DATE: January 13,2025
TO: MAYOR AND CITY COUNCIL
FROM: MICHAEL BLAY,CITY MANAGER
PREPARED BY:CHRIS ALANIS,INTERIM PUBLIC WORKS DIRECTOR

BOB CRITCHFIELD,ENGINEERING MANAGER
SUBJECT: CONSIDER APPROVAL OF A PROFESSIONAL SERVICES AGREEMENT FOR THE DESIGN OF STREET AND UTILITY IMPROVEMENTS ON 14TH STREET AND GROVE AVENUE
RECOMMENDED ACTION:

It is recommended that the City Council approve a professional services agreement with HR Green for the preparation of street, water, and sewer improvement construction documents for 14th Street, between Campus Avenue and Grove Avenue, and for Grove Avenue, between Foothill Blvd. and 15th Street in the amount of $421,378; approve a contingency in the amount of$43,622,for a total amount of$465,000;and,authorize the City Manager to execute the agreement and any future amendments within the City Manager's authority.

GOAL STATEMENT
The proposed action supports the City's goal of maintaining and improving the City's public roadway, water, and sewer facilities.

BACKGROUND
Grove Avenue, from Foothill Blvd. to 15th Street, and 14th Street from Campus Avenue to Grove Avenue are two roadway segments identified in the City's Fiscal Year 2024-25 Capital Improvement Program in need of rehabilitation.

Several factors have contributed to the deterioration of the roadway including age, inadequate drainage due to displaced concrete improvements, and traffic loading.

The City has since completed a preliminary drainage analysis and conceptual engineering review of the street and consequently, prepared the Request for Proposal(RFP)for engineering design services.

ISSUES AND ANALYSIS
On May 30, 2024, the City issued the RFP to three (3) engineering firms and posted it on the City's website, and subsequently received proposals from five (5) firms. A panel composed of Public Works staff from the Capital Projects and Utilities Division, as well as one member from the Development Services Division evaluated the proposals, and based on their responsiveness, ranked them as follows:

1. HR Green

2. TKE Engineering

3. Valued Engineering

4. Kabbara Engineering

5. Onward Engineering
All five(5)firms are well equipped and qualified to handle the proposed work. The panel concluded that HR Green showed the most comprehensive and thorough understanding of the work to be completed. The proposals are available in the City Clerk's office for review.

The design fee submitted by HR Green was originally$520,716,which was higher than the engineer's estimate for the proposed work. Engineering staff and HR Green went through a few iterations regarding the contemplated design improvements and associated cost and were able to agree on reducing the cost by$99,338 for an agreed upon fee of $421,378 for the preparation of the design plans and specifications.

INTRODUCTION
Professional consultants are selected for City engineering projects based on demonstrated competence and professional qualifications necessary for the satisfactory performance of the services to be performed at fair and reasonable prices to the public agency. The City of Upland is requesting proposals from qualified civil engineering firms, licensed in the State of California, for the purpose of entering into a professional consultant services agreement to perform engineering design services in connection with pavement rehabilitation and utility improvements along Grove Avenue, from Foothill Boulevard to north of 15th Street (project No. 7345 & 9152) and 14th Street from Campus Avenue to Grove Avenue (Project No. 70005 & 91001). The City intends to award a Professional Services Agreement (Agreement), to a firm deemed to be most qualified to provide services as required by the City. The Agreement to be executed shall be in the form attached hereto as Attachment A.

The California Labor Code section 1770, et seq., requires that certain consultants and/or subconsultants on public works projects pay their workers based on the prevailing wage rates which are established and issued by the Department of Industrial Relations, ( http://www.dir.ca.gov) . Proposers of this RFP agree to adhere to the prevailing wage requirements and use the wage schedules applicable at the time the work is performed, which can be obtained from the Department of Industrial Relations Internet site at:

Any consultant or subconsultant who submits a proposal or performs work that requires the payment of prevailing wages under the state law must be registered with the Department of Industrial Relations. This includes not only work performed by the building and construction trades, but also other types of work, including trucking, surveying, and material testing, if that work is subject to prevailing wage requirements.

