Felton was selected as the IHART provider after a competitive bidding process and community outreach. Felton’s response to City’s May 2023 Request for Proposals was ranked highest (of three proposals) by VPD staff and stakeholders based on a number of factors, including background and capacity, scope of services, and budget. VPD also hosted a community town hall in November 2023 to receive community feedback about the vendors to inform the selection process.

FISCAL IMPACT
The First Amendment’s $200,000 increase to Felton’s budget will be funded as follows: (a) May 2025 expenses (not to exceed $75,000) will be funded by available budget in Fund 151 (SLEF), and (b) June 2025 expenses (not to exceed $125,000) will be funded with a blend of Fund 151 (SLEF) funds and Opioid settlement funding.

VPD is also exploring additional funding options to sustain the IHART Program.

ENVIRONMENTAL REVIEW
This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project that has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378.

FROM: Dawn G. Abrahamson, City Clerk
SUBJECT: ADOPT A RESOLUTION CHANGING THE COMPOSITION OF THE STANDING PUBLIC SAFETY COMMITTEE FROM 2 TO 3 MEMBERS OF THE CITY COUNCIL AND MAKING

APPOINTMENTS THERETO

RECOMMENDATION
Adopt a resolution changing the composition of the Standing Public Safety Committee from 2 to 3 members of the City Council and making appointments

REASONS FOR RECOMMENDATION
Pursuant to Vallejo Municipal Code Section 2.03.350D, appointments to boards, commissions and committees shall be considered and acted upon by the City Council in open public meetings of the council, unless otherwise permitted by law. Pursuant to 2.02.350E, the Mayor is authorized to make appointments, with the consent of the City Council, to committees composed solely of councilmembers and to special ad hoc committees of limited duration of purpose.

BACKGROUND AND DISCUSSION
At its meeting on April 22, 2025, the Council considered appointing two members of the City Council to the standing Public Safety Committee. During discussion on the item, the Council indicated a desire to change the composition from 2 Councilmembers to 3 Councilmembers and directed staff to return with a resolution enacting that change at a future meeting.

Public Safety Council Committee
On December 20, 2011, the City Council, created a standing City Council Public Safety Committee consisting of 2 members. On January 31, 2012, the size of this standing committee was increased to 3 members with changes to the defined purpose and responsibilities of the Committee.

On February 28, 2012, the membership of this standing committee was reduced from 3 to 2 members and the specific objectives of the Committee were redefined. On April 3, 2012, the membership of this standing committee was reaffirmed to be comprised of 2 members of the CIty Council including redefining the purpose and responsibilities of the committee again as follows:

1. Receive referrals and make recommendations to the City Council regarding public safety issues within the City Council's discretion.

2. Receive public input regarding enhancement of public safety in the community from an Ad-Hoc Citizens Public Safety Advisory Committee. The Ad-Hoc Citizens Pubic Safety Advisory Committee was established April 3, 2012 as an advisory to the Council Public Safety Committee for a limited duration and was charged with 3 specific subject areas. In January of 2013, the ad-hoc committee completed its work with a final report to the City Council and was dissolved.

3. Review opportunities for public safety costs savings, revenue opportunities and enhanced technology to create a safer community.

Date: May 13, 2025

4. Review ongoing enhancements of public safety underway in the police and fire departments (i.e., implementation of Assessment Report items).

It is important to note that this standing committee is subject to the Brown Act and meetings shall be open to the public. In addition, the duties and responsibilities of this committee are as outlined immediately above, except for 2. Once the Committee holds it first meeting, it may return to the full Council with recommendations to redefine the purpose and responsibilities of this standing committee.

There is no fiscal impact in the filling of vacancies on standing committees

ACTION ITEM 9.D.

DATE: April 22, 2025
TO: Mayor and Members of the City Council
FROM: Dawn G. Abrahamson, City Clerk
SUBJECT: ADOPT A RESOLUTION APPOINTING TWO MEMBERS OF THE CITY COUNCIL TO

THE STANDING PUBLIC SAFETY COMMITTEE

RECOMMENDATION
Adopt a resolution appointing two members of the CIty Council to the standing Public Safety Committee

At its meeting on January 14, 2025, the Council adopted a resolution consenting to and approving various appointments to Commissions, Boards and Committees for 2025. At that meeting, the Council agreed to return at a future meeting date to revisit the public safety-related committees as well as several others left to be determined, including appointments relating to community based (nonprofit) organizations.

At its meeting on February 18, 2025, the Council considered community based (nonprofit) organizations, appointments to the Solano 360 Implementation Committee and the Green Empowerment Zone (GEZ) and several public safety related-committees including the Public Safety Committee and the Public Safety & Quality of Life Ad-hoc Subcommittee. At that meeting, there was Council consensus to return at a later meeting date for appointments to the Public Safety Committee and allow the Public Safety & Quality of Life Ad-hoc Subcommittee to sunset on its own, which will be November 28, 2025.

