ORDINANCE NO. 1977

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
UPLAND, CALIFORNIA ADDING SECTION 8.44.120 TO
CHAPTER 8.44 OF TITLE 8 OF THE UPLAND MUNICIPAL

CODE ESTABLISHING REGULATIONS PROHIBITING THE

UNLAWFUL POSSESSION OF CATALYTIC CONVERTERS IN

THE CITY

WHEREAS, in 2021, approximately 1,600 catalytic converters were reportedly stolen in California each month, and California accounted for 37% of all catalytic converter theft claims nationwide; and

WHEREAS, the citizens of Upland have experienced rising catalytic converter thefts from automobiles over the past several years; and

WHEREAS, there is currently no City legislation yet applicable within the City of Upland to define and punish catalytic converter thefts absent an identifiable victim; and

WHEREAS, there is currently no City, State, or Federal legislation applicable within the City of Upland requiring individuals discovered to be in possession of detached catalytic converters to provide proof to law enforcement as to how they obtained catalytic converters, thus limiting law enforcement’s ability to (1) protect the public by preventing catalytic converter thefts; and (2) seize suspected stolen catalytic converters when no victim is present; and

WHEREAS, the Legislature has enacted, and the Governor has signed into law, Senate Bill (SB) 1087 and Assembly Bill (AB) 1740, which generally prohibit (1) individuals from purchasing a used catalytic converter from anyone other than certain specified sellers, including automobile dismantlers, automotive repair dealers, or an individual possessing documentation, as specified, that they are the lawful owner of the catalytic converter; and (2) requires core recyclers to keep a detailed written record, including the year, make, and model of the car from which a catalytic converter was removed, as well as a copy of the vehicle’s title, prior to purchasing a catalytic converter from a seller; and

WHEREAS, the Legislature has not expressed its intent, whether explicitly or impliedly, to occupy the field of catalytic converter theft legislation; and

WHEREAS, pursuant to Article XI, Section 7 of the California Constitution, the City has broad discretionary power to make and enforce within its limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws; and

WHEREAS, catalytic converter thefts are on the rise because individuals are incentivized to commit catalytic converter thefts for multiple reasons including, but not limited to: (1) the ease and undetectable nature of committing such thefts, potentially in a matter of seconds and through the use of common tools such as a reciprocating saw; (2) the ability to recycle catalytic converters at scrap metal yards for high dollar returns ranging from $200 to $1,200 per catalytic converter; and (3)

loopholes in legislation protecting criminals from prosecution unless a victim can be identified; and

WHEREAS, preventing these crimes at present is nearly impossible due to the ease and speed with which catalytic converter thefts can be committed and the difficulty of tracing a particular catalytic converter back to its prior owner (the victim), because catalytic converters typically have no identifying markers; and

WHEREAS, the citizens of Upland and the Upland Police Department are in need of legislation criminalizing mere possession of catalytic converters absent proof of ownership or lawful possession, for multiple reasons including, but not limited to:
(1) achieving deterrence by establishing zero-tolerance for catalytic converter thefts; (2) establishing sanctions for possessing stolen catalytic converters; (3) preventing criminals from profiting from the sale and recycling of stolen catalytic converters; (4) providing indirect justice to the victims of catalytic converter theft cases that have gone or will go unsolved for the reasons discussed above; and (5) minimizing the fiscal and personnel impact on the City of Upland and the Upland Police Department by reducing the time invested in deterring and investigating catalytic converter thefts; and

WHEREAS, individuals who are in possession of stolen catalytic converters recycle them for substantial profit while victims of these thefts suffer tremendous consequences in the form of costly repairs, inconvenience, and feelings of a lack of safety in the community; and

WHEREAS, the City desires to regulate the possession of detached catalytic converters within its jurisdiction in order to better protect its citizens, their property, and their community; and

WHEREAS, regulating possession of detached catalytic converters neither contradicts nor duplicates the statutes adopted by the Legislature on the topic of catalytic converters; and

WHEREAS, this Ordinance is necessary to provide the City of Upland and the Upland Police Department clear legal authority to better protect the public and deter this criminal activity.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UPLAND DOES ORDAIN AS FOLLOWS:

Section 1. The above recitals are true and correct and are hereby incorporated herein by this reference.

Section 2. Ordinance: Amending the Municipal Code.

Section 8.44.120 of Chapter 8.44 of Title 8 of the Upland Municipal Code is hereby added as follows:

“Section 8.44.120 Unlawful Possession of a Catalytic Converter Prohibited.

