RESOLUTION NO. 2026-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
APPROVING AND ADOPTING THE CITY OF UNION CITY CITY
COUNCIL HANDBOOK
WHEREAS, the City Council of the City of Union City currently has no single, formal comprehensive handbook that unifies and sets forth its procedures, governance guidelines, and applicable statutory obligations; and
WHEREAS, the City Council previously adopted Resolution No. 5703-21 on January 12, 2021, to establish certain norms and rules of conduct for its members; and WHEREAS, City staff, in conjunction with the Legislation and Policy Committee, has developed a comprehensive City Council Handbook (the “Handbook”), attached hereto as Exhibit “A”, which codifies existing laws, local municipal codes, and established practices concerning council goals, powers, duties, vacancies, ethics, compensation, meeting protocols, decorum, and administration, keeping the above practices and guidelines in mind; and
WHEREAS, the adoption of this Handbook formalizes and centralizes current practices and state mandates for enhanced transparency and efficient governance; and WHEREAS, the City Council finds that establishing a unified governance document serves the public interest, ensures legal compliance, and provides an invaluable onboarding and operational resource for current and future City Councilmembers.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Union City that:
Section 1. Recitals. The foregoing recitals are true and correct and hereby incorporated by reference.
Section 2. Adoption of Handbook. The City Council hereby approves and adopts the City of Union City City Council Handbook, attached hereto as Exhibit “A” and incorporated by reference as though fully set forth herein.
Section 3. Maintenance and Updates. The Manager and City Attorney are hereby authorized to make technical, non-substantive updates to the Handbook as necessary to maintain accurate references to changing section numbers in state statutory codes or local ordinances, provided such changes do not alter the policy intent of the document.
Section 4. CEQA. The adoption of this Resolution and Handbook is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) (the "common sense" exemption), which applies where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. This action merely formalizes existing internal administrative procedures and rules of governance, and does not authorize any physical development, construction, or operational changes that could impact the environment.
