RECOMMENDATION
Conduct a public hearing regarding the proposed garbage rate increase. If appropriate, after hearing, adopt a resolution adopting the proposed garbage rate increases.

REASONS FOR RECOMMENDATION
SB 1383 legislation from the California Department of Resources, Recycling and Recovery (CalRecycle) requires all cities and counties in California to implement mandatory organics recycling and other programs to reduce organic waste disposal by 75% by 2025. To ensure compliance with this new legislation, Recology Vallejo (Recology), the City’s franchise waste hauler, will need to make significant operational and programmatic changes. There is not enough time left in the existing franchise Agreement to amortize or cover the costs to implement these new services. Therefore, Recology is proposing four rate increases that will take effect from July 1, 2022 through December 31, 2024.

Notices of the proposed increase to garbage collection services were mailed on April 29, 2022 to all residential property owners and on May 3, 2022 to all commercial property owners.

BACKGROUND AND DISCUSSION
Over the years, the State of California has adopted a number of bills mandating an update to the City’s waste management practices. The Integrated Waste Management Act of 1989 required jurisdictions to divert 50% of all waste away from landfills by 2000 or face fines of up to $10,000 a day for non-compliance. The City achieved this goal and has remained in compliance for many years.

In January 2012, CalRecycle adopted Assembly Bill (AB) 341, Mandatory Commercial Recycling, which requires recycling services for businesses and multi-family dwellings that generate four cubic yards or more of commercial solid waste per week. It was incumbent upon each jurisdiction to conduct outreach and provide businesses and multi-family dwellings with options to ensure that recyclable materials were diverted from the landfill through reuse, recycling and/or composting.

In January 2016, AB1826, Mandatory Organics Recycling, required the City to conduct outreach and implement an organic waste recycling program for businesses and multi-family dwellings to divert the following organic waste: food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and food- soiled paper waste.

In September 2016, SB 1383 was signed into law, establishing methane emissions reduction targets in a statewide effort to reduce methane emissions at landfills in California. The law mandates a 50% reduction in organics to landfills from 2014 levels by 2020, and a 75% reduction by 2025. As of January 1, 2022, the City is required to implement and oversee a program to recover edible food for human consumption, conduct

education and outreach to the community, create procurement policies, and more. It should be noted that the State requires jurisdictions, like the City, to enforce SB1383 for all residential and commercial generators that are not in compliance with this new legislation. Likewise, the State will levy penalties and fines of up to $10,000 a day on jurisdictions that fail to comply with SB 1383.

Based on these laws; SB1383 in particular, Recology will now need to modify its service routes, conduct extensive outreach, and purchase new vehicles, additional disposal containers, and container labels to provide organic waste collection services to all residential, businesses and Multi-Family Dwellings in the City.

Unfortunately, there is not enough time left in the existing franchise Agreement to amortize the cost to implement these new services and purchase all the new equipment needed to fully implement and meet the requirements of the SB1383 State mandate. Therefore, Recology has requested an amendment to the existing franchise agreement and is proposing four rate increases that will take effect from July 1, 2022, through December 31, 2024. The proposed rates will also cover the costs of additional customer service programs such as increased bulky-waste pick-ups, and dump coupons.

Notices of the proposed rate increases and of the public hearing were mailed on April 29, 2022 to all residential property owners and on May 3, 2022 to all commercial property owners. Also, five public meetings (three in person and two via Zoom) were held to inform and answer questions regarding the proposed rate increase. City staff understands that these are difficult times for the City’s residents and businesses; therefore, staff has worked with R3 Consulting and Recology to conduct as much outreach as possible and answer questions that the public might have. Full- and half-page ads were placed in the Vallejo Times Herald and on the City’s social media outlets regarding the public meetings that were held at the dates, times and locations listed below:

FISCAL IMPACT
The rate increases that Recology is proposing will increase all the program costs based on the percentage of increase. It is estimated that the franchise fees, which are 11%, will increase from $3,404,320 to $4,289,215 and the program costs will increase from $2,272,932 to $2,797,249 over the next two years.

BE IT RESOLVED by the City Council of the City of Vallejo as follows:

WHEREAS, the State of California recently adopted a number of bills mandating a comprehensive update to waste management and recycling systems, particularly with respect to the diversion of organic materials and food waste away from landfills; and WHEREAS, SB1383, the Short-lived Climate Pollutant Reduction Act of 2016, is the most significant unfunded waste reduction mandate adopted in California in the last 30 years, which directs public agencies to reduce organic waste disposal by 75% and increase edible food recovery by 20% by 2025 by requiring all waste generators are required to divert their organic materials from the garbage; and
WHEREAS, SB 1383 allows the Department of Resources Recycling and Recovery (“CalRecycle”) to impose enforcement actions and levy fines of up to $10,000 per day on local jurisdictions if significant progress has not been made in the law’s waste reduction goals; and
WHEREAS, SB 1383 requires the City to work with Recology Vallejo to implement new measures to reduce contamination, educate waste generators, procure recycled products with organic content, track and report recycling participation, and assist local jurisdictions with enforcement of new recycling requirements; and
WHEREAS, SB1383 will require substantial additional operational and programmatic changes in local waste hauling services to meet the new waste reduction goals; and WHEREAS, Recology Vallejo has informed the City that a rate increase is necessary for Recology Vallejo to meet the State of California’s new solid waste and recycling requirement; and
WHEREAS, Recology Vallejo has proposed a maximum service rate plan to increase garbage rates beginning on July 1, 2022 through June 30, 2024, attached hereto as Exhibit A; and WHEREAS, City Staff mailed notices on the proposed rate increases to all to all residential and commercial property owners, informing them of the date of the public hearing at which the City Council will take action thereon; and
WHEREAS, City staff has held seven public meetings including one via Zoom to inform and answer questions regarding the proposed garbage rate increases.

NOW, THEREFORE IT BE RESOLVED that the City Council of the City of Vallejo receives the proposed maximum service rate plan from Recology Vallejo to increase the garbage rates from July 1, 2022, through June 30, 2024, as set forth therein.

BE IT FURTHER RESOLVED that City Council adopts the maximum service rate plan as

proposed by Recology Vallejo.
