Dear Mayor and Council-members: 28 March 2025 First, thank you for your service thus far in your term of office; your job is challenging and I fully appreciate how week in and week out it takes a good deal of your time to work through the complexities of municipal governance.

But govern you must, regardless of the hour, or whether one is tired, uncomfortable, hungry, in the throes of a moral dilemma, in of need legal counsel, or “time to reflect.” While many municipalities’ unfortunate misreading of Martin v. Boise and unwillingness to act within the actual metes and bounds of that decision—instead of the laissez fair approach— helped the situation escalate to crisis proportions, this is on your plate now, so please govern.

A lawyer friend told me once that anyone can sue for anything and for virtually any reason at any time. And there are plenty of attorneys that do and will. Please govern.

While there was an admittedly tragic loss of life during a cleanup—adapt, solve the problem going forward; don’t blame. Please govern.

While it is not a crime to be homeless, too many criminals, packs of vicious dogs, large numbers of severely mentally ill, drug addicts and alcoholics reside in homeless camps. The bad actors commit crimes, deal drugs and pose public safety, public health, and environmental threats both within and outside of these camps. Please govern.

While it would be idyllic if the resources existed for adequate housing, mental health care, and alcohol and drug addiction treatment and or counseling, they don’t, and they never will. And if those resources existed, as San Francisco, San Jose, and multiple other more well-heeled municipalities in California have found, well over half, that is “most,” on the street or in camps prefer to stay on the street or in encampments. The City has many other pressing issues and interests that demand our scarce resources and your attention.

The greatest good for the greatest number. Please govern.

Special thanks to Mr. Murray, Mr. Lanusse, and the Solano County Sheriff’s Department for their help thus far.

Thank you,
Richard Underwood, Vallejo

Dear Mayor Sorce, City Council, City Manager Murray, and Vallejo’s senior leadership, Regarding the encampments for the unhoused, and pausing the clean-ups, I will cut to the chase:

I

am

among

many

who

are

relieved

that

Vallejo

finally

started

cleaning

up

the

illegal

encampments,

and

plead

that

the

city

will

continue

to

do

so.

The

city

has

tolerated

too

much

for

too

long.

It’s

time

to

reclaim

public

assets

and

spaces

for

clean

and

safe

access

by

ALL

123,000

of

Vallejo’s

residents,

not

just

the

fraction

who

are

unhoused.

The decision on the encampments affects all of Vallejo’s public safety, health and economic development.

Further,

if

we

pause

clearing

encampments

at

the

same

time

that

nearby

cities

are

tightening

their

anti-camping

enforcement,

we

make

Vallejo

even

more

of

a

target

for

lawlessness.

The

idea

of

coming

to

Vallejo

is

already

trending

in

social

media.

This email covers requested actions, and broader policy considerations. REQUESTED ACTIONS 1. Continue the clean-ups, especially at City Center and White Slough. a. The encampments at City Hall and the ferry building create an appalling first impression

for

new

residents,

new

businesses

and

tourists.

In

the

interests

of

economic

development

and

tourism,

the

“front

door”

to

the

city,

and

major

institutions

and

arteries

should

be

clean

and

welcoming.
b. White Slough is a bonafide crime center plus an ecological disaster. I’m surprised the

state

hasn’t

slammed

us

on

it.
c. When Natalie said the encampments quickly return, she later clarified that was prior

to

the

Supreme

Court

decision,

when

they

cleaned

around

encampments

but

left

tents

in

place
.

After

the

Supreme

Court

ruling,

the

city

has

actually

cleared

the

encampments

and

tents
,

which

has

largely

worked.

The

city

said

it

spent

$360,000

on

clearing

encampments,

but

almost

all

of

that

was

for

fixed

salary

costs,

so

that

figure

is

misleading.

Clearing

the

encampments

helps.

2. Expedite the opening of Navigation Center. It’s inexcusable that it has taken so long. 3. Offer first dibs for the Navigation Center to those at City Center and White Slough, but make

it

non-negotiable

–

either

move

to

the

Nav

Ctr,

or

move

on.

Street

experts

on

the

unhoused

say

only

about

20%

will

accept

help,

so

moving

big

groups

to

the

Nav

Ctr

would

take

a

big

bite

from

those

open

to

getting

help.

4. Once the City Center and White Slough are cleared, keep them cleared. 5. Create a Park & Sleep program and ordinance. Fairfield has had such an effort. This would

address

the

28.5%

who

sleep

in

their

cars,

and

if

run

with

local

churches,

should

not

be

a

budget-breaker.

6. Longer term, create a site for safe car camping –>>away from residences and businesses,

and

NOT

in

District

4. The

former

drive-in

on

Benicia

Rd

has

water,

electrical

and

sewer

connections,

and

few

close

neighbors.

