DATE: July 28, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Joan Malloy, City Manager
SUBJECT: Adopt a Resolution Accepting the Completed Subdivision Improvements for Tract 8349 – Seven Hills Estates Development and Authorizing the Release of the Improvement Securities
EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution accepting the completed subdivision improvements for Tract Map No. 8349 – Seven Hills Estates Development, a six-lot single-family residential subdivision located on Florence Circle. The required subdivision improvements have been completed in accordance with the approved plans, conditions of approval, and the Subdivision Improvement Agreement and have been inspected and accepted by the City Engineer. Acceptance of the completed improvements will satisfy the developer's obligations under the Subdivision Improvement Agreement and authorize the release of the applicable improvement securities in accordance with the Subdivision Map Act.
STRATEGIC PLAN ALIGNMENT
This agenda item is aligned with the following:
Goal C, Strategy 8: Prioritize and expedite major land use applications.
BACKGROUND
The Seven Hills Estates Development project consists of a 5.9-acre site located at the terminus of Florence Street. The project extended Florence Street and constructed Florence Circle, a private cul-de-sac that provides access to six single-family residential lots. Florence Circle is a privately owned and maintained street in accordance with the approved Final Tract Map and the recorded Development Agreement.
On July 13, 2021, the City Council adopted Resolution No. 5804-21 approving Tentative Tract Map No. 8349 (TTM-19-001) for the Seven Hills Estates Development.
On June 27, 2023, the City Council adopted Resolution No. 6154-23 approving Final Tract Map No. 8349 and authorizing execution of the Subdivision Improvement Agreement. As Agenda Item No. 4.10

required by the Agreement, the developer provided Faithful Performance and Labor and Material securities, each in the amount of $814,000, to guarantee completion of the required subdivision improvements and payment for labor and materials.
DISCUSSION
The required subdivision improvements for Tract Map No. 8349 have been completed in accordance with the approved improvement plans, specifications, conditions of approval, and the executed Subdivision Improvement Agreement. The completed improvements include the construction of a new privately owned and maintained cul-de-sac with associated infrastructure, including curb, gutter, sidewalk, pavement, water, sewer, storm drain, joint trench facilities, street lighting, and a fire hydrant. City engineering staff performed construction inspections throughout the project and completed a final inspection upon completion of the improvements. Based on these inspections, the City Engineer has determined that the required improvements have been constructed in substantial conformance with the approved plans, City standards, and the requirements of the Subdivision Improvement Agreement.
Pursuant to Government Code Section 66499.7, upon determining that the required improvements have been satisfactorily completed, the legislative body may accept the completed improvements and authorize the release of the applicable improvement securities in accordance with the Subdivision Map Act.
Acceptance of the completed subdivision improvements constitutes the City's acknowledgment that the developer has fulfilled the obligations required under the Subdivision Improvement Agreement. Florence Circle will remain a private street, and the homeowners association will continue to be responsible for the ownership, operation, repair, and maintenance of the private street and all privately maintained improvements in accordance with the approved Final Tract Map and the recorded Development Agreement.
FISCAL IMPACT
Construction of the subdivision improvements was financed entirely by the developer.
Acceptance of the completed subdivision improvements does not transfer ownership or maintenance responsibility of Florence Circle or the privately maintained improvements to the City. The homeowners’ association will remain responsible for the long-term operation, repair, and maintenance of the private street and associated private improvements. Accordingly, approval of the recommended action will have no material fiscal impact on the City's operating or maintenance budget.
RECOMMENDATION
Staff recommends that the City Council adopt a resolution:
1. Accepting the completed improvements for Tract Map No. 8349 – Seven Hills Estates Development; and
2. Authorizing the release of the applicable Faithful Performance and Labor and Materials securities in accordance with the Subdivision Improvement Agreement and Government Code Section 66499.7.