The Ad-Hoc Citizens Pubic Safety Advisory Committee

was established April 3, 2012 as an advisory to the Council Public Safety Committee for a limited duration and was charged with 3 specific subject areas. In January of 2013, the ad-hoc committee completed its work with a final report to the City Council and was dissolved.

3. Review opportunities for public safety costs savings, revenue opportunities and enhanced technology to create a safer community.

4. Review ongoing enhancements of public safety underway in the police and fire departments (i.e., implementation of Assessment Report items).

It is important to note that this standing committee is subject to the Brown Act and meetings shall be open to the public. In addition, the duties and responsibilities of this 2-member committee are as outlined immediately above, except for 3. If the Council wishes to change the duties and responsibilities of this standing committee or the composition of the committee, it will need to provide direction to staff at the meeting and a subsequent item to take that action will be scheduled at a later meeting date, which could also include appointments at that meeting date.

If the Council chooses to proceed with appointing 2 members of the Council tonight, staff recommends adoption of the resolution set forth in Attachment 1 to this staff report.

FISCAL IMPACT
There is no fiscal impact in the filling of vacancies on standing committees

ACTION ITEM 9.I.

DATE: May 13, 2025
TO: Mayor and Members of the City Council
FROM: Stephanie Sifuentes, Human Resources Director
SUBJECT: PRESENTATION OF PROPOSED WHISTLEBLOWER POLICY AND POSSIBLE

FEEDBACK

RECOMMENDATION
Review proposed Whistleblower Policy and provide feedback.

REASONS FOR RECOMMENDATION
While the state provides protections for whistleblowers, having a personnel policy that speaks to these protections provides more direct awareness to our employees.

BACKGROUND AND DISCUSSION
The State of California provides protections for employees who have reasonable cause to believe that they have witnessed a violation of a state or federal law, or a violation of, or noncompliance with, a local, state, or federal rule or regulation under their Whistleblower Protection Law (Lab. Code Section 1102.5). State law makes these whistleblower protections applicable to employees of charter cities or counties as well (Lab.

Code Section 1106, 53296(a)).

The Human Resources Department is working to update and modernize personnel policies ("administrative rules"). To that end, HR has utilized its membership in the Liebert Cassidy Whitmore NorCal Employee Relations Consortium to obtain model personnel policies which have been pre-vetted by their experienced team of employment law attorneys. The Whistleblower Policy before you this evening is one of those model personnel policies. While the state already provides these protections for employees, having a personnel policy that speaks to these protections provides more direct awareness to our employees.

The City of Vallejo Municipal Code delegates the authority to create, implement, and revise administrative rules to the City Manager. This policy is coming before Council for general awareness of the components of the policy, including procedures for reporting and retaliation complaints, as well as any feedback.

FISCAL IMPACT
No fiscal impact.

ENVIRONMENTAL REVIEW
This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378.

208.5 Reporting Procedure
When an applicant, employee, or temporary/seasonal/extra help employee has reasonable cause to believe they have witnessed a violation of federal or state law, or a violation of or City of Vallejo Personnel Policy Manual
Established:

Revised:
noncompliance with a local, state, or federal rule or regulation, they can notify the City in a number of ways:
•Utilizing the anonymous STOPIt reporting tool (see Attachment A) •Reporting the incident to their supervisor
•Notifying the Human Resources Director or their designee 208.6 Retaliation Complaint Procedure
An applicant, employee, or temporary/seasonal/extra help employee who feels they have been retaliated against in violation of this policy should immediately report the conduct according to the complaint procedure in the City’s policy against discrimination, harassment or retaliation so that the complaint can be resolved fairly and quickly. Supervisors and managers have the same responsibilities as defined in the policy against discrimination, harassment or retaliation.iv
i Whistleblower Protection Law: This policy reflects the protections provided in California’s whistleblower protection law. (Lab. Code § 1102.5.) AB 1509 (enacted in 2015; effective January 1, 2016) amended California law so as to also prohibit an agency from retaliating against an employee because their family member is perceived to have engaged in any of the protected activity described above. (Lab. Code § 1102.5(h).) The law does not define “family member.”
ii Applicability to Charter Cities and Counties: State law makes these whistle blower protections applicable to employees of charter cities or counties. (Lab. Code §§ 1106, 53296(a).) This policy covers applicants for employment because Government Code section 53297, subdivision (a) expressly identifies applicants. In addition, applicants are implicitly protected by Labor Code section 1102.5, subdivision (d), which prohibits agencies from retaliating against an “employee for having exercised his or her rights” to disclose alleged violations of law “in any former employment.” (Lab. Code § 1102.5(d).) iii Scope of Protection for Individuals: Labor Code section 1102.5 protects not only employees who report a violation of federal or state law, or a violation or noncompliance with a federal, state or local rule or regulation, but also employees that the employer believes will make such a complaint. iv Purpose of Whistleblower Protection Policy: Labor Code section 1102.5 and Government Code sections 53296 through 53299 prohibit public agencies from retaliating against actual or perceived whistleblowers.