If

not

there,

work

w/

Fairfield

and

the

County

to

offer

something

adjacent

to

the

Fairfield

shelter.

Anne Carr, March 30, 2025 Page 1

7. Encourage meals in food halls or at least designated areas where there is food clean-up
.

Leaving

the

remains

of

individually

packaged

meals

at

encampments

creates

rat

infestations.
a. Rat infestations are universal at the encampments – even the unhoused complain

about

them.

And

the

City

Attorney

knows

about

the

infestations.

She

admitted

that

at

the

clean-up

of

Brinkman’s

Marina,

she

stood

on

some

sort

of

crate

so

the

rats

wouldn’t

run

over

her

shoes.

To

be

honest,

I

don’t

understand

why

County

Vector

Control

has

not

cracked

down

on

this.
b. The next day after the clean-up at Brinkman’s, there were so many swarms of rats

on

Mare

Island

Way,

a

neighbor

had

to

stop

his

car

until

the

street

cleared.

Another

early

commuter

said

she

thought

the

earth

was

moving.

The

encampment

at

Lofas/Lakeside

was

finally

cleared

when

neighbors

complained

about

rats,

and

County

Vector

Control

was

alerted.

8. Sell Herbert House, the State Farm bldg, the N Vallejo school, and Farragut school in order

to

raise

money

for

various

services,

including

the

unhoused.
a. Rezone the Herbert House to Commercial and even Residential to get a better price.
b. If there are no buyers for the State Farm building, lease it to private sector tenants

who

will

pay

taxes

and

offer

jobs.

This

was

the

original

purpose

of

building

there:

jobs

and

revenue.

9. Promote the adoption of a county-wide standard that public camping is a misdemeanor, so

that

there

is

a

record

of

engagement,

and

so

that

people

have

to

go

to

Care

Court

and

at

least

consider

options

for

housing

and

treatment.

Fairfield

has

this

standard.

10. Encourage CAP-JPA to fund County-wide mental health & substance treatment 11. Encourage CAP-JPA to fund shelter beds, plus transition housing e.g., tiny huts or homes.

Conestoga

huts

can

cost

as

little

as

$3500

per

hut,

with

obviously

some

amount

of

cost

for

a

platform

and

services.
a. The County is truly lacking adequate facilities for the ”Continuum of Care.” If you call

“Resource

Connect”

you

will

discover

that

through

the

“Coordinated

Entry

System”

Resource

Connect

only

places

people

in

ONE

shelter

that

has

6-8

beds

for

the

entire

county.

That

is

not

a

typo.
b. https://www.communitysupportedshelters.org/conestoga-huts 12. Stop condoning the concentration of the unhoused in District 4. Although there are a few tents

and

RVs

sprinkled

around

the

city,

District

4 has

had

approximately

80-85%

of

the

largest

encampments.

It’s

a

scale

and

intensity

beyond

what

other

areas

experience,

with

the

RV

camps

in

District

6 a

distant

2nd.

It’s

too

heavy

a

burden

for

too

long,

and

is

unfair.

The

few

encampments

that

sprout

up

on

the

east

side

are

much

smaller,

and

quickly

cleared.

PLEASE ENFORCE THE LAW ● Vallejo is not a campground; state penal code and city regulations prohibit using public property

for

camping
● In no other case does the city have to justify enforcing the regulations that enhance public

safety

and

well-being.

Anne Carr, March 30, 2025 Page 2
CONSIDERATIONS ● As an underfunded city, we do not have the resources to house all the homeless. The projected

$8M

budget

deficit

for

the

next

fiscal

year

is

a

sobering

reality.

We

need

to

push

for

County

&

State

resources,

and

recognize

the

limits

of

our

budgets.
● Allowing guerilla encampments sets a dangerous and unfair precedent of allowing public assets

to

be

commandeered

for

private

use.

Where

do

you

draw

the

line?

The

use

of

public

land

for

private

purposes

is

effectively

stealing

from

the

public

good.
● People like to talk about equity, but it’s unfair to condone the disproportionate concentration

of

encampments

in

District

4,

where

80-85%

of

the

large

encampments

have

been

located.

It’s

essentially

a

continuation

of

the

segregation

and

redlining

that

framed

Vallejo’s

housing

development

for

decades.
● The “lived experience” of residents and businesses who live near encampments deserves

consideration

and

has

received

scant

attention.
● Regardless of your personal empathy for the unhoused, as city leaders your responsibility

is

to

make

decisions

that

achieve

the

greatest

good

for

the

greatest

number.