PROJECT LOCATION AND BACKGROUND
Grove Avenue is a north/south directional roadway that carries approximately 2,300 vehicles per day and is classified as a Major Collector highway from Foothill Boulevard to 14th Street and a Local Street from 14th Street to 15th Street under the California Road System (CRS) Maps. 14th Street is an east/west directional roadway that carries approximately 2,800 vehicles per day and is classified as a Major Collector highway from Campus Avenue to Grove Avenue under the California Road System (CRS) Maps. The location of the proposed project is shown on the attached project location map (Attachment B). Firms submitting proposals are encouraged to visit the project area to review site conditions first hand.

The following table specifies the approximate roadway segment lengths on Grove Avenue and 14th Street with corresponding contemplated water and sewer infrastructure information:

(ii) If at any time during the life of the Agreement, any policy of insurance required under this Agreement does not comply with these specifications or is canceled and not replaced, City has the right but not the duty to obtain the insurance it deems necessary and any premium paid by City will be promptly reimbursed by Consultant or City will withhold amounts sufficient to pay premium from Consultant payments. In the alternative, City may cancel this Agreement.
(iii) The City may require the Consultant to provide complete copies of all insurance policies in effect for the duration of the Project. (iv) Neither the City nor any of its officials, officers, employees, agents or volunteers shall be personally responsible for any liability arising under or by virtue of this Agreement.
j. Subconsultant Insurance Requirements. Consultant shall not allow any subcontractors or subconsultants to commence work on any subcontract until they have provided evidence satisfactory to the City that they have secured all insurance required under this section.

Policies of commercial general liability insurance provided by such subcontractors or subconsultants shall be endorsed to name the City as an additional insured using ISO form CG 20 38 04 13 or an endorsement providing the exact same coverage. If requested by Consultant, City may approve different scopes or minimum limits of insurance for particular subcontractors or subconsultants.

12. Indemnification.
a. To the fullest extent permitted by law, Consultant shall defend (with counsel of City's choosing), indemnify and hold the City, its officials, officers, employees, volunteers, and agents free and harmless from any and all claims, demands, causes of action, costs, expenses, liability, loss, damage or injury of any kind, in law or equity, to property or persons, including wrongful death, in any manner arising out of, pertaining to, or incident to any acts, errors or 7

omissions, or willful misconduct of Consultant, its officials, officers, employees, subcontractors, consultants or agents in connection with the performance of the Consultant's services, the Project or this Agreement, including without limitation the payment of all damages, expert witness fees and attorney's fees and other related costs and expenses. Consultant's obligation to indemnify shall not be restricted to insurance proceeds, if any, received by Consultant, the City, its officials, officers, employees, agents, or volunteers.
b. If Consultant's obligation to defend, indemnify, and/or hold harmless arises out of Consultant's performance of "design professional" services (as that term is defined under Civil Code section 2782.8), then, and only to the extent required by Civil Code section 2782.8, which is fully incorporated herein, Consultant's indemnification obligation shall be limited to claims that arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the Consultant, and, upon Consultant obtaining a final adjudication by a court of competent jurisdiction, Consultant's liability for such claim, including the cost to defend, shall not exceed the Consultant's proportionate percentage of fault.