Ordinance No. 1977

A. It shall be unlawful to possess any catalytic converter that is not attached to a vehicle, unless the possessor has valid documentation or other proof to verify that they are in lawful possession of the catalytic converter.

B. It is unlawful for any person to falsify or cause to be falsified any information in any documentation or other proof intended to show valid proof of ownership or possession of a catalytic converter.

C. For purposes of this section, “lawful possession” includes (1) being the lawful owner of the catalytic converter or (2) in possession of the catalytic converter with the lawful owner’s written consent. Dear Councilman James Breitling,
I am very excited about the opportunity to serve on your City Council Advisory committee. I have been a resident of Upland for over 10 years, and it would be an honor to serve district 2.

One city issue that comes to mind is the division of our city by the north and south bound of Foothill Blvd. When I first moved to Upland, I was told by multiple realtors to always stay “above” Foothill Blvd for safety reasons. That was over 10 years ago, and I believe that this economic and racial segregation by neighborhood has only become worse over time. And as a result, this is impacting our local businesses, the city’s ability to bring in more financial revenue, and allowing the south end of Upland to become even more marginalized.

As an event coordinator for The Colonies HOA, I have spent the last couple of years trying to urge more vendors from south Upland to participate in our events attended by residents of 850+ homes. However, I found that this stigma of south Upland is so pervasive that it has driven many north Upland residents to take their business elsewhere to neighboring cities instead. This continues to cause a huge financial loss for our city.

While there is no simple solution for this issue, I do believe that social opportunities and events are one step to destigmatizing the perception of south Upland. We want to encourage north Upland residents to be more active on the south side, and vice versa, we want residents on the south side to feel welcome and also enjoy the many wonderful stores/restaurants that the north side of Upland has to offer.

However, it’s important that we are creative, intentional, and meaningful in the type of events/projects that are put together to help bridge this gap and start gaining positive momentum in our city! As a City Council Advisory committee member, I would work hard on brain storming new ideas and to help find positive solutions to expand the community relationships within our city of Upland.

Thank you,
Sarah Lee

CITY OF UPLAND – PUBLIC SERVICE APPLICATION FOR STEPHANIE WELLS

CITY COUNCIL ADVISORY COMMITTEE
January 31, 2023

What do you feel are the most important issues facing the City of Upland? The City of Upland needs to focus on the revitalization of businesses within the city, with emphasis placed on the Historic Downtown district and in areas with a high number of business vacancies and decreased growth. Incoming businesses should be welcomed and selected based on the needs of the community and the areas served. A concerted effort should be made to seek women- and minority- owned businesses, increasing the diversity of Upland’s business community and better representing the diverse population of the city and those served. Business growth and support needs to focus on all four districts of Upland with special emphasis on Districts 3 and 4, which are often overlooked. Public infrastructure (safe roads, sidewalks) and neighborhood beautification (healthy trees and greenery, weed abatement, graffiti removal) must be supported within all districts with special emphasis on areas that often appear to be neglected more than other districts. Support of local non-profit organizations providing vital needs and services to Upland’s most vulnerable populations need full support of the city.

ORDINANCE NO.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
UPLAND, CALIFORNIA, AMENDING SECTION 5.04.280 OF

THE UPLAND MUNICIPAL CODE CONCERNING

REVOCATION OF BUSINESS LICENSES FOR UNLAWFUL

POSSESSION OF CATALYTIC CONVERTERS

WHEREAS, in 2021, approximately 1,600 catalytic converters were reportedly stolen in California each month, and California accounted for 37% of all catalytic converter theft claims nationwide; and

WHEREAS, the citizens of Upland have experienced rising catalytic converter thefts from automobiles over the past several years; and

WHEREAS, the Legislature has enacted, and the Governor has signed into law, Senate Bill (SB) 1087 (“SB 1087”) and Assembly Bill (AB) 1740 (“AB 1740”), which generally prohibit (1) individuals from purchasing a used catalytic converter from anyone other than certain specified sellers, including automobile dismantlers, automotive repair dealers, or an individual possessing documentation, as specified, that they are the lawful owner of the catalytic converter; and (2) requires core recyclers to keep a detailed written record, including the year, make, and model of the car from which a catalytic converter was removed, as well as a copy of the vehicle’s title, prior to purchasing a catalytic converter from a seller; and

