RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

UPLAND, CALIFORNIA APPROVING THE DESIGN FOR THE
DOWNTOWN URBAN PLAZA ON 0.69 ACRE LOCATED

BETWEEN SECOND AVENUE AND THIRD AVENUE, AND

ADJACENT TO THE PACIFIC ELECTRIC TRAIL

WHEREAS, in 2011 the City Council adopted the Historic Downtown Upland Specific Plan which encompasses 210 acres and serves to guide the future development within the Downtown area; and

WHEREAS, an Environmental Impact Report (State Clearinghouse No. 2009111055) was prepared and adopted by the City Council in conformance with Section 21000 et seq of the California Environmental Quality Act (CEQA) and Section 15000 et seq of the CEQA Guidelines for the Historic Downtown Upland Specific Plan; and

WHEREAS, implementation of the Historic Downtown Upland Specific Plan is intended to revitalize the Downtown and create a mixed-use, pedestrian-oriented environment where people live, work, shop, dine and engage in cultural and recreational activities; and

WHEREAS, Goal 5 of the Historic Downtown Upland Specific Plan is to create open space and recreational opportunities in Downtown; and

WHEREAS, Objective 5.1 provides for a system of parks, green alleys, plazas, open space, and recreational facilities that serve the needs of present and future Downtown residents, employees, and visitors; and

WHEREAS, Policy 5.1.1 provides that the City shall locate and design plazas, parks, and open spaces so they are accessible and provide a range of activities suitable for a Downtown environment; and

WHEREAS, Action 5.1.4 provides for an enhanced Pacific Electric Trail with shade trees, native landscaping, pedestrian amenities, pocket parks and connections to public alleys and adjacent neighborhoods; and

WHEREAS, the City of Upland has designed an urban plaza on a 0.69 acre vacant lot located along the Pacific Electric Trail, between Second Avenue and Third Avenue within the Trail right-of-way owned by the San Bernadino County Transportation Authority; and

WHEREAS, the City of Upland owns a revocable license agreement which permits the City to design and construct improvements along the Pacific Electric Trail within the City of Upland; and

WHEREAS, the design of the Downtown Urban Plaza and improvements comply with the goals and policies of the Historic Downtown Upland Specific Plan.

NOW, THEREFORE, the City Council of the City of Upland hereby finds, determines, and resolves as follows:

Section 1. The above recitals are true and correct and are incorporated herein by this reference.

Section 2. The City Council approves the design for the Downtown Urban Plaza, as provided in the City Council Staff Report, dated March 28, 2022.

Section 3. The project is Statutorily Exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the CEQA Guidelines (Class 3 New Construction or Conversion of Small Structures), in that the project involves the installation of small park structures and appetences, landscaping and hardscaping, and associated stormwater infiltration improvements within the existing right-of-way of the Pacific Electric Trail on a 0.69 acre vacant lot for the development an urban plaza in the Downtown area. None of the exceptions to the Class 3 exemption apply, as the project would not impact an environmental resource of hazardous or critical concern. There are no cumulative impacts, as the new Urban Plaza is a passive park and would not be developed in the same place over time.

There are no unusual circumstances surrounding the project site and the project would not damage resources within a state scenic highway, is not located on a hazardous waste site, and would not impact the significance of a historical resource as the site is currently vacant. In addition, the project is exempt pursuant to Section 15061(b)(3) of the CEQA Guidelines. This provision is the commonsense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. However, where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The Project concerns only small park structures and appetences, landscaping and hardscaping, and associated stormwater infiltration improvements within the existing right-of-way of the Pacific Electric Trail on a 0.69 acre vacant lot for the development an urban plaza in the Downtown area.

Section 4. Certification. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

Section 5. Severability. If any section, subsection, subdivision, sentence, or clause or phrase in this Resolution or any part thereof is for any reason held to be unconstitutional, invalid, or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Resolution or any part thereof. The City Council hereby declares that it would have adopted each section irrespective of the fact that any one or more subsections, subdivisions, sentences, clauses, or phrases are declared unconstitutional, invalid, or ineffective.

Section 6. The City Council directs that a Notice of Exemption be filed with the County Clerk of the County of San Bernardino within five working days of the passage and adoption of the Resolution.