13. California Labor Code Requirements.
a. Consultant is aware of the requirements of California Labor Code Sections 1720 et seq. and 1770 et seq., which require the payment of prevailing wage rates and the performance of other requirements on certain "public works" and "maintenance" projects ("Prevailing Wage Laws"). If the services are being performed as part of an applicable "public works" or "maintenance" project, as defined by the Prevailing Wage Laws, and if the total compensation is $1,000 or more, Consultant agrees to fully comply with such Prevailing Wage Laws. Consultant shall defend, indemnify and hold the City, its officials, officers, employees and agents free and harmless from any claims, liabilities, costs, penalties or interest arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. It shall be mandatory upon the Consultant and all subconsultants to comply with all California Labor Code provisions, which include but are not limited to prevailing wages (Labor Code Sections 1771, 1774 and 1775), employment of apprentices (Labor Code Section 1777.5), certified payroll records (Labor Code Sections 1771.4 and 1776), hours of labor(Labor Code Sections 1813 and 1815) and debarment of contractors and subcontractors (Labor Code Section 1777.1). The requirement to submit certified payroll records directly to the Labor Commissioner under Labor Code section 1771.4 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Section 1771.4. b. If the services are being performed as part of an applicable "public works" or "maintenance" project, then pursuant to Labor Code Sections 1725.5 and 1771.1, the Consultant and all subconsultants performing such services must be registered with the Department of Industrial Relations. Consultant shall maintain registration for the duration of the Project and require the same of any subconsultants, as applicable. Notwithstanding the foregoing, the contractor registration requirements mandated by Labor Code Sections 1725.5 and 1771.1 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Sections 1725.5 and 1771.1. c. This Agreement may also be subject to compliance monitoring and enforcement by the Department of Industrial Relations. It shall be Consultant's sole responsibility to comply with all applicable registration and labor compliance requirements. Any stop orders issued by the Department of Industrial Relations against Consultant or any subcontractor that affect Consultant's performance of services, including any delay, shall be Consultant's sole responsibility. Any delay arising out of or resulting from such stop orders shall be considered Consultant caused delay and shall not be compensable by the City. Consultant shall defend, indemnify and hold the City, its officials, officers, employees and agents free and harmless from 8

In such event, City shall be immediately given title and possession to all original field notes, drawings and specifications, written reports and other documents produced or developed for that portion of the work completed and/or being abandoned. City shall pay Consultant the reasonable value of services rendered for any portion of the work completed prior to termination. If said termination occurs prior to completion of any task for the Project for which a payment request has not been received, the charge for services performed during such task shall be the reasonable value of such services, based on an amount mutually agreed to by City and Consultant of the portion of such task completed but not paid prior to said termination. City shall not be liable for any costs other than the charges or portions thereof which are specified herein. Consultant shall not be entitled to payment for unperformed services, and shall not be entitled to damages or compensation for termination of work.

The basis for award of contract shall be the Contractor's Base Bid only.

TOTAL BASE BID PRICE BASED ON BID SCHEDULE
Total Base Bid in Figures
The costs for any Work shown or required in the Contract Documents, but not specifically identified as a line item are to be included in the related line items and no additional compensation shall be due to Contractor for the performance of the Work.

All blank spaces appearing above must be filled in. Failure to fill in any blank spaces may render the bid non-responsive. In case of discrepancy between the Unit Price and Item Cost set forth for a unit basis item, the Unit Price shall prevail and be utilized as the basis for determining the lowest responsive, responsible Bidder. However, if the amount set forth as a Unit Price is ambiguous, unintelligible or uncertain for any cause, or is omitted, or is the same amount as the entry in the Item Cost column, then the amount set forth in the Item Cost column for the item shall prevail and shall be divided by the estimated quantity for the item and the price thus obtained shall be the Unit Price.

For purposes of evaluating Bids, the City will correct any apparent errors in the extension of unit prices and any apparent errors in the addition of lump sum and extended prices.

The estimated quantities for Unit Price items are for purposes of comparing Bids only and the City makes no representation that the actual quantities of work performed will not vary from the estimates. Final payment shall be determined by the Engineer from measured quantities of work performed based upon the Unit Price.

The undersigned agrees that this Bid Schedule constitutes a firm offer to the City which cannot be withdrawn for the number of calendar days indicated in the Notice Inviting Bids from and after the Bid opening, or until a Contract for the Work is fully executed by the City and a third party, whichever is earlier.

If the Contract Documents specify Alternate Bid items, the City can choose to include any, all, or none of the Alternate Bid items in the Work. If the City selects any of the Alternate Bid items, the corresponding Alternate Bid prices shall be added to or deducted from Base Bid Price for the Work. The City can award/select Alternate Bid items at any time(s).

NOTES:

1. Determination of the lowest bidder will be based upon the "TOTAL BASE BID" price indicated in the Bid Schedule above.

2. All amounts and totals given in the Bid Schedule will be subject to verification by the Contractor. In case of variation between the unit cost and amount shown by bidder, the unit cost will be considered to be his/her bid.

