SUBJECT: CONSIDER APPROVAL OF AN ADDITIONAL$5,000 APPROPRIATION OF AMERICAN
RESCUE PLAN ACT FUNDS FOR RECONFIGURATION OF FINANCE WORKSTATIONS RECOMMENDED ACTION:
It is recommended that the City Council approve an additional appropriation of$5,000 in American Rescue Plan Act funds for reconfiguration of Finance workstations.
GOAL STATEMENT
The proposed action supports the City's goal to address staff recruitment, retention and appreciation.
BACKGROUND
On March 11, 2021, the President signed into law the American Rescue Plan Act ("ARPA"). The federal stimulus program allocated $1.9 trillion over the following three years to help state and local governments respond to the economic and public health impacts of COVID-19.Under the law, each local government agency nationwide receives an allocation of ARPA funds based on a formula. The City's share is$15.2 million with all funds to be obligated prior to December 31,2024.
On June 12,2023,the City Council approved the FY 23/24 Year Budget, which included a$60,000 appropriation for a reconfiguration of Finance workstations in account 2291301-5529.
ISSUES AND ANALYSIS
Office space planning includes maximizing the layout and improving the efficiency and productivity of employees within the workplace. City Hall's square footage is limited, however, how a reconfiguration of existing space management to best meet the needs of employees can positively impact overall work satisfaction and productivity.
Accounting workspace needs to be reconfigured to add additional cubicles for the Payroll Technician who is currently sitting with the Human Resources team, as well as creating a new workspace for temporary employees, interns and auditors. The Customer Service workspace needs to be reconfigured to create a cohesive layout design for the team to collaborate and address customer inquiries, while also providing fewer external distractions while on customer calls. The proposed designs will better utilize the existing workspace while planning for future office needs.
A competitive bid was not required as the City is piggybacking on the County of San Bernardino's Contract No.22- 1283 with G/M Business Interiors.
The original estimated cost of$60,000 is insufficient to complete the project, and staff is requesting an additional $5,000 to complete the project.
ENVIRONMENTAL DETERMINATION
The proposed action is not subject to the California Environmental Quality Act(CEQA). Section 15378 of the CEQA Guidelines defines a project subject to CEQA. The proposed action is not included within the definition of a"project" and thus is exempt.
FISCAL IMPACTS
The estimated cost for the Finance reorganization is$65,000. $60,000 was already budgeted in the FY 22/23 budget in Account No. 2291301-5529. If Council approves the appropriation, after moving the existing funds and an additional$5,000 appropriation, there will be$65,000 available in Account No.2291301-5529-16201.

PREPARED BY:ROBERT D.DALQUEST,DEVELOPMENT SERVICES DIRECTOR
JAMIE DAVIDSON,MANAGEMENT ANALYST II
SUBJECT: CONSIDER APPROVAL OF AMENDMENT NO. 2 TO PROFESSIONAL SERVICES
AGREEMENT WITH WILLDAN ENGINEERING
RECOMMENDED ACTION:
It is recommended that the City Council approve Amendment No. 2 to the Professional Services Agreement with Willdan Engineering for Building Division staff augmentation in the amount of$87,000 for a total not-to-exceed contract amount of$244,240 for the period through June 30, 2025, and authorize the City Manager to execute the amendment.
GOAL STATEMENT
The proposed action supports the City's goal of providing timely customer service and ensuring an expedited development review process.
BACKGROUND
Since 2014,the Development Services Department has utilized professional consulting services to provide improved customer service and flexible contract staffing in a fluctuating project workload environment. The professional services provided under the Agreement have helped to streamline the development review and the building permitting process. The decision to utilize consultant services was based on a 2014 Blue Ribbon Committee's recommendation and Upland's staffing levels being typically lower than similar sized cities. Using contract employees allows the Development Services Department to better respond to changing demands for services from the development community.
Previously, the Building and Safety Division("Division") was privileged with having one consultant who provided staff augmentation for both Building Official and Plans Examiner positions in tandem. However, this was not sustainable with the increased number of plan check submittals. Since the consultant spent a majority of the time plan checking, it prompted the decision to hire a contract Building Official to oversee the day-to-day operations of the Division and provide a transition to an in-house Building Official.
