PREPARED BY:MARCELO A.BLANCO,POLICE CHIEF

SUBJECT: CONSIDER ACCEPTANCE OF HOMELAND SECURITY GRANT PROJECT 2022 FUNDS RECOMMENDED ACTION:
It is recommended that the City Council accept the Fiscal Year 2022 Homeland Security Grant funds in the amount of$21,118 and authorize the appropriation of$21,118 to purchase gas masks to outfit the patrol division.
GOAL STATEMENT
The proposed action supports the City's goal of providing safe and effective law enforcement services for Upland's residents.
BACKGROUND
The Homeland Security Grant Program(HSGP)is a state grant with funding allocated and controlled by the County of San Bernardino. The funds must be expended exclusively to provide "frontline"public safety services by police and fire.In addition, grant monies must be used to supplement existing services and not to supplant any existing funds for public safety.
ISSUES AND ANALYSIS
Patrol officers have been affected by the deployment of chemical agents in high-risk situations due to the lack of the issuance of gas masks. With crime on the rise and the realization that critical incidents are becoming commonplace, it was determined that issuing patrol gas masks is the proper allocation of these funds. It has been recommended that $21,118 from HSGP 22 be used to outfit patrol officers with gas masks. The gas masks will provide patrol officers with protection from chemical, biological, radiological, and nuclear threats.
ENVIRONMENTAL DETERMINATION
The proposed action is not subject to the California Environmental Quality Act(CEQA). Section 15378 of the CEQA Guidelines defines a project subject to CEQA. The proposed action is not included within the definition of a"project" and thus is exempt.
FISCAL IMPACTS
The Fiscal Year 2024-25 budget will be adjusted to increase revenue by$21,118 and appropriate expenditures in the same amount to the Homeland Security Grant Program Account No. 2143201-5530-32619 to purchase gas masks to outfit the patrol division.
ALTERNATIVES
Provide alternative direction to staff.

SUBJECT: FISCAL YEAR 2022 HOMELAND SECURITY GRANT PROGRAM (HSGP) CFDA 97.067 - CALL FOR PROJECTS AND ADDITIONAL INFORMATION - TIME SENSITIVE —
This correspondence contains important time sensitive information regarding the completion of the Fiscal Year 2022 Homeland Security Grant Program (FY22 HSGP) Project Proposals Due on Friday, December 17, 2021.
Although the Federal Officials have not yet announced the funding opportunity for the FY22 HSGP, Cal OES has requested that proposed projects be submitted prior to the release of the Federal Notice of Funding Opportunity (NOFO), State guidelines and award amounts. Therefore, the proposed allocations will be based on prior award information as attached. Please be aware that this is the preliminary project proposal phase for the FY22 HSGP. Notifications will be provided of any award amount adjustments, program changes, or other new grant requirements.
There have been key changes to the Homeland Security Grants. Included in these changes is a National Priority project requirement for counties, which was introduced for the FY20 HSGP as a 20% allocation requirement. Counties must use HSGP funding for projects identified under National Priority (NP) categories or risk losing partial funding. The NP project requirement for the FY21 HSGP was increased to a 30% allocation requirement with changes in the percentages for 5 National Priority categories. It is anticipated that the NP projects for FY22 HSGP will be the same as FY21 HSGP requirements which are identified as follows:
1. Enhancing information and intelligence sharing and cooperation with federal agencies, including DHS (5%)
2. Enhancing the protection of soft targets/crowded spaces (5%)
3. Enhancing Cybersecurity(7.5%)
4. Addressing emerging threats (5%)
5. Combating domestic violent extremism through enhanced intelligence collection & analysis, training, and community resilience (7.5%)

In order to meet the NP requirement, jurisdictions must use a minimum of 30% of their allocation for projects that fall under at least one NP category. Jurisdictions who do not meet the NP requirement will receive a reduced allocation. Please note that projects identified as National Priority Projects will undergo extensive review and all future modifications to these projects will need FEMA approval National Priority Projects will not be permitted to be modified to a project that falls into a different project category. The NP requirement is not a match requirement. At this time, there is no match requirement for the HSGP program.'
There will be a mandatory Teams meeting regarding the national priority project criteria on Wednesday, December 1, 2021 at 2:00 pm. Information regarding the meeting will be sent in a separate email. •Failure to attend the meeting could result in losing FY2022 HSGP funding. If you are unable to attend, we strongly recommend that you send a representative. Further information regarding National Priority projects is located in the FY2021 NOFO, pages 6-7 & 23-25 (attached).