3. The price bid shall include all State, Federal, and other taxes applicable to the project, and shall be a firm offer for a period of 90 calendar days after the date of bid opening.

4. Acknowledge receipt of all Addenda. The cover sheet of each addendum issued is signed by the Contractor and attached herewith.

5. Unbalanced bids will be considered sufficient grounds for rejection of the entire bid. An unbalanced bid is defined as a bid containing lump sum or unit bid items which do not reasonably reflect actual costs, plus reasonable share of the anticipated profits, overhead costs, and other indirect costs attributable to the performance of the work in question.

6. The quantities listed in the above Bid Form are estimates shown for bid comparison only.

Payment will be made at the Contract Unit Price for the actual quantities constructed, based upon field measurements or certified weight tickets where appropriate. The City does not, expressly or by implication, agree that the actual amount of work will correspond therewith, and reserves the right to increase or decrease the amount of any class or portion of the work, or to omit portions of the work, as may be deemed necessary or advisable by the Engineer.

In case of variation between the unit cost and amount shown by bidder, the unit cost will be considered to be his/her bid.

7. The City reserves the right to delete one or more bid items, and/or to increase or decrease the quantities of any bid item.

8. *Indicates bid item that may or may not be used.

The undersigned, under penalty of perjury, acknowledges that they are authorized by the bidding Contractor to submit a bid for said Contractor

The project addressed road conditions across 460 lane miles, using various rehabilitation and preservation strategies to mitigate accident risks including crack sealing, slurry sealing, localized repair through digging out and replacement, edge grinding and overlay, full grinding and overlay, and recyclable pavement fabric for soft subgrade areas. The project covered 1,006 street segments, identified through the Pavement Management System (PMS), which prioritizes segments based on the Pavement Condition Index (PCI), traffic volume data, pothole repair records, proximity to schools, and resident requests.

These elements contribute to a 10-year plan updated annually.

Innovative technology, such as video image detector cameras, was installed for traffic synchronization and bicycle detection, avoiding traffic disruption and pavement disturbance. This technology eliminated the need to cut the pavement to install inductive loops in future pavement rehabilitation. Safety enhancements included upgrading 378 curb ramps to Americans with Disabilities Act (ADA) standards, adding 10 crosswalk flashing beacons, and installing over 100 miles of bike lanes citywide per the City's Adopted Bicycle Master Plan.

Innovative strategies like project bundling and single contract awards were used to cut gsaEEE.=- ;E=-,.. IcsAtI ( , costs, streamline processes, and meet the 18-month project delivery goal. The project was a collaborative effort, with designprovided byHR Green. Multiple contractors were RoadsProject Outstanding Local dSts ets and

hired due to the demanding schedule, including All American Asphalt, Hardy & Harper, 2024 Winner and RJ Noble.

Environmentally friendly materials and methods were used to promote sustainability, reduce overhead costs, and reduce the carbon footprint. For instance, Asphalt Rubberized Hot Mix (ARHM), which incorporates crumb rubber from recycled tires, was used in all overlay applications. This project diverted approximately 500,000 scrap tires from landfills to construct 194,000 tons of ARHM. The project used 20% Reclaimed Asphalt Pavement (RAP) Micro-surfacing on several industrial area streets with high traffic loading. A total of ® League of California Cities 17,139,000 square feet of slurry seal was used to extend pavement life without having to (Cal Cities) grind and dispose of existing pavement. county Engineers Association of California
The project resulted in refreshed striping, improved road quality, enhanced bicycle lanes, (CEAC) California State Association
and improved accessibility, resulting in better access to schools, businesses, and bus of Counties®(CSAC) stops. The citywide PCI is expected to increase from 72 to 76. Outstanding Local Streets and Roads Award-2024
This project was recognized by the League of California Cities (Cal Cities), County Engineers Association of California (CEAC), and California State Association of Counties® (CSAC) with the 2024 Outstanding Local Streets and Roads Project Award. This category includes, but is not limited to, projects that use resources efficiently, projects that employ emerging technologies and materials, progressive preservation programs that improve pavement conditions, projects that are cost-effective and/or creative in the planning, design, funding and/or implementation compared to traditional methods, that are sustainable from a financial and resource perspective, and/or reduce greenhouse gas emissions and are environmentally friendly. https://savecaliforniastreets.org/citywide-pavement-rehabilitation-program-phases- 1-and-2/

LICENSE Program Manager and Quality Control for the award-winning preparation of street Professional Engineer, CA improvement and signing and striping plans for 80+ miles of arterial/collector streets. #64701 The project included the grind and overlay or slurry seal of streets throughout the City.

