Agenda Item No. 4.4
DATE: June 23, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Joan Malloy, City Manager
SUBJECT: Adopt a Resolution Amending the City of Union City's Conflict of Interest Code Pursuant to the 2026 Biennial Review

EXECUTIVE SUMMARY
The Political Reform Act requires local agencies to review and update their conflict of interest codes to ensure they remain current and accurately designate positions that make or participate in making governmental decisions. As part of the 2026 biennial review, the City Clerk's Office reviewed the City's current Conflict of Interest Code, the current employee allocation and position control information provided by Human Resources and Finance, and input from department heads.

The proposed amendments update the Code to reflect current City classifications, remove obsolete or non-covered position references, separate combined classifications for clarity, revise disclosure categories where appropriate, and add positions that make or participate in making governmental decisions. The amendments are reflected in the attached resolution and amended Conflict of Interest Code.

Staff recommends that the City Council adopt the attached resolution approving the amended Conflict of Interest Code.

STRATEGIC PLAN ALIGNMENT
Goal B: Governance and Organization Effectiveness. Updating the Conflict of Interest Code supports transparent, accountable, and ethical governance by ensuring that the City's Form 700 filing obligations align with its current organizational structure and decision-making responsibilities.

BACKGROUND
The City of Union City has adopted the terms of Title 2 of the California Code of Regulations, section 18730, and any amendments duly adopted by the Fair Political Practices Commission, as the City's Conflict of Interest Code. The Code identifies designated positions and establishes the disclosure categories that determine which Agenda Item No. 4.4

financial interests designated filers must report on their Statements of Economic Interests (Form 700).

The Political Reform Act requires each local agency to review its Conflict of Interest Code at least every even-numbered year. The Code must accurately designate all positions that make or participate in making governmental decisions and must assign disclosure categories requiring disclosure of financial interests that may be foreseeably affected by those decisions.

The City Council adopted Resolution No. 6341-24 on August 13, 2024, approving the most recent comprehensive update to the Conflict of Interest Code. The City Council subsequently adopted Resolution No. 2025-023 on February 25, 2025, amending the Code to add the Neighborhood Preservation Inspector and Accounting Manager positions and remove the Budget Manager/Purchasing Agent position.

For the 2026 biennial review, the City Clerk's Office obtained the current employee allocation and position control information, reviewed the existing designated positions list, and met with department heads to determine whether positions should be added, removed, renamed, or assigned revised disclosure categories.

DISCUSSION
A position should be included in the Conflict of Interest Code if it makes or participates in making governmental decisions that may foreseeably have a material financial effect.

This includes positions that manage public investments; negotiate without significant substantive review; approve rates, rules, or regulations; issue, deny, suspend, or revoke permits, licenses, or similar authorizations; or prepare reports, analysis, opinions, or recommendations intended to influence a governmental decision.

Based on the 2026 review, staff recommends the following amendments:
• City Manager: Separate Management Analyst I/II into Management Analyst I and Management Analyst II, and separate Sustainability Analyst I/II into Sustainability Analyst I and Sustainability Analyst II. Existing disclosure categories are carried forward.
• Community and Recreation Services: Revise Homeless Program Coordinator/Case Manager to Homeless Program Coordinator, remove the Case Manager reference, and revise Community and Recreation Services Manager to disclosure categories 1 through 8.
• Economic and Community Development: Revise Chief Building Official / Senior Plans Examiner to Chief Building Official, rename Environmental Programs Inspector to Senior Environmental Programs Inspector, and remove Senior Building Inspector as an obsolete title reference.
• Finance: Add Business License Coordinator and Finance Specialist III, separate Management Analyst I/II into Management Analyst I and Management Analyst II, and remove Supervising Accountant as an obsolete classification. • Public Works: Add Streets Supervisor, Transit Analyst I, and Transit Analyst II.

Agenda Item No. 4.4

Streets Supervisor is included as a correction to align the written Code with existing filing administration.
• Boards, Commissions, and Committees: The Economic Development Advisory Team listing is updated to include the Alternate At-Large Member position created by Resolution No. 2026-008. The alternate position is included under the same disclosure categories as those assigned to Economic Development Advisory Team members.

The proposed amendments also include technical cleanup to ensure the Conflict of Interest Code reflects current titles, removes obsolete classifications, separates combined analyst classifications where appropriate, and aligns the written Code with current filing administration.

The proposed amendments are reflected in Exhibit A to the Resolution. A redlined version of the Conflict of Interest Code is also included as a staff report attachment for reference to illustrate the proposed changes.

FISCAL IMPACT
The proposed amendments have no fiscal impact. Reviewing and amending the Conflict of Interest Code is conducted within existing staff duties and does not require additional appropriation.

RECOMMENDATION
Staff recommends that the City Council adopt the attached resolution amending the City of Union City Conflict of Interest Code pursuant to the 2026 biennial review.