Vallejo

has

approximately

123,000

residents,

yet

we

have

allowed

takeover

of

public

spaces

by

a

fraction

of

that

total.
● Some challenges are beyond the scope and expertise of local resources. Just as we cannot

cure

cancer

at

the

local

level,

solving

the

complex

issues

of

the

unhoused

swamps

our

resources

and

expertise.
● Housed residents and businesses are expected to keep their areas clean and maintained,

but

anything

goes

for

the

unhoused.

Even

if

the

unhoused

were

in

an

official

campground

they

would

have

to

keep

their

spaces

tidy

or

get

kicked

out.
● Compassion for the unhoused should not be at the expense of everyone else. ● It is very different to live across the street from an encampment, or right next to one, vs 5 miles

away.

Those

who

live

in

more

privileged

areas

should

not

be

foisting

encampments

on

already

burdened

areas.
● Too much chaos and dysfunction has been tolerated for too long. We want our city back. IMPACTS OF LEAVING ENCAMPMENTS IN PLACE ● Newsom may withhold state funds if we do not clear encampments. ● Following the Supreme Court decision on Boise , many cities are tightening their anti-camping

regulations.

If

Vallejo

loosens

its

enforcement

now,

we

will

become

even

more

of

a

magnet

for

the

unhoused

and

related

lawlessness.
● In addition to actual costs, the encampments create an opportunity cost for lost potential business,

revenue

and

residents.

There

is

an

economic

hit

of

people

not

feeling

safe

shopping

in

Vallejo,

and

of

businesses

not

wanting

to

invest

here
● Condoning the encampments encourages general lawlessness and blight. By not taking action,

the

city

could

be

liable

for

damages.

SETTING PRIORITIES ● Public safety is critical for the security of all 123,000 residents, and for business retention and

development.

Anne Carr, March 30, 2025 Page 3
● The COV has been paralyzed in wanting to avoid liability, while well-intentioned advocates

say

leave

encampments

in

place

–

which

unfortunately

means

that

District

4 would

continue

to

shoulder

the

bulk

of

the

burden
● Following the Supreme Court’s ruling on the Boise decision, cities are now able to reclaim

their

streets

from

unfettered

encampments.

Despite

the

sympathy

some

have

for

the

unhoused,

we

deserve

clean

and

safe

public

spaces.

● Bottom line, compassion for the unhoused should not be at the expense of other residents

and

businesses.

FREE WILL, AGENCY & RECOVERY We cannot force the unhoused to get help or treatment. They have free will, even if they are making

bad

choices.

But

we

also

do

not

force

them

to

camp

illegally

in

public

and

private

spaces.

We

should

not

sanction

their

choices

by

allowing

the

takeover

of

public

assets

and

spaces.

One aspect of the homeless crisis that gets little discussion is around recovery, and the consequences

of

substance

abuse.

If

you

talk

to

experts

in

recovery,

they

will

say

that

hitting

bottom

is

what

drives

people

into

recovery

from

substance

abuse.

If

you

remove

the

bad

consequences,

do

you

prolong

the

substance

abuse,

much

as

what

happened

in

Oregon’s

brief

experiment

with

decriminalizing

illicit

drugs?

Per

the

2024

Point

in

Time

survey

39%

admit

to

substance

use,

and

28%

report

mental

health

problems.

There

might

be

overlap

of

those

two,

but

they

are

probably

both

undercounts

and

understatements.

At

the

high

end,

it

could

be

almost

70%

who

could

benefit

from

mental

health

or

substance

treatment.

ONE-SIDED CONSIDERATION OF ISSUES So far, there has been a mostly one-sided discussion about encampments. By hastily calling a “Special

Meeting”

on

Tues

March

18,

the

city

did

not

give

adequate

notice

to

the

full

community

that

might

have

wanted

to

speak.

Thus, we’ve heard lots of testimony about how clearing the encampments harms the well-being

of

the

unhoused,

but

very

little

about

the

considerations

and

“lived

experience”

of

housed

residents

and

businesses,

and

the

impact

of

the

encampments

on

the

rest

of

us.

The encampments are not neutral nor benign. Living close to them puts a heavy burden on

nearby

residents

and

businesses,

for

example,

blight,

garbage,

rat

infestations,

fires,

open

air

drug

use,

violence,

weapons,

porch

takeovers,

burglaries,

chop

shops,

fencing

operations,

rogue

gangs,

prostitution,

vagrants,

and

general

lawlessness.

BUDGET CONSTRAINTS At the city’s recent budget workshop, we got the sobering warning that we might face a $8 million

deficit

in

the

next

fiscal

year.

No doubt the City Manager will attempt to get our expenses in line with revenue. We already

are

running

a

$2.8

million

structural

deficit

for

this

fiscal

year,

which

we

have

covered

by

having

an

almost

crippling

level

of

staff

vacancies.

Obviously, Vallejo has some very tough choices. No one likes cuts in services, and no one

wants

to

have

to

say

no

to

impassioned

requests.