In addition to the rehabilitation or maintenance of existing pavement, the project also Qualified SWPPP included new signing and striping of all streets, including the addition of new Class Developer/Practitioner II and Class III bikeways as well as several bicycle boulevards. HR Green had to take (QSD/QSP), CA#00503 into the account the City's adopted bicycle and pedestrian master plan and existing PROFESSIONAL on-street parking to design the most effective and efficient corridors. At the City's MEMBERSHIPS request to expedite the project, HR Green was able to complete the design of all forty miles within six (6) months.

American Public Works
Association (APWA) >Van Buren Boulevard Pavement Rehabilitation, City of Jurupa Valley. Project Manager for the design and construction management/inspection services for 1.2 miles of pavement rehabilitation along Van Buren Boulevard, a major regional expressway. The design evaluated traditional grind and overlay using geosynthetic paving mats versus fiber-reinforced asphalt concrete (FRAC), with both options including an ARHM wearing surface. To minimize traffic disruptions on this critical corridor, the FRAC alternative was selected for its equivalent strength, potential cost savings, and ability to be placed through intersections without switching mixes.

3. Project Schedule
Our Project Manager, Steve Loriso, PE, QSD/QSP, will be accessible and responsive to you at all junctures. This approach requires careful listening to your input. We invite active participation from you as part of our team. Your voice is crucial to the success of this management approach. HR Green will monitor schedule and budget, workload, and critical project element completion items to maintain schedule for each individual. A task-by-task detailed schedule has been developed as detailed below. In addition, HR Green will apply cost and schedule trending for the project to include any potential changes based on discussions or meetings. This open line of communication will allow the project to progress minimizing rework or surprises. HR Green establishes a communication plan at the beginning of every project in order to establish protocols to keep information flowing. In addition to establishing communication with the City, we will establish clear lines of communication with our subconsultant team, any and all review agencies, and any appropriate stakeholders.

We understand that an efficient and informed process benefits everyone involved from a time, cost, and consistency basis. Even though you should feel free to call your Project Manager anytime, we will hold meetings throughout the process to keep you informed of progress. HR Green is well known for our ability to maintain project schedules. Our managers use Microsoft Project in conjunction with Deltek Vantagepoint to manage our talent and resources. Overbooking staff only creates stress and actually decreases quality; therefore, we not only look at the project at hand, but we analyze the office workload across a nine-month period to ensure that all our projects meet the agreed upon deadlines as well as our high standards. Our team assigned to provide these services creates the core design group and utilizes Company-wide resources to make certain that project schedules are being met and the necessary staff is assigned to meet schedules. HR Green staff has effectively utilized these best-practice tools and processes to deliver projects within budget and schedule for all our client agencies in California and throughout the U.S.

CtIFOBS
DATE: January 13,2025
TO: MAYOR AND CITY COUNCIL
FROM: MICHAEL BLAY,CITY MANAGER
PREPARED BY:CHRIS ALANIS,INTERIM PUBLIC WORKS DIRECTOR

STEVEN NIX,CONTRACT PROJECT MANAGER
SUBJECT: CONSIDER APPROVAL OF CHANGE ORDER NO. 3 FOR PROJECT NO. 82347,PD AIR

HANDLER REPLACEMENT PROJECT
RECOMMENDED ACTION:

It is recommended that the City Council approve Change Order No. 3 for Project No. 82347, PD Air Handler Replacement Project with F.M. Thomas Air Conditioning, Inc., in the amount of$98,626; and authorize the City Manager or his designee to execute the change order.

GOAL STATEMENT
The proposed action supports the city's objective to continue to maintain and improve the City's public building facilities.

