RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
APPROVING THE ADJUSTED STORMWATER FEE AND ORDERING
THE COLLECTION OF THE FEE ON THE TAX ROLL
WHEREAS, Proposition 218 requires voter approval of taxes, fees, and assessments, except when the charge was in effect prior to November 6, 1996, the effective date of Proposition 218; and
WHEREAS, the City of Union City (“City”) adopted a Stormwater Fee prior to the enactment of Proposition 218 and has collected the fee since 1994 or earlier; and WHEREAS, the Stormwater fee is subject to annual adjustments based on a schedule of adjustments in place since at least 1994; and WHEREAS, the City desires to adjust the amount of the annual stormwater fee pursuant to the established schedule of adjustments and collect the Stormwater Fee on the tax roll; and
WHEREAS, the Stormwater Fee may be collected on the tax roll of Alameda County in accordance with the provisions of Section 5473.1 of the Health and Safety Code; and
WHEREAS, pursuant to Health and Safety Code Sections 5473 and 6520.10, charges, including delinquent charges, may also be collected on the tax roll of Alameda County; and
WHEREAS, the City has caused a written report to be prepared and filed with the City Clerk containing a description of each parcel of real property subject to the Stormwater Fee, together with the amount of the charge for each parcel for the fiscal year 2026-2027 computed in accordance with the schedule identified above; and WHEREAS, the City Council held a public hearing in conformance with Health and Safety Code Sections 5473.1 and 5473.2, heard and considered all objections or protests, and finds that the owners did not make protests of a majority of separate parcels of property described in the report; and
WHEREAS, California Health and Safety Code Section 5470 et seq. allows a legislative body, by a two-thirds vote, to establish the collection of fees or other charges on the tax roll.

Approving Adjustment of Stormwater Fee
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Union City as follows:
1. The recitals set forth above are found to be true and correct and are incorporated herein by reference.
2. The City Council approves the Stormwater Fees for fiscal year 2026-2027 at the rates specified in the Stormwater Fiscal Year 2026-2027 Report on file with the City Clerk.
3. The collection of the Stormwater Fee on the tax roll is hereby ordered pursuant to California Health and Safety Code Sections 5470 et seq., and the City Clerk is authorized and directed to file a copy of the stormwater fiscal year 2026-2027 report with the Auditor of Alameda County.
