RESOLUTION NO. 2026-XXX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY

ESTABLISHING A UNIFORM JANUARY SCHEDULE FOR THE ANNUAL

SELECTION OF CHAIRS AND VICE CHAIRS FOR THE BICYCLE AND

PEDESTRIAN ADVISORY COMMITTEE AND THE SALES TAX AND

UTILITY USERS' TAX OVERSIGHT COMMITTEE
WHEREAS, the City Council values consistent governance and administrative practices for City boards, commissions, and committees; and WHEREAS, on February 25, 2025, the City Council adopted Resolution No. 2025- 029 to standardize the start and expiration dates for new appointments to City boards, commissions, and committees so that such terms align with the calendar year; and WHEREAS, the Bicycle and Pedestrian Advisory Committee and the Sales Tax and Utility Users' Tax Oversight Committee are City advisory bodies that elect a Chair and Vice Chair but are not governed by the commission-specific officer-selection provisions of the Union City Municipal Code; and
WHEREAS, Resolution No. 2025-125 adopted revised Commission Norms and Guidelines that identify the Bicycle and Pedestrian Advisory Committee as a City advisory committee; and
WHEREAS, Resolution No. 5735-21 established the Sales Tax and Utility Users' Tax Oversight Committee, and Resolution No. 2025-069 subsequently revised its membership and terms without establishing the timing of officer selection; and WHEREAS, selecting officers at the first regular meeting in January, or the first regular meeting thereafter, aligns advisory body leadership with the City's calendar-year appointment cycle and provides a consistent annual organizational process.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNION CITY AS FOLLOWS:

Section 1. Covered Advisory Bodies.

This Resolution applies only to the Bicycle and Pedestrian Advisory Committee and the Sales Tax and Utility Users' Tax Oversight Committee.

Section 2. Annual Selection of Chair and Vice Chair.

At its first regular meeting in January of each year, or, if no regular meeting is held in January, at its first regular meeting thereafter, each covered advisory body shall elect a Chair and Vice Chair from among its regular voting members. Each officer shall assume office immediately upon election and shall serve until a successor is elected, unless removed or replaced sooner by the advisory body.

Section 3. Officer Vacancies.

If a vacancy occurs in the office of Chair or Vice Chair, the covered advisory body shall elect one of its regular voting members to fill the vacancy at the next regular meeting at which the election can be properly noticed.

Section 4. Transition to the January 2027 Cycle.

Each person serving as Chair or Vice Chair of a covered advisory body on January 1, 2027 shall continue to serve until the officer elected for that position at the body's first regular meeting in January 2027, or at its first regular meeting thereafter if no regular meeting is held in January, assumes office, unless the office becomes vacant or the officer is removed or replaced sooner by the advisory body.

Section 5. Implementation and Conforming Amendments.

The City Clerk and the staff liaison for each covered advisory body are directed to place the annual officer election on the appropriate agenda and coordinate any conforming amendments to the body's charter, bylaws, or operating procedures. This Resolution supplements Resolution Nos. 5735-21, 2025-069, and the Sales Tax and Utility Users' Tax Oversight Committee charter. To the extent of a conflict concerning the timing of annual officer selection, this Resolution controls.

Section 6. Limited Scope.

This Resolution does not modify the officer-selection method or governance structure of the Economic Development Advisory Team, Climate Action Plan Update Task Force, Disaster Council, Youth Commission, City Council committees or subcommittees, temporary task forces, or any other advisory body not expressly identified in Section 1.

Section 7. Effective Date.

This Resolution shall take effect immediately upon adoption. The first annual officer selections under Section 2 shall occur in January 2027.
