RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
ACCEPTING THE COMPLETED SUBDIVISION IMPROVEMENTS FOR
TRACT 8349 – SEVEN HILLS ESTATE DEVELOPMENT AND
AUTHORIZING THE RELEASE OF THE IMPROVEMENT SECURITIES
WHEREAS, on June 27, 2023, the City Council adopted Resolution No. 6154-23 approving Final Tract Map No. 8349 for the Seven Hills Estates Development and authorizing execution of a Subdivision Improvement Agreement between the City of Union City and the developer; and
WHEREAS, pursuant to the Subdivision Improvement Agreement, the developer agreed to construct the required subdivision improvements in accordance with the approved improvement plans, specifications, and conditions of approval, and furnished Faithful Performance and Labor and Materials securities, each in the amount of $814,000, to guarantee completion of the required improvements and payment for labor and materials; and
WHEREAS, the City Engineer has determined that the required subdivision improvements have been completed in substantial conformance with the approved plans, City standards, and the requirements of the Subdivision Improvement Agreement; and
WHEREAS, Government Code Section 66499.7 authorizes the legislative body to accept completed subdivision improvements and authorize the release of the applicable improvement securities upon determining that the improvements have been satisfactorily completed; and
WHEREAS, Florence Circle is a private street, and acceptance of Florence Circle will remain under the ownership of the homeowners' association for the operation, repair, and maintenance of the private street and privately maintained improvements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby accepts the completed subdivision improvements for Tract 8349 – Seven Hills Estates Development and authorizes the release of the Faithful Performance Security and the Labor and Materials Security furnished pursuant to the Subdivision Improvement Agreement in accordance with Government Code Section 66499.7 and the terms of the Agreement.