Yet

we

have

to

have

clear

eyes

about

the

Anne Carr, March 30, 2025 Page 4
full scope of Vallejo’s needs for the full spectrum of our population. Here are some unfunded and

underfunded

needs:
● $11million for help from the sheriff ● An unknown amount for security guards. Several million? ● $100million for a new police station ● $10million/year for 10 years to inch our streets up a couple notches in quality. $500million

for

the

whole

enchilada!
● Tens of millions for a new seawall and dredging for the marina ● Millions to recruit lateral-hire police officers and get the PD to adequate staffing levels. In short, we’re an underfunded city, and are not adequately funding the basics like public safety,

nor

most

all

other

city

functions.

Staffing

is

about

30%

below

a

full

level

in

most

city

departments,

and

most

city

services

are

delayed

because

the

city

does

not

have

enough

people

to

handle

the

functions.

WHAT ARE ROOT CAUSES OF BECOMING UNHOUSED? Is the root cause of homelessness the high cost of housing – or for the majority, does it trace to poor

life

choices

and

disabilities?

How

you

answer

this

question

shapes

our

strategy

for

the

unhoused.

While

not

everyone

has

mental

health

or

substance

issues
,

the

2024

PIT

survey

says

that

almost

70%

do

have

those

issues,

revealing

a

big

clue

to

who

is

in

the

largest

encampments.

If

you

isolate

vets

and

those

needing

mental

health

&

substance,

that

leaves

25%

of

the

unhoused

stemming

from

unexpected

hardships.

That

would

be

a

much

more

manageable

number.
● There’s great sympathy for the unhoused in Vallejo – the high cost of housing combined with

Vallejo’s

low

average

incomes

make

many

feel

they

are

a

paycheck

away

from

being

homeless.

Many

assume

that

the

cost

of

housing

is

the

cause

of

homelessness,

● It you look at the 2024 Point in Time, it gives clues as to key issues in being homeless: ○ 39.3% admit to substance use, probably an undercount, and also probably understated.

○ 29.5% have mental health issues ○ 5% of the unhoused are veterans. They should get top priority for housing. ○ In the PIT surveys when they still asked about working, only 25% did any kind of work, and

some

of

them

it

was

seasonal

or

sporadic.

Did

the

PIT

surveys

stop

asking

about

work

because

the

low

numbers

were

too

incriminating?

What

we’ve

observed

in

the

large

encampments

is

people

doing

drugs

in

public,

in

the

middle

of

the

day,

chop

shops,

fencing

operations,

drug

dealing.
○ Yes, we need better mental health and substance treatment, but individuals also need

to

be

accountable

for

their

decisions.

In

the

world

of

substance

recovery,

protecting

addicts

and

alcoholics

from

the

consequences

of

their

action

is

called

enabling,

and

it’s

seen

as

a

major

obstacle

to

the

person

becoming

healthy.

ARE WE DOOMING ECONOMIC DEVELOPMENT? Year after year, Vallejo’s city leaders have said that economic development is critical. Yet allowing

unlimited

and

unfettered

encampments

undermines

our

efforts

to

attract

and

retain

new

residents,

businesses

and

tourists.

The

encampments

at

our

city

center

and

in

front

of

the

ferry

Anne Carr, March 30, 2025 Page 5
are especially appalling. If that area is your first look at Vallejo, why would anyone ever look any farther?

There

is

no

way

you

can

have

blighted

encampments

at

the

front

door

to

the

city

and

expect

to

attract

new

residents,

new

business

and

tourists.

PERSONAL AGENCY, & FREEDOM TO MAKE CHOICES Homeless advocates oppose clearing encampments, saying, but where will the unhoused go? These

laments

overlook

a

key

issue,

and

that

is,

just

as

the

city

and

state

cannot

force

the

unhoused

to

seek

help

or

treatment,

the

city

also

does

not

“force”

the

unhoused

to

camp

illegally.

At

some

point,

the

unhoused

have

both

the

freedom

and

the

responsibility

to

make

life’s

choices.

Many people with street experience say that only about 20% of the unhoused will seek or

accept

help.

The

unhoused

often

prize

their

“independence”

and

don’t

want

to

be

constrained

by

someone

else’s

rules.

While

that

is

their

choice,

we

should

not

say

ok,

anything

goes,

just

camp

wherever

you

like.

THE FAILURE OF REAGANISM & CLOSING MENTAL INSTITUTIONS The very fact that we are grappling with the unhoused dates back to the national movement to close

mental

health

institutions.

The

political

lie

told

then

was

that

it

would

be

better

to

treat

mental

health

and

substance

issues

at

the

local

level

–

but

the

budgets

and

expertise

for

doing

so

were

not

part

of

the

package.

