City of Upland
Upland, California
We have performed procedures enumerated below to be the accompanying Appropriations Limit worksheet of the City of Upland, for the year ended June 30, 2023. These procedures, which were agreed to by the City of Upland and the League of California Cities (as presented in the publication entitled Agreed-upon Procedures Applied to the Appropriations Limitation Prescribed by Article XIIIB of the California Constitution), were performed solely to assist the City in meeting the requirements of Section 1.5 of Article XIIIB of the California Constitution. The City's management is responsible for the Appropriations Limit worksheet. This agreed-upon procedures engagement was conducted in accordance with attestation standards established by the American Institute of Certified Public Accountants. The sufficiency of the procedures is solely the responsibility of those parties specified in this report. Consequently, we make no representation regarding the sufficiency of the procedures described below either for the purpose for which this report has been requested or for any other purpose.
The procedures performed and our findings were as follows:
1. We obtained the completed worksheets and compared the limit and annual adjustment factors included in those worksheets to the limit and annual adjustment factors that were adopted by resolution of the City Council. We also compared the population and inflation options included in the aforementioned documents to those that were selected by a recorded vote of the City Council.
Finding: No exceptions were noted as a result of our procedures.
2. For the accompanying Appropriations Limit worksheet, we added last year's limit to total adjustments and agreed the resulting amount to this year's limit.
Finding: No exceptions were noted as a result of our procedures.
3. We agreed the current year information presented in the accompanying Appropriations Limit worksheet to the other documents referenced in #1 above.
Finding: No exceptions were noted as a result of our procedures.

SUBJECT: MID-YEAR BUDGET REVIEW FY 2023/24
RECOMMENDED ACTION:
It is recommended that the City Council: 1) Receive and file the Mid-Year Budget Review for Fiscal Year 2023/24 (Attachments 1-3); and 2) Approve the Mid-Year Budget Review's Proposed Adjustments (Attachment 4); and 3) Approve the updated Schedule of Positions(Attachment 5).
GOAL STATEMENT
The proposed action supports the City's goal to provide fiscal stewardship for the City of Upland.
BACKGROUND
In June 2023, the City Council adopted an operating and capital improvement budget for Fiscal Year 2023/24 that included $156,786,570 in revenue and transfers in and $212,717,440 in operating and capital expenditures and transfers out. General Fund revenue was budgeted at $55,807,750 and operating expenditures were budgeted at $55,684,290.
Amendments have been made to the original budget through City Council action and City Manager authority(cost neutral changes within the existing department and fund)and are reflected in the attachments in the Amended Budget totals.
Each year, staff presents a Mid-Year Budget report to the City Council and Upland residents. This report reviews actual revenues and expenditures once the City has reached the half-way point of the year. Staff then recommends changes to the current years'budget based on the most recent information available. The primary focus of this review is on General Fund revenues and expenditures.
ISSUES AND ANALYSIS
The first attachment to this staff report details adjustments in the Fund Balance for FY 2023/24.Using the audited FY 2022/23 figures, beginning Fund Balance in the General Fund is$9,770,117. Based on the results of the City's Mid- Year Budget Review, Fund Balance is projected to grow by $36,800 to $9,806,917. There are a number of modifications proposed to the budget in this presentation, over 8 months after the budget was originally adopted. We will highlight some of the more significant changes in this staff report.
Revenue:
Overall General Fund revenue is anticipated to increase by $5,206,050,but that figure is made up of increases and decreases. I'll detail all the adjustments that exceed $200,000 here, but the Proposed Adjustments (Attachment 4) lists the complete detail of all proposed modifications. 1) Sales tax is being projected by HdL, the City's sales tax consultant, to increase $3,737,570 over their previous estimates. The causes of the increase include growth in the building and construction sector, autos and transportation, and the growing County Pool due to the other growth. With more taxes received, the City will have some expenses increase by a similar factor for the County's administration fee(projected to increase by$25,810)as well for payments related to the City's sales tax sharing agreement(increasing by$110,000). 2)Property tax is being projected primarily by the San Bernardino County Auditor Controller/Treasurer/Tax Collector to increase by$967,940. This higher figure exists due to higher housing prices, a full 2% increase in the assessed value of properties, and changes in ownership with significant valuation increases.
3)Use of Money&Property is projected to increase by$696,570. That entire amount relates to the projected increase in interest income as a result of cash and investments in the City Pool placed in higher-yielding investments. 4) Charges for Services is projected to decrease by $343,950. Recreation User Fees are projected to decrease by $120,000,Engineering Map and Plan Check by$105,000 and Economic Development Fees are projected to decrease by$77,000. The majority of the decrease seen in Recreation User Fees is due to the lack of the Tiny Tots program in the current fiscal year. Engineering Map and Plan Check revenues are trending lower based on current years'activity, while the Economic Development Fees drop is due to rock extraction tax equivalent revenue as a part of an operating covenant coming in lower than anticipated.
