RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNION CITY
APPROVING A SIDE LETTER AGREEMENT BETWEEN THE CITY OF
UNION CITY AND THE UNION CITY POLICE OFFICERS’ ASSOCIATION ESTABLISHING A TWO-YEAR 3/12:20/40 WORK SCHEDULE PILOT
PROGRAM FOR SWORN STAFF ASSIGNED TO THE COMMUNITY
ORIENTED POLICING AND PROBLEM SOLVING (COPPS) UNIT
WHEREAS, the City of Union City (“City”) and the Union City Police Officers’ Association (“UCPOA”) are parties to a Memorandum of Understanding (“MOU”); and WHEREAS, the Union City Police Department (“Department”) maintains a special assignment known as the Community Oriented Policing and Problem Solving (“COPPS”) Unit; and
WHEREAS, employees assigned to the COPPS Unit are represented by the UCPOA; and
WHEREAS, the City and UCPOA are interested in establishing a pilot program that provides for 3/12:20/40 work schedules for sworn employees assigned to the COPPS Unit; and
WHEREAS, the proposed Side Letter Agreement provides that all sworn staff assigned to the COPPS Unit will work a 3/12:20/40 Work Schedule for the duration of the pilot program, subject to the existing terms and conditions applicable to sworn staff working 3/12:20/40 schedules, including the calculation of FLSA overtime, as memorialized in the current MOU effective January 1, 2025 through December 31, 2027; and
WHEREAS, the proposed Side Letter Agreement provides that, if the Chief of Police determines that operational needs require a temporary schedule change, affected personnel assigned to a 3/12:20/40 work schedule may have their schedule altered to no less than a 4/10/40 work schedule; and
WHEREAS, the proposed Side Letter Agreement provides that the pilot program will remain in place for two years from the date of implementation and may be extended beyond the two-year term by mutual agreement of the City and UCPOA; and WHEREAS, all other terms and conditions set forth in the MOU will continue without modification.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby approves the Side Letter Agreement between the City of Union City and the Union City Police Officers’ Association establishing a two-year 3/12:20/40 Work Schedule Pilot Program for sworn staff assigned to the COPPS Unit, attached hereto as Exhibit A and incorporated herein by reference; and
BE IT FURTHER RESOLVED that the City Council hereby authorizes the City Manager to execute the Side Letter Agreement on behalf of the City, in substantially the form attached as Exhibit A, subject to approval as to form by the City Attorney; and Resolution No. 2026-XXX
COPPS Unit Work Schedule Pilot
BE IT FURTHER RESOLVED that the pilot program shall be implemented in accordance with the terms of the Side Letter Agreement and the applicable provisions of the current MOU between the City and UCPOA; and
BE IT FURTHER RESOLVED that all other terms and conditions of the MOU shall remain in full force and effect without modification.