SUBJECT: CONSIDER AWARD OF BID FOR PROJECT NO. 82350.UPLAND PUBLIC LIBRARY HVAC REPLACEMENT PROJECT(BID NO.2024-10)
RECOMMENDED ACTION:
It is recommended that the City Council approve the plans and specifications for Project No. 82350, deem the bid from Estate Design&Construction as non-responsive;and award the construction contract to Eco Green Vision,LLC, in the amount of$570,000; and approve a construction contingency in the amount of$50,000, for a total amount of $620,000.
GOAL STATEMENT
The proposed action supports the city's objective to continue to maintain and improve the City's public building facilities.
BACKGROUND
The current Upland Public Library located at 450 N.Euclid Avenue was constructed and occupied fifty-one years ago, in 1973.In early 2004,the city contracted with Pardess Air,Inc. for the purchase and installation of an all-new HVAC chiller&boiler system, and all pertinent upgrades required for building.
Upon recent research with reputable commercial HVAC vendors, it has been determined that the average life expectancy of the current size/configuration of HVAC boiler and chiller equipment is approximately 20 years.
Over the past 2-3 years the Library's current HVAC system has experienced frequent issues and challenges due to an aging system. During the summer months, there has been intermittent non-operational issues that has on various occasions required the Library to close during heat spells. In 2023, one repair cost $17,300. In summer 2024, City staff rented a cooling unit in anticipation of cooling system breakdowns and to avoid further closures of the Library due to high indoor temperatures.Commercial HVAC vendors have recommended Staff consider replacing the HVAC system.
ISSUES AND ANALYSIS
The Upland Public Library HVAC Replacement Project Notice Inviting Bids(NIB)was advertised on September 27, 2024 and October 4, 2024 in accordance with the California Public Contract Code (Section 20164) and was also advertised on Planet Bids as well as on the City's website. On October 30, 2024, the City received 10 bids for the project, under Bid No.2024-10 as follows:
BIDDER BID AMOUNT
Estate Design&Construction $378,900
Eco Green Vision,LLC. $ 570,000
MESA Energy Systems,Inc. $643,618
Western Allied Corporation $656,744
Retrofit Technology,LLC. $728,860
ACCO Engineered Systems,Inc. $751,114
Bon Air,Inc. $ 826,000
Horizons Construction Company Int'l,Inc. $ 846,278
Allison Mechanical,Inc. $ 849,000
F.M. Thomas Air Conditioning,Inc. $ 871,136
Staff reviewed each bid to confirm that each of the bidders understood the bid documents and that the bids all represented similar equipment and scope of work. Staff then reviewed the bid documents received from lowest bid contractor,Estate Design&Construction. The bid documents provided failed to adequately describe and/or identify the required experience and technical expertise needed for the scope and scale of the project. Additionally, the proposed bid amount was deemed unrealistically low given the project's requirements. As a result,it is recommended that the bid provided by Estate Design and Construction be deemed non-responsive and that Eco Green Vision,LLC be confirmed as the lowest responsible and responsive bidder.
Staff spoke with Eco Green Vision, LLC and discussed their proposed plan of action for the project, reviewed the references provided, and confirmed that Eco Green Vision,LLC of Anaheim,California,is the lowest responsible and responsive bidder. If awarded by the City Council, construction is anticipated to begin in March 2025 and be substantially completed by May 31,2025.
ENVIRONMENTAL DETERMINATION
The Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA) and the State CEQA Guidelines and determined to be categorically exempt from further environmental review pursuant to Section 15301 (Existing Facilities), of the CEQA guidelines. The project involves replacement of existing equipment within the existing facility footprint and does not involve any expansion of use beyond that which exists.
FISCAL IMPACTS
The total project cost is estimated at$620,000. There are available funds in the General Fund Capital Projects Other Services Account No.4257500-5258-82350.
ALTERNATIVES
1. Reject all bids and authorize City Clerk to re-advertise the Upland Public Library HVAC Replacement Project. Due to the successful bidding process, staff does not recommend an alternative.

SUBJECT: FISCAL YEAR 2024-25 FIRST QUARTER BUDGET REVIEW AND PROPOSED BUDGET
ADJUSTMENTS
RECOMMENDED ACTION:
It is recommended that the City Council: 1)receive and file the Fiscal Year 2024-25 First Quarter Budget Review; 2) approve the First Quarter Budget Review's Proposed Budget Adjustments; 3) approve the updated Schedule of Positions;and 4)approve the job description for the Senior IT Specialist.
GOAL STATEMENT
The proposed action supports the City's goal to provide fiscal stewardship for the City of Upland.
BACKGROUND
On June 10,2024,the City Council adopted the Biennial Budget for Fiscal Years 2024-25—2025-26.
ISSUES AND ANALYSIS
The main areas to be reviewed in the First Quarter Budget Review include:
1. Comparing prior year projections at the time the budget was approved to unaudited year-end balances;and
2. Proposing budget adjustments to current year revenues and expenditures based on current information;and
3. Approving the updated Schedule of Positions.
First,it should be noted that Fiscal Year 2023-24 figures provided in this presentation are unaudited numbers and are likely to be different in the Annual Comprehensive Financial Report once the auditors complete their audit.
Attachment 1 details adjustments in the projected beginning Unassigned Fund Balance for Fiscal Year 2024-25. The beginning Unassigned Fund Balance was projected to be$9,585,260 when the budget was adopted. Comparatively, with nearly all year-end closing journal entries completed, the unaudited figure is projected at $15,760,270. The positive difference of$6,175,010 can be attributed to an increase in revenue for the following items:
1. Development Impact Fee Reconciliation
2. Interest Income
3. Unrealized Gain on Investments
4. Sales Tax
5. Franchise Tax
6. Building Permits/Fees
As a note, the unaudited figure provided above is prior to the distribution of the year-end operating surplus to reserves in accordance with the General Fund Reserve Policy.
Fiscal Year 2024-25 Revised Revenue Projections
There are several factors as to why the City's projected revenues for FY 24/25 are higher than anticipated. The following detail provides additional information related to projections available at this time:
1. $634,600 in one-time revenue for a one-time sales tax adjustment.
2. ($324,000)revenue loss due to termination of Tesla parking lease effective 8/2024.
3. $75,000 unbudgeted revenue from the Flood Control Lease. This revenue was previously deposited into the Storm Drain Development Impact Fee(DIF)Fund but should be recorded in the General Fund.
