RESOLUTION NO. 2026-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY APPROVING THE UNION LANDING PROPERTY OWNERS’
ASSOCIATION ANNUAL REPORT FOR THE PERIOD OF JULY 1, 2025, THROUGH DECEMBER 31, 2026
WHEREAS, the City Council pursuant to the provisions of the Property and Business Improvement District Law of 1994, Part 7 of Divisions 18 of the Streets and Highways code of California (hereafter referred to as the “Code”), and in accordance with the provisions of the California Constitution, Article XIID conducted proceedings for the renewal/formation Union Landing Business Improvement District (hereafter referred to as the “ULPBID”), and the levy of annual assessments connected therewith; and WHEREAS, on July 8, 2025, the City Council held a full and fair public hearing regarding the renewal/formation of the ULPBID and the establishment of annual assessments and the maximum assessments required to pay for police and marketing services and management of the ULPBID for a five-year period beginning July 1, 2025, and ending June 30, 2030; and
WHEREAS, the City Council retained NBS to prepare a Management Plan (the “Plan”) for the ULPBID renewal to determine the special benefits received from the services provided and levy amounts as part of the formation of the ULPBID for the purpose of assisting with the Annual Levy of the ULPBID; and WHEREAS, pursuant to the Code and the Plan, the Union Landing Property Owners Association (the “Owners’ Association”) shall cause to be prepared an Annual Report (hereafter referred to as the “Report”) each fiscal year for which the assessment are to be levied and collected and said Report shall be filed with the City Clerk and contain any proposed changes to the ULPBID boundary; the improvements and activities to be provided; the estimated costs and method of assessments; the amount of any surplus or deficit; and contributions from other sources; and
WHEREAS, the Report is labeled Exhibit A attached hereto and made a part hereof; and
WHEREAS, this City Council has carefully examined and reviewed the Report as presented, and is satisfied with the Report, each and all of the budget items and documents as set forth therein, and is satisfied with the special benefits received from the improvements, operations, maintenance, and services to be performed within the ULPBID, as set forth in said Report.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNION CITY AS FOLLOWS:
Section 1: The Report as required by the Code and Plan, and presented to the City Council, consists of the following:
• The improvements, services, and activities to be provided for that fiscal year; Resolution No. 2026-XXX

• An estimate of the cost of providing the improvements and the activities for that fiscal year;
• The method and basis of levying the assessment in sufficient detail to allow each real property owner to estimate the amount of the assessment to be levied against his or her property for the fiscal year;
• The amount of any surplus or deficit revenues to be carried over from the previous fiscal year;
• The amount of any contributions to be made from sources other than assessments levied pursuant to the 1994 Act.
Section 2: The Report as presented is hereby approved and order to be filed in the Office of the City Clerk as a permanent record and to remain open to public inspection.
Section 3: That the City Clerk shall certify to the passage and adoption of this Resolution and the minutes of this meeting shall so reflect the presentation of the Report; and BE IT FURTHER RESOLVED that the City Council hereby approves the Union Landing Property Owners Association Annual Report for the period of July 1, 2025, through December 31, 2026.