WHEREAS, there is currently no State, or Federal legislation applicable within the City of Upland requiring individuals discovered to be in possession of detached catalytic converters to provide proof to law enforcement as to how they obtained catalytic converters, thus limiting law enforcement’s ability to (1) protect the public by preventing catalytic converter thefts; and (2) seize suspected stolen catalytic converters when no victim is present; and

WHEREAS, on January 23, 2023, the City Council conducted first reading of Ordinance No. 1977, which would update Chapter 8.44 of the Upland Municipal Code to add Section 8.44.120, which would make it unlawful to possess a detached catalytic converter in the City without valid documentation or other proof of ownership; and

WHEREAS, on February 13, 2023, the City Council conducted second reading and adopted Ordinance No. 1977, updating Chapter 8.44 of the Upland Municipal Code to add Section 8.44.120; and

Ordinance No.

Page 2 ends

WHEREAS, in order to better protect its citizens, their property, and their community, the City desires to further regulate the possession of detached catalytic converters within its jurisdiction by providing for the revocation, pursuant to Upland Municipal Code Section 5.04.280, of City business licenses held by any person or entity that violates Section 8.44.120 of the Upland Municipal Code, SB 1087, or AB 1740; and

WHEREAS, this Ordinance is necessary to provide the City of Upland clear legal authority to better protect the public and deter this criminal activity by terminating the business licenses of any business that violates City or State restrictions on the possession and/or sale of detached catalytic converters.

Section 5.04.280 of Chapter 5.04 of Title 5 of the Upland Municipal Code is hereby amended to read in its entirety as follows:

“Section 5.04.280 Revocation of License.

A. Any license issued under the provisions of this title may be revoked by the license official upon the failure on the part of the licensee to pay the charges imposed by this title or to file reports as required by this title within 60 days after such charges or reports become delinquent.

B. Whenever the license official receives sufficient evidence, in the license official’s sole discretion, that the licensee, or any person hired, retained, controlled, or employed by the licensee, has violated section 8.44.120 of the Upland Municipal Code or any provision of State law related to the purchase and sale of detached catalytic converters (including but not limited to SB 1087 or AB 1740), the license official shall have the authority, pursuant to this section, to summarily suspend or terminate any license held by the licensee issued under the provisions of this title and order in writing to the licensee that the licensee immediately cease and desist any further activity under any such license for such period of time as set forth in this section.

C. For a first offense under subsection (B) above, the remedy shall be a suspension of any such license for a period not to exceed ninety (90) days.

D. For a second offense under subsection (B) above, the remedy shall be a suspension of any such license for a period not to exceed one hundred eighty (180) days.

Ordinance No.

Page 3 ends

E. For a third or subsequent offense under subsection (B) above, the remedy shall be permanent revocation of any such license.

F. Any person who continues to engage in any activity for which a business license is required and which such license is currently suspended or revoked pursuant to this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding $1,000.00, or by imprisonment in jail for a period not exceeding six months, or by both such fine and imprisonment. Each and every day in which any person continues to engage in such activity shall constitute a separate offense.

G. The order issued under subsection (A) of this section shall also notify the licensee that it shall have seven working days from the date of such order to request a hearing to determine whether such license shall be suspended or revoked. Failure to request, in writing, such hearing before the license official within the seven-day period shall result in the suspension or revocation of the license pursuant to the terms of this section.

H. Upon such request by the licensee whose license has been suspended or revoked under this section, for a hearing to determine whether such license shall be suspended or revoked, the license official shall provide such hearing within 15 calendar days after receipt by the license official of such request, at which hearing the licensee may appear before the license official for the purpose of presenting evidence why the license should not be suspended or revoked. No license shall be suspended or revoked under this section unless notice of the time and place of such hearing shall have first been given at least five calendar days before the hearing thereof by depositing in the United States mail a notice directed to the licensee at the address given in the application. The notice shall set forth a summary of the grounds advanced as the basis of the suspension or revocation.

I. Any licensee whose license is suspended or revoked under this section shall not engage in any activity for which such license is required until either authorized to do so by the license official or the City Council or its designee, on appeal, determines to overrule the decision of the license official.

J. The remedies provided herein are not to be construed as exclusive remedies. The City is authorized to pursue any proceedings or remedies provided by law.”

The City Council hereby declares that it would have adopted each section irrespective of the fact that any one or more subsections, subdivisions, sentences, clauses, or phrases are declared unconstitutional, invalid, or ineffective.

Section 5. Effective Date. This Ordinance shall become effective thirty (30) days from its adoption.