Since January 8, 2024,Willdan Engineering has provided professional services to augment staffing in the Division.
The original Agreement for$50,000 was intended to fund a contract Building Official for a specific period until the recruitment process for an in-house Building Official was completed. The Building Official recruitment was opened in July of 2024 and successfully filled in October 2024. Consultant Building Official services concluded in October 2024. Additionally, in March 2024 there were unforeseen staffing changes within the Division which prompted the immediate necessity to hire a consultant Building Permit Technician. On May 28th, the First Amendment was approved which increased the compensation by $107,240. The increase facilitated the two part-time consultants, Building Official and Permit Technician, and extended the term through November 30,2024.
ISSUES AND ANALYSIS
The consultant Permit Technician has extensive experience with our permitting software which is beneficial to both the department and the public. The Permit Technician provides services on a part-time basis and is projected through the end of this fiscal year. The goal is to return this to a full-time staff position, however, the experience the contract permit technician brings to the organization is needed during the upcoming permitting software changes.
The original agreement provides that upon mutual agreement, the term and contract amount could be increased. The consultant Building Permit Technician services are still needed to maintain the level of service for our customers and
to maintain the staffing status quo. Therefore, it is necessary to extend the term of the agreement to June 30, 2025, and increase the amount of the agreement by$87,000.
ENVIRONMENTAL DETERMINATION
The proposed action is not subject to the California Environmental Quality Act(CEQA)pursuant to Section 15378 of the CEQA Guidelines. This section defines what projects are,and are not, subject to CEQA. The proposed action to award a contract to provide Building& Safety contract services is not considered a project. The proposed action is considered an organization or administrative activity of the local government that will not result in direct or indirect physical changes in the environment.
FISCAL IMPACTS
The Second Amendment will increase the Agreement by$87,000 for a total amount of$244,240.Available funds are in the Building and Safety Professional Services Account No. 1012201-5252.
ALTERNATIVES

PREPARED BY:CHRIS ALANIS,INTERIM PUBLIC WORKS DIRECTOR
STEVEN NIX,CONTRACT PROJECT MANAGER
SUBJECT: CONSIDER AWARD OF BID FOR PROJECT NO. 16135,PD 2ND FLOOR EXPANSION PROJECT(BID NO.2024-09)
RECOMMENDED ACTION:
It is recommended that the City Council approve the plans and specifications for Project No. 16135, PD 2nd Floor Expansion Project and award a construction contract to First Trade LLC,DBA YMC in the amount of$194,100(base bid amount plus additive item#1)and approve a construction contingency in the amount of$25,000 for a total contract amount of$219,100;and authorize the City Manager to execute the agreement and any future amendments within the City Manager's authority.
GOAL STATEMENT
The proposed action supports the City's goal to continue to maintain and improve the City's public infrastructure and maintain a high standard of public health and safety.
BACKGROUND
On October 11,2021,the City Council adopted an American Rescue Plan Act(ARPA)Investment Plan that included $200,000 to fund an evidence storage building and security fencing. It was ultimately determined that the location for the storage building was not suitable for construction and therefore the project was cancelled.A new project was found within the police station that could make use of these now available funds.
On September 9,2024,the City Council reallocated the$200,000 of ARPA funding and added an additional$50,000 for a total of$250,000 and created a project to expand the second floor of the upstairs lobby area of the police station.
This expansion will create approximately 900 square feet of new workspace area on the second floor.
ISSUES AND ANALYSIS
The PD 2nd Floor Expansion Project Notice Inviting Bids(NIB)was advertised on September 27,2024 and October 4, 2024 in accordance with the California Public Contract Code (Section 20164) and was placed on the PlanetBids electronic bidding service website as well as being listed on the City's website and distributed to various electronic plan rooms. On November 12, 2024, six (6)bids were received through PlanetBids for the Project, under Bid No. 2024-09,and the results of these bids are as follows:
BIDDER BASE BID AMOUNT
First Trade LLC,DBA YMC $ 170,100.00
Estate Design and Construction $ 193,720.85
Y4M Developing Inc.,DBA Construction Masters $ 197,805.00 Venture Construction&Management $ 199,620.00
R Dependable Construction,Inc. $223,230.00
MLC Constructors,Inc. $286,658.00
The lowest bidder was First Trade LLC, DBA YMC with a base bid amount of$170,100. Staff reviewed the bid packages for all six(6)bids and confirmed that First Trade LLC,DBA YMC is the lowest responsible and responsive bidder.
