RESOLUTION NO. 2026-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
ADOPTING AMENDED AND RESTATED GOALS AND POLICIES
REGARDING USE OF MELLO-ROOS COMMUNITY FACILITIES ACT OF 1982
WHEREAS, the City of Union City (the “City”) desires to assist community and economic development through the establishment of Mello-Roos community facilities districts; and
WHEREAS, the financial soundness of community facilities districts is important for the creditworthiness of the City; and
WHEREAS, Government Code Section 53312.7(a) requires that cities have a standard policy on the formation of Mello-Roos community facilities districts and the issuance of bonds by such districts; and
WHEREAS, the previously adopted goals and policies adopted by Resolution No. 9058-97 are outdated and do not meet the current requirements of Government Code Section 53312.7(a), and the new policies are designed to ensure compliance with all applicable legal standards.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Union City as follows:
1. The above recitals are true and correct, and the City Council so finds and determines.
2. The City Council hereby rescinds Resolution No. 9058-97 in its entirety.
3. The City Council hereby adopts the Amended and Restated Statement of Goals and Policies Regarding Use of the Mello-Roos Community Facilities Act of 1982, attached as Exhibit A.
4. This Resolution shall take effect immediately upon its adoption.