Since

the

1980s,

90%

of

the

mental

health

institutions

in

the

country

have

closed.

90%
.

It’s

a

staggering

proportion,

and

leaves

cities

and

counties

struggling

to

create

solutions.

The

state

of

California

has

spent

$24

billion

from

2019-2024,

yet

our

unhoused

population

has

grown.

Obviously,

the

decentralized

approach

is

not

working.

LOCATION, LOCATION The most successful compound for the unhoused in the country is called Community First, in the Austin

TX

area.

They

specifically

located

their

compound

8 miles

from

the

city

center.

Similarly,

the

Dignity

Villages

in

the

Portland

area

are

near

the

airport,

far

from

the

city

center.

Vallejo

and

Solano

County

would

do

well

to

follow

this

example,

as

the

unhoused

population

can

be

very

problematic.

The

idea

that

the

unhoused

need

proximity

to

bus

routes

is

not

supported

by

their

actual

use

of

public

transportation,

and

with

food

deliveries

made

to

encampments,

they

do

not

need

to

be

in

the

center

of

businesses.

I apologize for the length of this email. I know Council is inundated. But obviously, there is much to

say,

and

to

quote

Mark

Twain,

“I

would

have

written

a

shorter

letter,

but

I

didn’t

have

the

time.”
To close, I reiterate my plea: please continue to clear the encampments. We need to simultaneously

get

the

Navigation

Center

open,

and

to

pressure

the

County

to

up

their

game.

But

to

pause

the

clearings

now

makes

our

bad

problem

worse.

ZjQcmQRYFpfptBannerEnd March, 31, 2025 Dear Vallejo City Council Members, I am writing to express my concern regarding the decision to pause encampment sweeps in Vallejo. While addressing homelessness with compassion is essential, halting encampment cleanups without immediate alternatives poses significant risks to both the unhoused and the broader community. Unchecked encampments on public property, including parks, sidewalks, and other publicly funded areas, can lead to unsanitary conditions, fire hazards, and increased crime. Public spaces should be accessible and safe for all residents. Allowing encampments to persist on publicly funded land challenges the maintenance of safety and accessibility for the entire community. Data indicates that persistent homeless encampments adversely affect local economies, deter investments, and contribute to revenue losses, property value declines, and increased crime. For instance: • Property Value Declines: A study estimated that the externalities associated with homeless encampments in Los Angeles resulted in property transaction losses totaling $32.4 billion, more than double the projected cost of housing all 31,000 individuals living on the streets. • Business Revenue Losses: In Denver, businesses experienced up to a 40% drop in sales, while Portland reported a 25% revenue loss, attributed to the presence of nearby homeless encampments. • Increased Crime Rates: Research indicates that crime is 2.9 times more concentrated within one block of reported homeless camps compared to other areas in Portland, Oregon. Cities like Berkeley and Los Angeles have faced legal actions from businesses and homeowners over financial losses and safety concerns related to nearby homeless encampments. If encampments remain unregulated, Vallejo could encounter similar legal challenges and economic repercussions, affecting both the economy and public services. While homelessness is a complex issue, allowing encampments to persist without regulation risks further economic decline. Encampments discourage new business investment, as safety concerns and negative perceptions reduce foot traffic and deter potential investors. This lack of investment limits city revenue and hampers funding for essential services, including support for the homeless, creating a cycle of economic decline. Rather than pausing sweeps indefinitely, Vallejo should focus on expanding shelter options, referring individuals to regional mental health and substance abuse services, and providing targeted support for formerly housed Vallejo residents. Given Vallejo’s limited resources, prioritizing support for those with the strongest ties to the community will ensure that resources are directed to those who truly need them, helping maintain a sustainable approach to addressing homelessness. I urge the council to reconsider this decision and implement a plan that prioritizes formerly housed Vallejo residents while ensuring the safety and quality of life for all. Thank you for your time and attention. CITY OF VALLEJO

ADMINISTRATIVE RULE

SUBJECT: ENFORCEMENT OF UNLAWFUL CAMPING
ORDINANCE; CLEAN UP OF TEMPORARY
SHELTERS; AND TEMPORARY STORAGE

OF UNATTENDED PROPERTY
A.R. Number: 7.10
Date Effective: 09-28-11
Date Revised: 10-26-20
6-17-14

I. PURPOSE

The City of Vallejo regularly receives complaints from citizens and businesses throughout the City which relate to health and safety, criminal activity and other concerns arising in and around areas in which individuals have erected temporary shelters.

By this Administrative Rule, the City of Vallejo sets forth its policies and procedures for cleaning up areas in which individuals have constructed temporary shelters, and expresses its intention to implement these policies in a manner which balances the n eeds and rights of all of its citizens, including the residents of such temporary shelters. This policy does not establish any individual right to erect temporary shelters or otherwise encroach on public or private property.

