SIXTH AMEMDMENT
TO THE CONSULTING SERVICES AGREEMENT
WITH CSG CONSULTANTS, INC.
FOR ENCROACHMENT PERMIT REVIEW AND ASSISTANCE
THIS SIXTH AMENDMENT (the “Sixth Amendment”) is effective as of this 9th day of June 2026 by and between THE CITY OF UNION CITY, a municipal corporation, (“City”) and CSG CONSULTANTS, INC. ("Consultant"), collectively referred to as the "Parties".
W I T N E S S E T H:
WHEREAS, on September 22, 2020, the Parties entered into a Consulting Services Agreement, C5464 (the “Agreement”), in the amount of $215,000 for Municipal Programming and Project Management and Consultant agreed to provide the City with services for the Engineering Division; and
WHEREAS, on June 28, 2022, the Parties entered into a First Amendment to the Consulting Services Agreement, C5464b (the “First Amendment”), to amend the services, extend the term, and increase the compensation by $99,400, for a total compensation of $314,400; and
WHEREAS, on June 30, 2023, the Parties entered into a Second Amendment to the Consulting Services Agreement, C5464c (the “Second Amendment”), to extend the term; and
WHEREAS, on August 8, 2023, the Parties entered into a Third Amendment to the Consulting Services Agreement, C5464d (the “Third Amendment”), to amend the services, extend the term, and increase the compensation by $81,120, for a total compensation of $395,520; and
WHEREAS, on June 17, 2024, the Parties entered into a Fourth Amendment to the Consulting Services Agreement, C5464e (the “Fourth Amendment”), to extend the term; and
WHEREAS, on July 1, 2025, the Parties entered into a Fifth Amendment to the Consulting Services Agreement, C26PW1137 (the “Fifth Amendment”), to extend the term; and WHEREAS, the Parties desire to amend the Agreement to further extend the term and increase the compensation; and
WHEREAS, the City and Consultant desires to enter into this Sixth Amendment.
NOW, THEREFORE, the Parties hereto do mutually agree as follows:
1. The “Term of Services”, as set forth in the first sentence of Section 1.1 of the Agreement is hereby extended to June 30, 2027.

2. The first sentence of Section 2 "COMPENSATION" of the Agreement is hereby amended to reflect payment based upon a sum increase of Thirty Thousand Dollars ($30,000). The total compensation under the Agreement, including this Amendment, shall not exceed a total amount of Four Hundred Twenty-Five Thousand Five Hundred Twenty Dollars ($425,520). The first sentence of Section 2 is hereby amended to read as follows:
City hereby agrees to pay Consultant a sum not to exceed Four Hundred Twenty-Five Thousand Five Hundred Twenty Dollars ($425,520), notwithstanding any contrary indications that may be contained in Consultant's proposal, for services to be performed and reimbursable costs incurred under this Agreement.
3. The “COST PROPOSAL” as set forth in EXHIBIT B of the Agreement, is hereby amended to include the information contained in Exhibit B of this First Amendment, attached hereto and incorporated herein by reference.
4. All other provisions of the Agreement remain in full force and effect, except as modified by this Sixth Amendment.
IN WITNESS WHEREOF, the City and the Consultant have executed this Amendment effective as of the date hereinabove written.