The bid documents also included an additive bid item to provide corrective measures in the public men's and women's restroom located on the first floor to bring these facilities into current ADA compliance.First Trade LLC,DBA YMC provided a bid amount of$24,000 for this additive bid item and it is staffs recommendation that this item be included in the award of the contract.
ENVIRONMENTAL DETERMINATION
The Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), and the State CEQA Guidelines, and determined to be categorically exempt from further environmental review pursuant to Section 15301(c) (Existing Facilities), of the CEQA guidelines. The project involves repair and maintenance of existing public facilities and does not involve any expansion of use beyond that which is existing. The City filed the Notice of Exemption with the County of San Bernardino on November 18,2024.
FISCAL IMPACTS
The total project cost is estimated at$239,100 as detailed below. There are available funds in the ARPA PD Building Expansion Account No.2293201-5529-16135.
Estimated Project Costs
Basic Bid Amount $ 170,100.00
Additive Bid Item#1 $24,000.00
Construction Contingency $25,000.00
Total Contract Work: $219,100.00
Construction Administration and Inspection $20,000.00 Total Estimated Project Cost: $239,100.00
ALTERNATIVES
1. Reject all bids and authorize the City Clerk to re-advertise the Project. Due to a successful bidding process, staff does not recommend this alternative.
2. Provide alternative direction to staff.
CEQA: Categorically Exempt from further environmental review pursuant to Section 15301(c) (Existing Facilities).

SUBJECT: DISCUSSION REGARDING CITY COMMITTEES APPOINTED TO ADVISE THE COUNCIL RECOMMENDED ACTION:
It is recommended that the City Council discuss options for the elimination of committees appointed to advise the City Council and direct staff to bring back a Resolution reflecting any recommended changes for consideration at a subsequent Council meeting.
GOAL STATEMENT
The proposed action supports the City's goal to provide opportunities for the citizenry to participate in local government through service on various Commissions, Committees,Boards, and Authorities; and to conduct regular meetings in an efficient and transparent manner.
BACKGROUND
At the regular City Council meeting on November 11, 2024, Mayor Velto requested that this item be brought to Council for discussion.
ISSUES AND ANALYSIS
The City has a total of 9 boards, commissions, and committees. Several of these are required by Government Code or Upland Municipal Code(UMC). These include:
• Building Board of Appeals
• Library Board
• Personnel Board of Review
• Planning Commission(Airport Land Use Committee)
• Public Works Committee (includes Citizen Members that perform duties of the Street Tree Advisory as required in the UMC)
The Building Board of Appeals and the Personnel Board of Review meet on an as needed basis only.
There are three legislative committees and two citizen advisory committees that meet on a quarterly basis. These committees include:
Legislative Committees
• Economic Development Committee
• Finance Committee
• Public Works Committee (includes Citizen Members that perform duties of the Street Tree Advisory as required in the UMC)
Advisory Committees
• City Council Advisory Committee(also serves as the CDBG Committee) • Parks,Arts,Recreation, and Community Services(PARCS)Advisory Committee In addition to considering the elimination of committees, staff recommends the Council consider changing the quarterly schedule of the Economic Development Committee meetings. Currently the meetings are held the first Monday of March,June, September, and December. This results in the September meeting falling on the Labor Day Holiday, which requires cancellation of the meeting and scheduling a special meeting. Staff is requesting that the
meetings remain the first Monday of the month, but adjusting the quarterly schedule to February,May,August, and November.
There is no fiscal impact associated with this action.
ALTERNATIVES
Provide alternative direction to staff.
CEQA:Not a Project.

SUBJECT: REVIEW AND PROVIDE DIRECTION ON DRAFT PROGRAM GUIDELINES FOR THE
SMALL BUSINESS EXPANSION GRANT
RECOMMENDED ACTION:
It is recommended that the City Council review the draft program guidelines for the proposed Small Business Expansion Grant Program;consider the proposed funding;and provide direction to staff.
