RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY APPROVING A CONSULTING SERVICES AGREEMENT WITH R3
CONSULTING GROUP, INC. FOR FISCAL YEAR 2026-2027
CONSULTING SERVICES IN A NOT-TO-EXCEED AMOUNT OF
$156,000, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE
AGREEMENT IN A FORM APPROVED BY THE CITY ATTORNEY
WHEREAS, the City of Union City maintains franchise agreements and related operational agreements associated with solid waste, recycling, organics, construction and demolition debris management, and disposal services within the City; and WHEREAS, the City currently administers and oversees franchise and operational agreements associated with Republic Services, Tri-CED Community Recycling, and BLT Enterprises; and
WHEREAS, the City is required to maintain compliance with various State of California solid waste and recycling laws and regulations including, but not limited to, AB 939, AB 341, AB 1826, SB 1383, SB 54, CalRecycle reporting requirements, StopWaste program requirements, and related regulatory mandates; and WHEREAS, the City requires ongoing technical, operational, financial, and regulatory consulting support services related to franchise agreement administration, rate review, billing audit activities, compliance monitoring, reporting obligations, and solid waste program implementation; and
WHEREAS, R3 Consulting Group, Inc. (“R3”) has previously provided consulting and staff augmentation services to the City supporting solid waste, recycling, sustainability, regulatory compliance, and operational program management activities in FY 2025-2026; and
WHEREAS, R3 has assisted the City with franchise agreement oversight, billing and revenue reconciliation, annual rate review analysis, regulatory compliance support, Construction and Demolition (“C&D”) debris management program support, Green Halo compliance tracking, SB 1383 implementation activities, and public education and outreach coordination; and
WHEREAS, the proposed Fiscal Year 2026-2027 Consulting Services Agreement provides continued consulting, financial oversight, regulatory compliance, and program support services intended to assist the City in managing its solid waste and recycling programs and franchise agreements; and
WHEREAS, the proposed Consulting Services Agreement establishes a total notto-exceed compensation amount of $156,000 for Fiscal Year 2026-2027, including contingency support services as needed by the City; and WHEREAS, the City Council finds that approval of the Consulting Services Agreement with R3 Consulting Group, Inc. is in the best interest of the City and necessary to support effective administration, regulatory compliance, financial oversight, and operational management of the City’s solid waste and recycling programs; and Resolution No. 2026-XXX
R3 Consulting Group, Inc. Master Services Agreement
WHEREAS, sufficient funds are included within the FY 2026-2027 Adopted Budget in the Solid Waste Assessment Fund under Professional/Consulting, Account No. 203- 12301-54110, for these consulting and support services.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby approves the Consulting Services Agreement with R3 Consulting Group, Inc. for Fiscal Year 2026-2027 solid waste, recycling, regulatory compliance, franchise administration, billing audit, and program support services in a total amount not to exceed $156,000; and
BE IT FURTHER RESOLVED that the City Council hereby authorizes the City Manager to execute the Consulting Services Agreement, in a form approved by the City Attorney, and approve revisions consistent with the intent of this Resolution, in a form approved by the City Attorney.