II. POLICY

The City of Vallejo shall respond to complaints and concerns arising in and around areas in which individuals are unlawfully camping or have erected temporary shelters, in a manner that protects the public health and safety and which complies with applicable state, federal, and local laws.

This Administrative Rule 7.10 seeks to promote a balanced approach to addressing potential negative impacts of encampments, while respecting the need for shelter, safety, and community.

Specifically, this Administrative Rule aims to:

• Acknowledge that encampments are born of the necessity to address basic human needs such as shelter, sleep, and community.
• Expeditiously respond to complaints and concerns of citizens arising in and around areas in which individuals are unlawfully campi ng or have erected temporary shelters, in a manner that protects the public health and safety and which complies with applicable state, federal, and local laws.
• Create a single applicable definition of encampments and the process to respond to encampments.
• Enumerate a continuum of response options, emphasizing proportionality of response in relation to totality of circumstances or impacts present at an encampment. • Ensure that encampment response does not preclude or replace normal investigation and prosecution of unlawful activity at an encampment.

III. DEFINITIONS

Encampment or Temporary Shelter Encampment is one or more individuals or households:

• Who have been inhabiting a specific public location not meant for human habitation for three or more consecutive days; and
• Who meet at least one of the following conditions:
o Use temporary sheltering accommodations such as tents, vehicles, or improvised structures that they leave attended or unattended at such public location; and/or o Have accumulated ma terials or personal belongings that they leave attended or unattended at such location.

Personal Property may include but is not limited to clothing, shoes, jackets, tents, backpacks, duffel bags, bicycles, tools, watches, jewelry, audio and video equipment, medications, toiletries, eyeglasses, purse, handbags, personal papers, equipment, photographs, books , and baby strollers.

Trash and Debris is rubble, wreckage, ruins, litter , discarded garbage/refuse, and scattered remains of something destroyed. It includes property that appears to have been discarded by its owner, but the fact that the property is unattended does not necessarily mean that it has been discarded.

Unattended Property is defined in Vallejo Municipal Code section 7.67.020 as any personal property which appears to have been abandoned, discarded, or disregarded by its owner; or property which has been left unattended for an unreasonable amount of time. An “unreasonable” amount of time may be any amount of time . However, any property left unattended for twelve hours or more is presumed to be unattended and shall be processed as set forth in this Administrative Rule. Unattended property shall be handled pursuant to the City’s policies and procedures, and in no event shall it be destroyed without providing owners with notice and a reasonable opportunity to recover the property.

IV. PROCEDURE

The following procedures apply to encampments on both public and private property. However, if the encampment is on private property, unless the encampment is an immediate danger, the City must first obtain an abatement warrant or consent from the owner of the property.

A. Encampment Resolution: Noticing Protocols

When City staff identify an encampment or temporary shelter encampment or a person occupying camp facilities or using camp paraphernalia for the purpose of overnight occupancy in a manner that violate s Chapter 7.67 of the Vallejo Municipal Code, enforcement of that Chapter may commence. Unless there is a need for immediate abatemen t or encampment removal, n o police or code enforcement officer shall issue a citation, make an arrest , or otherwise enforce this section against any person unless the following steps are c omplied with:

1. Verbal Warning

The police or code enforcement officer first orally requests or orders the person to refrain from the alleged violation of this section.

2. 72-Hour Written Notice

If the person fails to comply after receiving the oral request or order, the police or code enforcement officer shall tender a written warning stating that if the person fails to comply with the notice within 72 hours, he or she may be subject to a citation and removal of the encampment by City staff.

The wr itten notice will state that individuals must move their belongings before the conclusion of the 72-hour noticed period or their possessions will be removed and stored according to City ’s policies. The 72-hour written notice shall be in a form substantiall y similar to Exhibit A, attached hereto.

The posting and/or service of the 72 -hour written notice shall be performed in a manner which is reasonably calculated to provide effective notice to any residents of the adjacent encampment. Where possible, the notice shall describe the area subject to removal as clearly as possible (e.g. the east side of the 400 block of Olive Avenue). The notice shall be served by email and/or facsimile on the organizations that assist residents of encampments including, but not limited to: Vallejo Housing Authority CAP Solano, Mission Solano.