Moreover, several federal and state laws, such as the Patient Protection and Affordable Care Act (“ACA”), and the state paid sick leave laws, prohibit retaliation against employees when employees use the benefits these laws provide or protest what they perceive to be violations of those laws. (29 U.S.C. § 218C; Lab. Code § 234; Gov.

Code §§ 53296-53299.)

ACTION ITEM 9.J.

DATE: May 13, 2025
TO: Mayor and Members of the City Council
FROM: Naveed Ashraf, Chief Innovation Officer & IT Director SUBJECT: NOTICE OF INTENT TO AMEND THE BUDGET ACCEPTING THE LAST MILE FEDERAL

FUNDING ACCOUNT GRANT AWARDED TO THE CITY OF VALLEJO IN THE AMOUNT OF $3,806,104 TO INSTALL THE LAST MILE BROADBAND CONNECTIVITY FOR THE

MARE ISLAND BUILD, NORTH SONOMA BLVD, PORTER STREET TO SEAPORT, AND TRAILER CITY PARK (STEP 1 OF 2).

RECOMMENDATION
Notice of Intent to amend the FY 24-25 budget and accept the California Public Utilities (CPUC) Federal Funding Account Last Mile grant (Step 1 of 2).

REASONS FOR RECOMMENDATION
Accept the grant awarded to the City of Vallejo in the amount of $3806,104 from the California Public Utility Commission (CPUC) Last Mile Federal Funding Account. More information below in background and discussion section of the staff report.

BACKGROUND AND DISCUSSION
The California Public Utilities Commission (CPUC) established the Last Mile Federal Funding Account as part of the state's comprehensive strategy to bridge the digital divide and ensure equitable access to high-speed internet across California. This initiative was formalized through Senate Bill 156 (SB 156), signed into law in July 2021 by Governor Gavin Newsom. SB 156 allocated a historic $6 billion to accelerate broadband infrastructure development, with $2 billion designated specifically for the Last Mile Federal Funding Account.

The Last Mile Federal Funding Account is administered by the CPUC under its California Advanced Services Fund (CASF) program. The fund is designed to support the deployment of last-mile broadband infrastructure to connect un-served and underserved communities throughout the state. The program prioritizes areas lacking access to broadband speeds of at least 100 MBPS download and 20 MBPS upload.

This strategic investment underscores California's commitment to fostering digital equity and supporting economic development through enhanced connectivity. The City of Vallejo's successful application for a $3.806,104 grant from this fund exemplifies the state's dedication to empowering local communities and ensuring that all Californians have access to the digital resources essential for education, employment, and civic participation.

Grant Details
The City of Vallejo's application was received on September 29, 2023, and subsequently posted on the Commission’s Last Mile Federal Funding Account web page. CPUC staff reviewed the application for compliance with Commission and federal rules, conducted fiscal and technical analysis, and determined that it met the requirements for a grant under the program. On November 7, 2024, Commissioners considered Vallejo's application and voted to approve Vallejo's grant award in CPUC Resolution T-17853.

The ultimate performance period under this grant award is five years from the date the grant funds are made

Vallejo's Project
For Vallejo, this grant represents a pivotal step in the ongoing efforts to enhance connectivity and digital equity within the city. The awarded funds will support four major broadband infrastructure projects:

1. Mare Island Build: Expanding high-speed internet access to support the growing business community on Mare Island.

2. North Sonoma Boulevard Expansion: Improving connectivity for residents and small businesses along North Sonoma Boulevard, facilitating better access to essential services and opportunities.

3. Porter Street to Seaport Connectivity: Enhancing broadband infrastructure to support local businesses and economic development in the Porter Street to Seaport corridor.

4. Trailer City Park Initiative: Providing reliable internet access to residents of Trailer City Park, one of Vallejo's most underserved areas, thereby improving access to education, healthcare, and employment resources.

These broadband infrastructure projects represent a strategic advancement of the City’s Broadband and Digital Equity Strategy, which seeks to ensure that all Vallejo residents can access reliable, high-speed, and affordable internet. By focusing on underserved areas, these efforts aim to reduce longstanding gaps in connectivity and create a more equitable digital landscape across the city.

The partnership between the City of Vallejo, Smart Fiber Networks, and Vallejo's grant administration team has been a key driver in securing funding and shaping the implementation of these projects. The combined efforts reflect a shared commitment to delivering practical, scalable solutions that meet the community’s current and future connectivity needs.

As the City moves forward, these projects will support broader goals—increasing digital access, strengthening the local economy, and improving access to education, health services, and job opportunities. Together, these investments lay the groundwork for a stronger, more connected Vallejo.

Next Steps
This City Council action is Step 1 of the 2-step process. In the subsequent City Council meeting on May 27th, 2025, step 2 will be brought forth before the City Council with a recommendation to award the contract to the City's P3 (private-public-partner), Smart Fiber Networks Inc.

FISCAL IMPACT
There is no fiscal impact on the general fund. The funding for this project is a grant from CPUC, California Public Utility Commission Last Mile Federal Funding Account.