GOAL STATEMENT
The proposed action supports the City's goal to create economic development assistance programs to help small businesses with recovery and resiliency in the wake of the Covid-19 Pandemic as mandated by the American Rescue and Recovery Plan Act.
BACKGROUND
On October 14th,the City Council directed staff to look at opportunities to help struggling small business owners and bring back a draft program for the City Council's review. The Council will recall that staff developed and implemented three recent programs which assisted small businesses and funded using American Rescue Plan Act(ARPA) funds.
These programs included:
• Catch-Up Business Rental Assistance Program. Approved in July 2022,the grant program assisted citywide small businesses that were in arrears in rent and covered up to two months or$6,000,whichever was less. A total of 17 businesses were assisted and a total of$105,207 was expended. • Raise-Up(Rental Assistance for increased Sales and Efficiency—Upland)Program. Approved in February 2023,the grant program was aimed at assisting citywide independent restaurants with a not to exceed grant up to$6,700 for tenant improvements, business equipment, electronics, signage,or digital marketing. A total of 28 restaurants were assisted and a total of$181,000 was expended. • Micro-Retail Resiliency Program. Approved in October 2023, the grant program assisted downtown businesses with up to $5,000 for new business signage, rent in arrears, adaptive marketing strategies, and security shutters and cameras. The City assisted 7 downtown businesses and expended$35,000.
Based on the above programs, staff recommends developing a program that would substantially help small businesses with 10 or less employees and annual gross sales of$500,000 or less. The program would provide up to$15,000 to qualified small business owners and assist them in their expansion plans or assist them in helping grow their business through the following costs:
1. Increasing building square footage;
2. Expanding indoor/outdoor seating capacity;
3. Enhance business service capacity,or
4. Improving marketing,promotions,and signage.
Additional funding requests that align with the grant's objectives, which are found in Page 2 of the grant guidelines, may also be considered subject to the approval of the Development Services Director.
ISSUES AND ANALYSIS
Prior to developing the draft program, staff had met previously with two small business owners who either had plans to expand their business or were seeking help to grow their business. The need to expand or grow a business became the concept for the grant and one that staff thought would have more substantial outcomes. To achieve this, the maximum amount of the grant had to be more considerable than the previous grant programs mentioned in the above section of the report.
Thus, the draft program guidelines are intended to substantially assist several small businesses that either have plans to physically expand their business but couldn't because of the lack of funding or need financial help and assistance to grow some aspects of their business. The proposed grant program would utilize up to$225,000 of ARPA funds to provide a maximum of$15,000 per eligible business on the listed items above or on Page 2 of the draft guidelines.
This amount would assist up to 15 small businesses, or several more depending on whether some of the individual grantees do not use the entire$15,000. Staff recommends that$15,000 is enough to achieve the goal of the grant for a limited number of eligible small business owners to expand or grow their business.
Lastly, the draft guidelines require approved applicants to participate in two business training courses offered through the Small Business Development Center (SBDC), including a one-on-one professional consulting meeting with a representative of the SBDC to review or modify their business plan to qualify for the funding.
Staff is seeking the City Council's review and comments/revisions on the draft program guidelines and direction if the Council wishes staff to come back at the December 9th City Council meeting for a formal approval of the grant program guidelines,as well as to allocate funding for the program using ARPA funds.
ENVIRONMENTAL DETERMINATION
The proposed Small Business Expansion Grant Program has been determined to be exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the CEQA Guidelines. This exemption applies only to projects which do not have the potential for causing a significant effect on the environment.Where it can be seen with certainty that there is no possibility that the activity may have a substantial effect on the environment, the activity is not subject to CEQA. The program grant only applies to a limited number of small businesses for increasing building square footage, expanding indoor/outdoor seating capacity, enhancing business service capacity, or improving marketing, promotion and signage.
FISCAL IMPACTS
The grant program proposes to utilize American Rescue and Recovery Plan Act Funds in the amount of$225,000.
There will be no fiscal impact on the General Fund.
ALTERNATIVES
Provide alternative direction to staff.
CEQA: Determined to be Exempt pursuant to Section 15061(b)(3)of the CEQA Guidelines.