3. Abatement after 72-Hour Notice

There are a total of 941 incidents reported that were reported as directly related. Also attached are heat maps (broken into North and South Vallejo) that plots the data points of the locations in the report that shows a visual representation of locations and frequency of calls. It is important to note that the only way to track this data is a self-reported data field in the National Incident Fire Reporting System (NFIRS) report that the oVice completes. The field is labeled “Was this call homeless related” with the options of YES/NO/UNKNOWN. The report attached only pulls the “YES” incidents as reported. If “UNKNOWN” was included, the number would have been closer to 1500. 2. % or # of calls for Police / IHart for support for unhoused members in the past few years The police department does not currently track calls for service based oV an “incident type” or use specific verbiage (ie: unhoused, homeless, encampment, etc.) when entering calls for service involving our unhoused population. Most often that information is not included in the call for services unless it is relevant to locating the subject in a specific area. 3. approximate $ cost for each encampment sweep + total # of sweeps in 2023, 2024 and 2025 (thus far) Clean-ups conducted in: • 2023 – 7 clean-ups • 2024 – 28 clean-ups (8 pre-Grants Pass – no movement of individuals) • 2025 (to date) – 16 clean-ups (additional 3 locations posted, but clean-ups paused) Costs per clean-up are not specifically tracked. Beginning in July 2024 IBEW employees (predominately Public Works (PW) staV) receive a diVerential for work conducted in an encampment clean-up. We can pull exact staV costs for staV working on the clean-ups (PW and VPD OVicers) and estimate costs associated with staV from City Manager’s OVice and City Attorney’s OVice dedicated specifically towards encampment clean-ups. Other costs associated with clean-ups that have not been as communicated on March 18, 2025 to Council are trash dumping costs, which are currently included with all dumpsters or dumping costs (i.e.: illegal dumping and regular trash pick-ups) and vehicle/equipment usage and vehicle maintenance from wear and tear. 4. # of encampments in each of the districts – this has come up repeatedly in many emails we’ve received. Below are the number of encampments reported that are on City property. The encampments listed are based on SeeClickFix reports, and locations reported to staV (through community member & council emails and phone calls). The encampments vary in size from 1 vehicle and/or tent/structure to multiple vehicles and/or tents/structures. • District 1: 26 • District 2: 15 • District 3: 3 • District 4: 65 • District 5: 39 • District 6: 34 5. May I have the list of vacant properties shared with the past City Councilmembers and any associated proposed plans and costs for use of the land, services such as trash, port a potties, security, street medicine teams, county services, etc. The vacant locations previously brought before Council are listed below. Attached is the staV report that went to Council May 26, 2020 and ultimately Council did not direct staV to move forward with any of the presented locations. • Short-term Options o 3 Curtola (Boat Launch / Lot M) o 485 Wilson (River Park) o County owned Fairgrounds parking area o City owned lot at Wilson & Tennessee o City owned near Broadway & Tenneessee • Long-term Options o 500 Redwood (Former Walmart Site on Redwood & Sonoma Blvd.) o City owned property near Rollingwood and Benicia Rd On December 21, 2021, staV brought Hope Village for City Council consideration of an outdoor tent camping facility at an existing church parking lot. At that meeting another location was also put forth for consideration and both sites were ultimately not approved for permitting of tent camping. o 921 Amador St-Church of the Nazarene o 1140 Fifth St The cost for any proposed tent locations will vary depending on the type of shelter (i.e.: tent, pallet, tiny home, vehicle camping, etc) and the number of individuals served per site. The information below are estimates for diVerent project types previously researched by staV and presented to Council (in February 2022). StaV are currently reviewing more recent budgets that are available from similar projects to get more current information. The ranges vary depending on the services that are needed or provided to the program (i.e.: restrooms, security, wrap around services, medical support, etc.). • Safe camping: $30K-$61K per tent per year • Safe parking (cars): $10K per vehicle per year • Safe parking RVs: $18K-$27K per RV per year 6. Please provide the address used to store items removed from members of this community and the process to book the items and retrieve. Items stored from encampment clean-ups are currently stored at an oV-site City property in a Conex container. The description of items that are eligible to be stored are outlined in Administrative Rule 7.10 (attached). Items stored are documented, photographed, and transported to the storage container. The Unhoused Team works with individuals’ onsite prior to clean-ups. StaV oVers storage of items that unhoused do not wish to discard or won’t be able to move prior to the start of the clean-up. The Unhoused Team also does their best to identify if tents that are vacant upon staV’s arrival are truly vacant or if the individuals might be coming back. They do that through working with the unhoused in the surrounding tents/structures to identify if the tent is inhabited or not. Process for items stored when individual is present: • StaV work with the individuals to determine what they would like to have stored and confirm that it meets the storage requirements. If requirements are met, items are stored for up to 90 days in the storage container. The individual is provided with a list of items stored and information on how to contact the Unhoused Team to access retrieval of their personal items. • Individuals wishing to retrieve their items must connect with the Unhoused Team within 90 days of property removal and the Unhoused Team will coordinate a date, time and location to return the property. • Inventory not retrieved by the designated date will be documented and disposed of according to policy. Process for items stored when individual is not present: • StaV conduct a visual inspection of the encampment (tents, structures, and immediate surrounding area) to determine if there are any items that meet the criteria for storage. If items are found they are documented, photographed and transported to the storage container. • Information is posted at the clean-up site that states that items were removed and stored and how to contact the Unhoused Team to retrieve the items. • Individuals wishing to retrieve their items must connect with the Unhoused Team within 90 days of property removal and the Unhoused Team will coordinate a date, time and location to rretrieve the property. • Inventory not retrieved by the designated date will be documented and disposed of according to policy. 7. In addition, provide the SOP for how we work with our County and CBOs to serve members of this community. For example, what's the process for County services to visit our encampments, how often does County personnel come, what services do they provide, how do we handle intake information, how do we address needed meds, etc. The full list of services provided by the County and their contractors (for example Abode), frequency of visits and all applicable SOPs have been requested from the County. They currently don’t have the staV to respond immediately, but we are hopeful to get an estimate of the delivery date of this information tomorrow when the JPA contact returns from vacation. Services provided range from general outreach, intakes and needs assessments, behavioral health, and medical health. Many outreach services are also conducted by CBOs such as Vallejo Together and 4th Second which are overseen by the County or the City. They provide general outreach, food and supply distribution, and street medicine. These resources are outlined on our website and within the handout provided at time of posting of clean ups. This handout is attached for your information.

