Agenda Item No. 4.6
DATE: July 28, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Joan Malloy, City Manager
SUBJECT: Adopt a Resolution Approving a Two-Year Independent Contractor Agreement with Frank Monge, in an Amount Not to Exceed $260,000, to Provide Youth Basketball Services

EXECUTIVE SUMMARY
Staff recommends that the City Council adopt a resolution approving a two-year Independent Contractor Agreement ("Agreement") with Frank Monge, in a total amount not to exceed $260,000, to provide youth basketball services.

Community & Recreation Services (“CRS”) has worked with Mr. Monge for over 10 years.

His program is one of the most successful youth programs that CRS offers, generating significant revenue that supports community initiatives. There is no direct cost to the City for this agreement with Mr. Monge. Program participants pay the City for the program, and the City subsequently pays a portion of the program registration fees to Mr. Monge.

Due to the cost of this contract, CRS is required to seek approval from the City Council to continue the basketball program.

STRATEGIC PLAN ALIGNMENT
This agenda item does not have alignment with the Strategic Plan.

BACKGROUND
CRS contracts with several independent contractors to provide a variety of recreational programs for the community. Frank Monge has partnered with the City for several years to provide year-round youth basketball instruction and training through his Beast Mode Youth Basketball program. During FY 2025-2026, the Beast Mode basketball program served more than 600 participants and generated over $130,000 in gross annual revenue.

Under the current agreement, Mr. Monge receives 70% of the gross program revenue, which helps cover his costs for coaches, uniforms, supplies, and other program-related expenses. The remaining 30%, approximately $39,000, is retained by CRS and is deposited into the City’s Revolving Enterprise Fund (“REF”). The REF funds support other youth sports programs, purchase equipment, and help offset the salary costs of the CRS Agenda Item No. 4.6

Youth Sports Recreation Coordinator. No City General Fund pays for this program – the City pays Mr. Monge from participant fees for community members who wish to participate in the Beast Mode basketball program.

For FYs 2026-2027 and 2027-2028, it is expected that Mr. Monge will continue providing year–round youth basketball classes, camps, clinics, leagues, and training programs.

Participation is anticipated to continue growing based on the program's sustained success and strong community demand. Because the total value of the proposed Independent Contractor Agreement exceeds the City Manager's authority, City Council approval is required.

Staff recommends that the City Council approve the two-year Independent Contractor Agreement and authorize the City Manager to execute the Agreement in a form approved by the City Attorney.

DISCUSSION
The Community & Recreation Services Department provides a multitude of recreational opportunities for the community. Much of the recreational programming is conducted by independent contractors, and most are compensated through an agreed-upon percentage of the registration fees collected for the programs and services provided.

Frank Monge has been providing youth basketball programs and services for the CRS department for several years. He is the most popular and highest-revenue sports contractor for CRS. For FY 2026-2027, Mr. Monge's program is estimated to generate $130,000 in registration fees. It will receive compensation of 70% of the registration fees collected (less any additional expenses that the City may incur to provide the program).

Due to his popularity and proven record as a contractor for the City, CRS is seeking to renew Mr. Monge's agreement for a 2-year period, which will result in the total contract amount increasing accordingly. Because the amount of the Independent Contractor Agreement exceeds the City Manager's authority, the City Council is being asked to approve the Agreement and authorize the City Manager to execute it.

FISCAL IMPACT
The total cost for this two-year Independent Contractor Agreement will not exceed $260,000 over the next two fiscal years (2026-2027 and 2027-2028). One hundred and thirty thousand dollars ($130,000) in funding for the first year of this two-year agreement has been included in the adopted FY 2025-2026 CRS Revolving Fund budget in Account Number 241-52008-54113 (CRS Revolving Fund - Youth Sports - Sports - Contract Employees). Funding for the second year of this Agreement will be included in the next biennial budget. The approval of this Agreement will have no impact on the General Fund.

RECOMMENDATION
Staff recommends that the City Council adopt a resolution approving a two-year Independent Contractor Agreement with Frank Monge, in a total amount not to exceed $260,000, to provide youth basketball services, and authorize the City Manager to execute the Agreement in a form approved by the City Attorney.