Expenses:
Overall General Fund expenses are anticipated to increase by$4,302,586,but that figure is made up of increases and decreases. Keep in mind the detail of all adjustments can be found on the Proposed Adjustment sheet(Attachment 4). 1)The most significant increase proposed in Expenses for the current fiscal year is a Transfer Out of the General Fund.
Transfers Out totaling$4,060,320 are proposed to be sent to 4 different funds:
• $950,000 to the General Capital Projects Fund, which is going to two projects. The first will add$500,000 to project 82347,the PD Air Handler Replacement Project. While the$150,000 currently in the budget was to help replace 1 of 4 phases of air handlers failing at the Police Department,the$500,000 transfer from the General Fund will allow the entire project to be completed at once. Once this project is completed, many sworn and nonsworn Police Department employees will appreciate the ability to have temperature regulation in their workplace. The other project also relates to regulating temperatures in a City facility. The last two summers the Library has had to close for multiple days in a row due to a failing HVAC system. With the system so old that parts are no longer available, patchwork fixes have not lasted long. Quotes for the complete replacement of the HVAC system are $750,000. However, the Library Systems & Services agreement on the consent calendar on the March 11,2024 Council agenda includes$300,000 being provided to the City to help replace the existing HVAC. As a result, only$450,000 is being requested for the Library's complete replacement of the existing HVAC system.
• $1,076,320 to the Self-Funded Liability Insurance Internal Service Fund. The requests include$100,000 for higher than anticipated legal services, $316,430 due to a much higher insurance premium this year than expected during the budgeting process, and$300,000 and$350,000 in additional claims expense increases for Worker's Compensation and General Liability, respectively. The latter two transfers are a way to act as a bit of a buffer from unanticipated future increases. The Self-Funded Liability Insurance Fund has a negative balance due to amounts expected to be owed in the future, but not in the present. A healthy Self-Funded Liability Insurance Fund would have a positive fund balance instead of just a positive cash balance. These transfers will help the fund get closer to a positive fund balance and may be able to be tapped into if needed in a potential future downturn.
• $2,000,000 to the Fleet Maintenance &Replacement Internal Service Fund. This transfer is made entirely with an eye to the future. The three-year average General Fund contribution to the Fleet Maintenance & Replacement Fund exceeds $1,000,000. Knowing that the upcoming 2-year budget will be tighter due to a very large increase in required Unfunded Accrued Liability payment to CalPERS due to CalPERS'FY 21/22 investment and experience losses, a transfer to the Fleet Maintenance fund now could act as an advance towards future budgets, allowing the City to decrease the General Fund's contribution for fleet purposes in the upcoming 2-year budget,or if healthy,a potential future budget. • $34,000 to the Information Systems Internal Service Fund. Two divisions have requested the purchase of wide-format plotters as a part of daily operations. The Engineering Division in Public Works, and the Recreation Division in Landecena both have frequent use for plotters. The Information Systems Fund is requesting $20,000 for a plotter for each group. In addition, the Friends of Animal Shelter have requested additional cameras for security in the Animal Shelter. The$14,000 cost for camera purchases, licenses and installation is also provided for with the mid-year budget. • A fifth fund does not have any transfer being requested from the General Fund, but there is a request of the use of$130,000 in reserves of the Building Maintenance&Operations Fund to allow additional projects in that area. The larger projects requested with this funding include $35,000 to replace the front doors at the Animal Shelter, $20,000 to replace netting at Memorial North's baseball field, $18,100 for an AC replacement in the Police Department's server room,and$17,300 for unbudgeted chiller repairs already spent at the Library earlier this year. The Building Maintenance & Operations Fund has reserves exceeding $1 million, and will not be in any jeopardy from the drawdown of$130,000 in reserves.
2) The Public Works Department has projected increases of$373,760 in this budget review, with over 25% of the increases relating to the higher prices of utilities, including electricity, water and sewer. Additional proposed adjustments in the Public Works Department include:
• $100,000 in Public Works Administration's Other Services account for on-call concrete work such as sidewalk, curbs and gutters
• $59,500 in Public Works Administration's Other Supplies/Materials account for a number of smaller items, the largest of which is $33,000 for new roadway signage and $12,000 for concrete materials for sidewalk replacements
• $46,000 in Parkway Maintenance's Other Services account for Sunday trash service in City Parks($30,000) and the City's share of Shine Illumination's Downtown Christmas Lights project($16,000) 3) Overall Salaries &Benefit Expenses are anticipated to come in$171,934 lower after evaluation in the Mid-Year Budget Review. The City budgets a vacancy allowance in the Non-Departmental Fund, and current vacancies are slightly higher than anticipated when $2,013,220 was calculated at the beginning of the fiscal year. The $231,934 increase is slightly offset by a $60,000 increase in part-time salaries in the Recreation and Community Services Division to help run additional special events such as the inaugural City-run Hometown Holiday Parade&Faire and the unanticipated forthcoming return of the Irish Festival.
