RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY AWARDING A TWO-YEAR SERVICE CONTRACT TO P31
ENTERPRISES, INC., IN THE AMOUNT OF $208,209 PER YEAR, FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $430,000, FOR TREE PRUNING
AND REMOVAL, AND AUTHORIZING THE CITY MANAGER, AT THEIR
SOLE DISCRETION, TO EXERCISE OPTIONS TO EXTEND THE
CONTRACT FOR A THIRD, FOURTH, AND FIFTH YEAR, FOR AN
ADDITIONAL AMOUNT OF UP TO $255,000 PER YEAR, FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $1,195,000
WHEREAS, the proper care and maintenance of more than 50,000 Citymaintained trees that beautify the City’s parks, public streets, and facilities involves inspection, trimming, pruning, and, on rare occasions, removal, based on criteria that balance the protection of the tree as an urban forest investment with safety and aesthetics; and
WHEREAS, additionally, the Grounds Division prepares for each winter storm season by allocating contingency funds for emergency-response tree work to clear incidents involving fallen branches or trees in the public right-of-way; the sheer volume of both the routine and emergency tree work requires additional staffing and equipment resources beyond the limits of what the Grounds Division is able to provide; and WHEREAS, on August 19, 2026, the City advertised for bid the Citywide Tree Pruning and Removal Project, City Project No. 27-00, on the City’s website, with the active builder exchanges listed in the California Uniform Construction Cost Accounting Commission’s Cost Accounting Policies and Procedures Manual 2019 Edition, and with the Bay Area News Group for two consecutive weeks, beginning on August 21, 2026; and WHEREAS, eight proposals were received and were opened on September 10, 2026, at 2:00 p.m. in City Hall; and
WHEREAS, the lowest bidder, P31 Enterprises, Inc., submitted a first-year bid of $208,209, which is approximately 31% below the Engineer’s Estimate for the project; and WHEREAS, the service contract with P31 Enterprises, Inc., in the not-to-exceed amount of $430,000, will be funded with funds from the Lighting & Landscaping Fund (Account Number 282-33025-54111) for Fiscal Years 2026-2027 and 2027-2028.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby awards a two-year service contract to P31 Enterprises, Inc., based on its firstyear bid of $208,209, for a total not-to-exceed amount of $430,000, for tree pruning and removal, and authorizing the City Manager to execute the contract in a form approved by the City Attorney; and
BE IT FURTHER RESOLVED, that the City Manager, in the City Manager’s sole discretion, is authorized to exercise options, subject to satisfactory performance and available funding, to extend the contract for a third, fourth, and fifth year, for an additional amount of up to $255,000 per year, for a total not-to-exceed amount of $1,195,000.
