ACTION ITEM 9.C.
DATE: September 12, 2023
TO: Mayor and Members of the City Council
FROM: Melissa Tigbao, P.E., Public Works Director
SUBJECT: ADOPT A RESOLUTION APPROVING A FIRST AMENDMENT TO THE DESIGN PROFESSIONAL SERVICES AGREEMENT WITH INDIGO HAMMOND + PLAYLE ARCHITECTS, LLP TO: 1) INCREASE THE CONTRACT AMOUNT BY $2,671,765 TO A MAXIMUM NOT TO EXCEED AMOUNT OF $5,634,700; 2) MODIFY THE SCOPE OF
WORK TO INCLUDE ADDITIONAL DESIGN SERVICES FOR A NEW POLICE FACILITY AT 111 AMADOR STREET; AND 3) EXTEND THE TERM BY ONE YEAR, WITH TWO
ONE-YEAR OPTIONS TO EXTEND, AND AUTHORIZING THE CITY MANAGER TO
EXECUTE SAME
RECOMMENDATION
Adopt a resolution approving a First Amendment to the Design Professional Services Agreement with Indigo Hammond + Playle Architects, LLP to: 1) increase the contract amount by $2,671,765 to a maximum not to exceed amount of $5,634,700; 2) modify the Scope of Work to include additional design services for a new police facility at 111 Amador Street; and 3) extend the term by one year, with two one-year options to extend, and authorizing the City Manager to execute same.
REASONS FOR RECOMMENDATION
The original agreement was for Indigo Hammond + Playle Architects to assist the City with final renovation cost estimates and the development of bid ready construction documents for the Police Department Headquarters to be relocated to 400 Mare Island Way. As the current direction is to make the necessary renovations that will allow for the Police Headquarters to remain at 111 Amador Street, the scope of work, not to exceed limit, and term of the agreement must be amended to cover the new work required for this location.
BACKGROUND AND DISCUSSION
In 2018, the City of Vallejo began efforts to move police operations to 400 Mare Island Way and released an RFP for architectural design services in 2019. On February 25, 2020, the City Council authorized a design professional services agreement with Indigo Hammond + Playle Architects for $2,962,935 over the life of the agreement. Subsequently, on April 11, 2023, the City Council gave staff new directions to pursue the design and construction of a new police station located at 111 Amador Street. In order for Indigo Hammond + Playle Architects to continue work, the scope must be adjusted to include the services at 111 Amador Street.
As of the beginning of August 2023, $991,400 has been spent or is encumbered in relation to this contract (20- PW177), which is due to expire on December 31, 2023. The remaining approximately $1,971,535 will not sufficiently cover the cost of services for the modified scope of work, which is estimated to be $4,643,300.
There is a need to increase the contract by $2,671,765, which will raise the maximum not to exceed amount to $5,634,700. Additionally, the term will need to be extended to ensure sufficient time to complete the work.
Staff recommends approving the First Amendment to the Design Professional Services Agreement with Indigo Hammond + Playle Architects to: 1) increase the contract amount to $5,634,700; 2) modify the scope of work to include design services for 111 Amador Street; and 3) extend the term of the agreement to December 31,

2024, with two additional one-year options to extend.
FISCAL IMPACT
The proposed recommendation is to amend the agreement with Indigo Hammond + Playle Architects, LLP, for an amount not to exceed $5,634,700. Due to current funding availability, the agreement has been divided into three different phases:
• Phase 1 – Preliminary Design (through 35% design completion, Schematic Design) • Phase 2 – Final Design (65% Plans, Specification, and Estimate (PS& E), 95% PS&E, 100% Submittal and Permit)
• Phase 3- Bidding and Construction Support
The agreement stipulates that the architect will not proceed with each phase without receiving a written task order or authorization from the City.
If the City Council approves the proposed action, the first amendment will be for a maximum contract amount not to exceed $5,634,700, with the costs of estimated work from the modified scope ($4,643,300) allocated as follows:
Phase 1 – $1,653,300
Phase 2 – $1,998,200
Phase 3 – $ 991,800
Funding for this agreement will come from capital improvement project PW9818, which is currently funded for Phase 1.

ACTION ITEM 9.D.
DATE: September 12, 2023
TO: Mayor and Members of the City Council
FROM: Stephanie Sifuentes, Human Resources Director
SUBJECT: APPROVE FIRST AMENDMENT TO CITY MANAGER EMPLOYMENT AGREEMENT
RECOMMENDATION
Adopt a resolution approving an amendment to the Employment Agreement for City Manager, Michael Malone.
REASONS FOR RECOMMENDATION
The City Council and Michael Malone have completed a performance evaluation for the period of April 19, 2022 through April 18, 2023. Both parties mutually desire to amend the Employment Agreement to apply a Cost of Living Adjustment (COLA) of 3%, effective the first full pay period following April 18, 2023.
BACKGROUND AND DISCUSSION
The City Council and Michael Malone have completed a performance evaluation for the period of April 19, 2022 through April 18, 2023. Both parties mutually desire to amend the Employment Agreement to apply a Cost of Living Adjustment (COLA) of 3%, effective the first full pay period following April 18, 2023.
The proposed COLA is consistent with other recent employee increases. Effective the first full pay period following July 1, 2023, employees in three of our bargaining groups received a cost of living adjustment of 3%, including IBEW, CAMP, and Unrepresented. In addition, the City Attorney received a 3% COLA effective the first full pay period following July 1, 2023. This 3% COLA is intended to provide employees with an off-set for increased costs of living, in addition to keeping all classifications in alignment with one another.
FISCAL IMPACT
The total cost of the 3% Cost of Living adjustment is approximately $10,700 (for one year) from the first full pay period following April 18, 2023 through the contract end date of April 30, 2024. This amount will be funded from anticipated budget savings.
