STRATEGIC PLAN ALIGNMENT
This agenda item is aligned with the following:
Goal D: Create a healthy, sustainable community and maintain and improve the City’s Infrastructure.
BACKGROUND
The Public Works inspection staff monitors the construction of various projects to ensure that they meet City engineering standards and are built to City specifications. The inspection staff of the Public Works Engineering Division is currently authorized to consist of three employees: a Supervising Construction Inspector, a Lead Construction Inspector, and a Public Works Inspector. Unfortunately, the Lead Construction Inspector position has been vacant for nearly a year due to unsuccessful recruitment. Candidates have not had the necessary skill set. There are several sizeable projects currently in the construction phase, including Capital Improvement Plan (CIP) and land development projects:
Citywide Street Rehabilitation Project
2026 PG&E June Slurry & Striping Work
Alvarado-Niles Pipeline Seismic Improvements Project
2026 PG&E Gas Underground Improvement Project Near Christine Drive Agenda Item No. 5.10

Alameda County Water District/Ranger Pipeline Water Main Improvement at Smith, Alvarado-Niles Road (Santa Maria Dr.– Decoto Rd.) The following CIP projects are either due to begin construction soon or are currently out to bid:
Dyer Street Pavement Rehabilitation Project – Phase 2 Arizona Street Bicycle Boulevard
Dry Creek Bridge Repair
Additionally, the inspection staff members oversee all the encroachment permit work done in the City. The City requires utility companies and development contractors who construct utility, traffic signal, roadway, or sidewalk improvements within the City’s public rights-of-way to get an encroachment permit to ensure that proposed improvements meet the City’s design criteria and standards. Over the past five fiscal years, the City has issued more than 2,350 encroachment permits, generating more than $3,178,998 in revenue deposited into the General Fund.
On June 1, 2023, the City entered into a Consulting Services Agreement with Park Engineering, Inc. (C5997), in the amount of $74,000, to provide assistance with public works inspections. Park Engineering, Inc. was the original name of the consulting firm.
Due to an unforeseen increase in workload, staff requested additional funds for inspection support and, on September 26, 2023, the City Council adopted Resolution No. 6205-23, approving the First Amendment to the Consulting Services Agreement with Park Engineering, Inc. (C5997b), in the amount of $100,000, for a total not-to-exceed amount of $174,000.
On December 12, 2023, the City Council adopted Resolution No. 6236-23, approving the Second Amendment to the Consulting Services Agreement with Park Engineering, Inc., in the amount of $100,000, for a total not-to-exceed amount of $274,000.
On February 25, 2025, the City Council adopted Resolution No. 2025-026, approving the Third Amendment to the Consulting Services Agreement with Park Engineering, Inc., in the amount of $100,000, for a total not-to-exceed amount of $374,000.
On May 28, 2025, the City executed the Fourth Amendment to the Consulting Services Agreement with Consor PMCM, Inc., documenting the consultant’s name change from Park Engineering, Inc., to Consor PMCM, Inc.
On December 9, 2025, the City executed a Fifth Amendment to the Consulting Services Agreement with Consor PMCM, Inc., in the amount of $150,000, for a total not-to-exceed amount of $524,000.
On January 1, 2026, the City executed a Sixth Amendment to the Agreement (C5997-6A) to document another name change, from Consor PMCM, Inc., to Consor North America.

DISCUSSION
The Public Works Department continues to see an increasing workload, which is further exacerbated by the vacancy on the inspection team. Additional support from qualified contract inspectors is essential to meet the current and future inspection demands.
Consor inspectors conduct inspections on the biweekly Fridays when City staff are off duty, ensuring project continuity and minimizing disruptions to the public rights-of-way.
Staff continues to be satisfied with the performance of Consor North America, Inc., and requests to retain its services until the Public Works inspection team is staffed to a level that can fully handle the inspection demands of the City's increasing development and growth.
With the approval of this Seventh Amendment to the Agreement with Consor North America, Inc., the City will be able to continue to provide timely inspection services to allow uninterrupted maintenance and improvement of the City’s Infrastructure.
FISCAL IMPACT
The total cost of the Seventh Amendment to the Consulting Services Agreement with Consor North America, Inc. is $300,000 and will be funded with $197,000 of Measure BB funds (Account Number 264-33004-54110) and $103,000 of Gas Tax funds (Account Number 250-33004-54110) in Fiscal Year 2026-2027.
RECOMMENDATION
Staff recommends that the City Council adopt the attached resolution authorizing the City Manager to execute the Seventh Amendment to the Consulting Services Agreement with Consor North America, Inc., in the amount of $300,000, for a total not-to-exceed amount of $824,000, for Inspection Services in a form approved by the City Attorney.