BACKGROUND
The current City of Upland Police Station, located at 1499 W. 13th Street, was constructed and occupied thirty-five years ago, in 1989. Since its construction, there has been very limited updating of any of the mechanical equipment.

In August 2017, the city contracted with Alliance Building Solutions to provide solar installation and other energy efficiency upgrades at the city's main building facilities. Under this contract the Police Station received solar panel installation,a high efficiency air-cooled chiller,an Energy Management System to control the HVAC,and an upgrade of all lighting to LED.

In late 2020, the existing hot water boiler and associated water piping between the chiller and boiler to the Police Station were replaced, leaving only the twenty-nine(29)air handler units as original equipment. In May 2023,one of these air handlers began leaking and required replacement.During this replacement,it was suggested by the contractor that the remaining would likely be in a similar condition and replacement should be highly considered.

ISSUES AND ANALYSIS
On May 13, 2024, the City Council awarded a construction contract to F.M. Thomas Air Conditioning, Inc. for the contract amount of$392,326 and approved a construction contingency in the amount of$82,674 for the replacement of the remaining twenty-eight(28)air handler units.During review of the new equipment submittals,it was determined that four(4)of the proposed air handler units should be upsized to provide better heating and cooling capacity.Change Order No. 1 was then authorized to upsize the four(4)units AHU#14,#26,#27 and#28 in the amount of$8,921.

During the recently completed locker room replacement project,it was observed that neither of the men's or women's shower rooms were equipped with exhaust fan facilities to eliminate the buildup of moisture and potential for mold.

Considering that a contract had already been awarded for the replacement of the Air Handler Units, it was deemed appropriate to have this issue corrected using the HVAC contractor in-lieu of the locker project contractor. Change Order No.2 was then authorized to install exhaust fan registers in the men's and women's shower rooms in the amount of$15,047.

As each of the new units are installed, they are reconnected to the existing HVAC control system.During this process, the contractor brought to our attention that the existing control system will only provide constant speed fan operation for the new units, and we would therefore not be getting the benefits and efficiency of the new variable speed air handler units being installed. The current HVAC controls are those that were installed with the energy upgrades in 2017 and are more suited towards the constant speed system that is being replaced. These controls are also based on proprietary programming and as such are more difficult to maintain and operate.

Page 225 of 237 ends

To take advantage of the efficiency of the new air handler units,F.M. Thomas Air Conditioning,Inc has suggested a scope of work to remove the existing outdated control system and replace with a Carrier iVu Control system which includes 28 local sensor units,a new control system for the chilled water and boiler plant,a mini-pc with a graphical user interface, customized graphics and programming and 8 hours of training. This system will also have the capability to be adjusted remotely by iPhone or iPad if desired. The total cost for the removal of the existing control system and integration of the new Carrier control system is$98,626.

ENVIRONMENTAL DETERMINATION
The Project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA) and the State CEQA Guidelines and determined to be categorically exempt from further environmental review pursuant to Section 15301 (Existing Facilities), of the CEQA guidelines. The project involves replacement of existing equipment within the existing facility footprint and does not involve any expansion of use beyond that which is existing.

FISCAL IMPACTS
The total cost for Change Order No. 3 is $98,626, increasing the total project cost to an estimated$514,920. There are available funds in the Capital Project Account No.4257500-5540-82347.

Estimated Project Costs
Awarded Construction Contract—F.M.Thomas Air Cond.: $392,326.00 Contract Change Order No. 1: $ 8,921.00
Contract Change Order No.2: $ 15,047.00
Contract Change Order No. 3: $ 98,626.00
Total Project Cost: $514,920.00

ALTERNATIVES

1. Reject Contract Change Order No. 3 and utilize existing HVAC Control System. Staff does not recommend this alternative.

