RESOLUTION NO. 2026-XXX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY APPROPRIATING $120,000 TO THE DRY CREEK BRIDGE WINGWALL REPAIR PROJECT AT ALVARADO-NILES ROAD, CITY PROJECT NO. 24-11
WHEREAS, on June 28, 2011, the City Council adopted Resolution No. 4172-11, authorizing the improvement of neighborhood streets in five Bridge Assessment Districts through the use of surplus funds remaining after construction of the bridges; and
WHEREAS, the five bridges have been constructed, and the surplus funds have remained unused for several years and are eligible for use for neighborhood street improvements for the benefit of each respective bridge benefit district; and WHEREAS, on October 9, 2023, at 1:17 AM, a driver traveling eastbound on Alvarado-Niles Road fell asleep at the wheel and crashed into the Dry Creek Bridge; and
WHEREAS, the City immediately submitted a claim for damage and plans to repair the bridge, itemize all expenses, and seek restitution before the three-year statute of limitations; and
WHEREAS, per the provisions of Resolution No. 4172-11, monies from the Bridge Benefit District Funds 413, 414, and 417 are available for this unanticipated repair; and
WHEREAS, there are three Benefit Bridge District Funds – the Dry Creek Bridge Fund (Fund 413), the South City Limits (UCB) Fund (Fund 414), and the North City Limits (Hesperian) Fund (Fund 417) – with a combined available balance of approximately $240,000; and
WHEREAS, the total cost of the Dry Creek Street Bridge repair efforts will be nearly $170,000, which does not include the significant staff time and other Cityincurred expenses; and WHEREAS, the repairs will be funded from the fund balance of Bridge Benefit District Funds 413, 414, and 417, and the $120,000 will be appropriated to the Dry Creek Bridge Wingwall Repair Project at Alvarado-Niles Road, City Project No. 24-11 (Account Number 417-92411-57128).
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby authorizes the appropriation of $120,000 for the Dry Creek Bridge Wingwall Repair Project at Alvarado-Niles Road, City Project No. 24-11; and Resolution No. 2026-XXX
Allocation of Bridge Benefit District Funds 413, 414, and 417 to the Dry Creek Bridge Wingwall Repair
