April 30, 2024

To: Mayor McConnell and Vallejo City Council

RE: Item 5.A . CONSIDER THE WHOLE OF THE RECORD AND POSSIBLE ADOPTION OF A RESOLUTION DENYING AN APPEAL (APP24-0001) OF THE PLANNING COMMISSION’S APPROVAL, AND GRANTING WITH CONDITIONS, MAJOR USE PERMIT (UP22-0008) TO ALLOW

THE OPERATION OF A NEW PUBLIC CHARTER HIGH SCHOOL WITH AN ENROLLMENT OF UP TO 400 STUDENTS IN AN EXISTING TWO-STORY BUILDING AT 241-255 GEORGIA STREET (APN:0055- 170-390) AFTER FINDING THE PROJECT CATEGORICALLY EXEMPT FROM ENVIRONMENTAL

REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15332 (CLASS 32: IN-FILL PROJECTS).

Mayor McConnell and Vallejo City Council,

The Staff Report for Item 5.A of the April 30, 2024 Special Meeting of the City Council erroneously stated that the Downtown Vallejo Specific Plan (DVSP) has always allowed high schools in the Georgia Street Corridor, first by right and later with a minor use permit. This was not correct.

However, the 2021 Zoning Code Project eliminated the land use regulations from the Specific Plan and incorporated them into the new Zoning Ordinance. Land uses in the Downtown Vallejo Specific Plan area are now regulated under the Downtown-Mixed Use (DMX) zoning designation. The DMX zoning designation permits any level of school—elementary, middle and high school—in the Georgia Corridor.

Small schools (less than 10,000 sf) are permitted by right and large schools (over 10,000 sf) are permitted with a Major Use Permit.

Best,

Christina Ratcliffe, AICP,
Planning and Development Services Director