Personnel:
The Mid-Year Budget Review includes one unfrozen position, two part-time positions converted to full-time ones, 5 proposed reclassification of employees, one equity adjustment and two promotions. Human Resources reviewed all of the proposed reclassifications, new positions and equity adjustment for appropriateness and passed them along to Finance for consideration in the Mid-Year Budget Review.
The Police Department is requesting funding to be able to hire the 1 Police Officer position that was frozen-included in this years' Schedule of Positions, but without funding. There is also a request for a new full-time position. The benefits of the part-time Background Investigator have been valuable, and the Police Department is requesting to convert the position to full-time and eliminating the contract services funding currently being used to outsource elements of that effort. The final police request is to reclassify a Police Services Technician into a Property and Evidence Clerk. This reclassification would support the processing and release of property in a timely manner.
Without the new classification, that duty is currently a task of the Forensic Technician, which has created a backlog and hindered the timely processing of evidence and property.
Public Works is proposing two utility-funded reclassifications, one promotion and one new position to better serve the department. The department is requesting the reclassification of a Lead Utility Worker — Sewer to a Utilities Supervisor — Sewer/Storm Drain. Creating a Supervisor in the Sewer/Storm Drain area would create a more reasonable span of control—by creating a position that would handle 6 direct reports and 2 contractors,it would reduce the Utility Supervisor position's current 25 employees and 4 contractors supervised to only 17 and 2, respectively.
The other reclassification is a Lead Water Treatment Operator to a Chief Water Treatment Operator. While this is essentially a promotion, with no required position control changes, there would be additional budget necessary to effectuate this change. The promotion is the current Customer Service Specialist I moving to a Customer Service Specialist II. This classification is a Customer Services Specialist I/II, so a promotion can occur without Council approval, but the budget for the higher classification was not included in the original budget. The last proposed change is the creation of an Operations Supervisor. The new position requested is an Operations Supervisor that would supervise the Fleet and Maintenance Divisions. Currently the Fleet Division is supervised by a part-time contract Fleet Maintenance Supervisor. Having a full-time supervisor over Fleet and Maintenance would reduce the administrative burden of the Operations Manager who currently supervises 25 employees and 11 contractors with the assistance of just one Supervisor. The funding for the position would come from the elimination of the contract Fleet Maintenance Supervisor and the elimination of a part-time Maintenance Worker I.
In Administrative Services, the only change is a promotion from a Human Resources Analyst Ito a Human Resources Analyst II. The classification in question is a Human Resources Analyst I/II,so a promotion can occur without Council approval, but the budget due to the higher classification was not included in the original budget.
The final recommended change is in the City Manager's Office, where an equity adjustment is proposed for the Executive Assistant to the City Manager. The Public Information Officer-type duties of the position were reviewed
and evaluated against the City's comparable agencies. The result was a recommended revision of the salary grade from 40 to 46.
The Schedule of Positions detailing the City's proposed amended positions can be found in attachment 5, while the financial effect of all the position change requests is detailed on the Personnel Changes Fiscal Impact in attachment
6. The total General Fund impact for all requested changes in the current fiscal year is an increase of$40,015, and the All Funds effect is a$76,791 increase. The budget for these adjustments has already been factored into this Mid- Year Budget Review.
ENVIRONMENTAL DETERMINATION
The subject action revises the budget for the fiscal year. This spending plan is not considered a"project"under the California Environmental Quality Act(CEQA)pursuant to Section 15378(b)(4)of the CEQA Guidelines. Under this section, a project does not include the creation of a government funding mechanism or other government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.
FISCAL IMPACTS
Proposed Fiscal Year 2023/24 budget adjustments increase General Fund revenues by $5,206,050, increase maintenance and operations expenses by$242,266, decrease salary and benefit expenses by$171,934 and increase transfers out by$4,046,320, resulting in a net increase to reserves of$50,800 and a projected ending General Fund Fund Balance of$9,820,917. Adjustments to Other Funds include Transfers In of$4,046,320, a net increase in expenditures of$4,176,320 and a drawdown of fund balance of$130,000. See attachment 4 for all proposed budget adjustments.
