environmental setting, and no new environmental impacts would occur as a result of the extension.

FISCAL IMPACT
Approval of the requested tentative map extension would have no fiscal impact on the General Fund.

RECOMMENDATION
Staff recommends that the City Council adopt a resolution approving a twelve-month extension of Tentative Parcel Map 11429 (TPM-24-001) at 32415 Winchester Drive (APN 475-0175-082-02), extending the expiration date.
