ITEM 6.2

RESOLUTION REAFFIRMING AND

PROCLAIMING UNION CITY AS A

COMPASSIONATE CITY

2 Background
• Staff presented information regarding potential options to address civil immigration enforcement activities on City property to the Legislation and Policy Committee at its meeting on April 20, 2026.
• The Committee considered examples of actions taken by other jurisdictions including the City of Pinole, the City of South San Francisco, and Alameda County. • Following presentation and discussion, the Committee directed the City Attorney’s Office to prepare an ordinance for Council review that would prohibit the use of Cityowned and controlled facilities and property for civil immigration enforcement.

3 Background
• The City Council considered an ordinance that would prohibit the use of City-owned and controlled facilities and property for civil immigration enforcement at its meeting on May 12, 2026.
• After consideration of the proposed ordinance, the City Council voted to not proceed with the introduction of the proposed ordinance and for staff to return with a resolution reaffirming and proclaiming Union City as a compassionate city and including the words “or City properties” to locations that the City strongly urges ICE not to engage in enforcement activities.

4 Compassionate City Resolution
• In 2017, the City Council adopted Resolution 5069-017, declaring Union City a “Compassionate City.”
• The Resolution expresses the City’s commitment to a community free from prejudice, bigotry, and hate, and prohibits the City from engaging in activities solely to enforce federal immigration law.

5 Proposed Resolution
• The purpose of the proposed resolution reaffirming Union City as a Compassionate City would be to further the City’s commitment to enhancing its cultural fabric by supporting and celebrating its multi-ethnic diversity, which is critical to the City’s overall prosperity. • Consistent with Council direction, the proposed resolution includes the words “or City properties” in locations that the City strongly urges ICE not to engage in enforcement activities.

6 Recommendation
Staff and the City Attorney’s Office recommend that the City Council adopt the proposed resolution or provide other direction.
