RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
APPROVING A TIERED RECOVERY STRUCTURE FOR PROPERTY
OWNERS’ SIDEWALK REPAIR COSTS ASSOCIATED WITH THE 2025
ANNUAL SIDEWALK, CURB & GUTTER, AND RAMP REPAIR
PROJECT, CITY PROJECT NO. 25-03, AND AUTHORIZING A
REPAYMENT PLAN OF UP TO 24 MONTHS
WHEREAS, the City of Union City completed the 2025 Annual Sidewalk, Curb & Gutter, and Ramp Repair Project, City Project No. 25-03, for a total construction cost of $611,523; and
WHEREAS, pursuant to Section 5610 of the California Streets and Highways Code and Section 12.08.615 of the Union City Municipal Code, property owners are responsible for the repair and maintenance of sidewalks fronting their property; and WHEREAS, the City has historically funded sidewalk repair projects up front and subsequently sought reimbursement from property owners for their share of eligible costs; and
WHEREAS, the total cost attributable to property owners for this project is $278,346; and
WHEREAS, the City Council has expressed a desire to reduce the financial burden on property owners, particularly those who are economically disadvantaged; and WHEREAS, the City Council reviewed options for the City to recover only a portion of property owners’ sidewalk repair costs and determined that a tiered recovery structure would be equitable; and
WHEREAS, the proposed tiered recovery structure includes either electing not to recover 13% of the amount owned for property owners or 31.5% of the amount owed for property owners participating in the City’s Utility Users Tax (UUT) Exemption Program or Republic Services Discount Program; and
WHEREAS, the City Council also directed that property owners be provided the option to repay their remaining balance over a period of up to 24 months to reduce monthly payment amounts; and
WHEREAS, approval of the tiered recovery structure will reduce cost recovery to the City, but does not require appropriations for the completed project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby approves a tiered recovery structure for property owners for the 2025 Annual Sidewalk, Curb & Gutter, and Ramp Repair Project, City Project No. 25-03, consisting of either electing not to recover 13% of the amount owed for property owners or 31.5% of the amount owed for property owners participating in the UUT Exemption Program or Republic Services Discount Program; and

Approval of Tiered Underwriting Structure for Sidewalk Repair Program
BE IT FURTHER RESOLVED that the City Council of the City of Union City authorizes a repayment plan of up to 24 months for property owners to pay their remaining balance; and
BE IT FURTHER RESOLVED that the City Council of the City of Union City authorizes the City Manager, or her designee, to take all necessary actions to implement this Resolution, including verification of program eligibility and application of the appropriate underwriting amount to property owners’ final costs.