2. Provide Alternative direction to staff.

"The City of Gracious Living"
Stafif(krctilt
CtIFOBS
DATE: January 13,2025
TO: MAYOR AND CITY COUNCIL
FROM: MICHAEL BLAY,CITY MANAGER
PREPARED BY:CHRIS ALANIS,INTERIM PUBLIC WORKS DIRECTOR

STEVEN NIX,CONTRACT PROJECT MANAGER
SUBJECT: CONSIDER AWARD OF BID FOR PROJECT NO. 82358,ELECTRIC VEHICLE CHARGING

STATIONS AT PUBLIC WORKS
RECOMMENDED ACTION:

It is recommended that the City Council approve the purchase of nine (9) CPF50 dual port, level 2 electric vehicle charging stations and one (1) CPE250 dual port, DC fast charging station from ChargePoint, Inc. in the amount of $99,942.02,authorize the City Manager to finalize the purchase of the charging stations through Sourcewell Contract No.042221-CPI;and approve a budget amendment to increase the Fiscal Year 2024-25 General Fund Capital Project Account No.4257500-82358 in the amount of$275,000 for Project No. 82358.

GOAL STATEMENT
The proposed action supports the City's objective of providing the most efficient use of City resources while increasing the use of environmentally friendly energy sources.

BACKGROUND
On April 27, 2023, in consideration of the City's desire to begin the purchase and use of electric vehicles within the fleet, the City applied for federal funding under the U.S. Department of Energy EECBG Program available to all agencies for the installation of electric vehicle charging facilities.

On May 3, 2024, the City was notified of approval under the EECBG Voucher Program for up to $134,030 of reimbursement for expenses related to design, construction and installation of electric vehicle charging facilities.

Under this program, the City is required to pay any costs associated with the project up front and then be entitled to reimbursement from EECBG.

ISSUES AND ANALYSIS
In addition to obtaining $134,030 in funding from the U.S. Department of Energy's EECBG Program, staff also became aware of a funding opportunity provided through Southern California Edison Company called the Charge Ready Program. This program, funded through the SCE rate structure, will provide 100%funding for the design and installation of all infrastructure needed between the SCE point of service and a proposed electric vehicle charging facility. On July 9,2024,the City submitted an application to SCE for this program and on October 9,2024,approval was received. SCE has prepared a conceptual design and is ready to move forward with final design documents, however the City must provide a commitment of purchase for the electric vehicle charging units for them to proceed.

Once the City has provided evidence of purchase, SCE will complete the design and have construction completed within 12-18 months.

The purchase of nine (9) CPF50 dual port, level 2 electric vehicle charging stations and one (1) CPE250 dual port, DC fast charging station is from ChargePoint, Inc. via the Sourcewell Contract No. 042221-CPI in the amount of $99,942.02.

The City of Upland is a Sourcewell member. Sourcewell, formerly known as the National Joint Powers Alliance (NJPA),is a self-sustaining government organization that provides contract purchasing solutions through Cooperative Purchasing. This arrangement allows multiple agencies to aggregate volume to enhance purchasing power. This procurement process meets the State of California's Cooperative Purchasing Code 6500 & 6502, and Upland Municipal Code section 2.48.080,allowing the City to dispense with the bidding procedures from suppliers who have been awarded a contract resulting from a formal competitive bidding process by another government agency.

Page 231 of 237 ends

Upon completion of the infrastructure by SCE, the City will initiate the competitive bidding process for the final installation of the pre-purchased charging units.

ENVIRONMENTAL DETERMINATION
The action being considered does not constitute a "project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15738(b)(5) because the activity includes the administrative activity of purchasing equipment that will not result in direct or indirect changes to the environment.

The actual installation of this equipment will occur at a later date at which time an environmental assessment will be performed prior to award of any construction contract.

FISCAL IMPACTS
The total cost to purchase the electric vehicle charging stations is$99,942.02. Once the budget amendment has been approved, there will be available funds in the General Fund Capital Project Account No.4257500-82358.

Funding for Project No. 82358 was approved in the Fiscal Year 2025-26 Capital Improvement Plan(CIP).Given the unexpected award of SCE's Charge Ready Program, this project needs to be moved forward to the current fiscal year.

As a result, the Fiscal Year 2025-26 CIP will be decreased in the General Fund Capital Project Account No.4257500- 82358 by$275,000 to acknowledge the change in fiscal year funding.

ALTERNATIVES
Provide alternative direction to staff.

CEQA:Not a Project.