Intake for individuals is conducted through the coordinated entry system (Resource Connect Solano - RCS). CAP Solano JPA manages the HMIS system and has contracted this work to RCS for the intake and Pathways for management of the system. Service Providers and Operators that provide services and housing in Solano County and work with the coordinated entry system also have HMIS access to provide case notes and updates on the unhoused individuals they are working with. 8. Also, do we know the number of unhoused families with children? How do we coordinate with the school and County and CBO resources, and how do we track the unhoused families? This information is stored in the Homeless Management Information System (HMIS), which is managed through CAP Solano JPA by the Coordinated Entry System (CES), which for Vallejo is Resource Connect Solano (RCS). The school district may also have some of this information. StaV has met with the McKinney-Vento coordinator who is responsible for tracking unhoused youth to share resources and other partners they can connect with. 9. During the encampment sweeps, what company(s) is contracted to tow vehicles? What is the cost of contractor(s)? How many of those vehicles are recovered by the owner and average cost to the owner and how many never recovered, sold or destroyed? The City uses local tow companies to conduct the vehicle tows at clean-ups. The contracts will be sent separately, as they are too large to be sent in this email notification. The contracts are managed by the VPD TraVic Commander. The City does not pay per vehicle for encampments tows, and the cost for pick-up by the individuals is based on the length that the vehicle is stored and outlined in the contracts. The City does not track vehicles recovered by owner, sold or destroyed. However, the City has the ability request that information from the tow company, if needed. 10. What's the total cost of a sweep how many sweeps have taken place, private organizations and cost per department - number of personnel, types of vehicles, etc. Quantify each sweep as it relates to removal of people, vehicles, trash, pets, stored items, etc. See response to #3 above. StaV can work to gather additional information to provide a closer estimate on costs per location, but it will take some time as it will be a manual process amongst multiple departments. If Council would like staV to allocate time to gather additional details for the estimate, we will do so. There are currently no hard costs for stored items as the City already owns the Conex container that the items are stored in and the property it is stored on. If storage requirements change, additional storage units and containers may be needed. At which time the property develops, a new location will need to be identified for storage. Solano County SherriV’s Department assists with pets at encampment clean-ups. There have been very few times (only 1 that staV is aware of) where animals have been removed from clean-ups and brought to the Humane Society. 11. How long does an encampment exist before it's removal? The length of encampments timelines vary. There are many encampments that have been well established and in place for months to years. Encampments are prioritized based on several factors including American with Disabilities Act (ADA) concerns (i.e. blockage of sidewalks), environmentally sensitive areas (i.e. White Slough, areas around waterways etc.), youth locations (i.e.: schools, libraries, parks, etc.), residential neighborhoods, and places of business. Encampments posing ADA non-compliance are prioritized and can be cleared immediately (once reported and after confirmation of the ADA issue) to abate the issue. 12. What is the noticing period and how do we collaborate with the County, CBOs, and Faith-based community. Please attach the SOP and notices, communications, etc. for each listed sweep. Encampments are posted a minimum of 72 hours ahead of the clean-up, outside of emergency situations. StaV aims to post 5-7 days prior to clean-ups occurring to give additional time for individuals residing at the encampment to prepare. Posting requirements are outlined in Admin Rule 7.10 (attached). The City posts its clean-ups on our website (MyVallejo.com/homelessresources) and emails notification to CAP Solano JPA and the Vallejo Housing Authority. All postings are on the MyVallejo.com/homelessresources (copies of posting will be sent separately as it will be too large for this email response.)
