SUBJECT: ADVANCE ITEM – Residential and Mixed-Use Overlay Development Code and M-X-D (Mixed Use Zone) Zoning Text Amendment
SUMMARY
On January 31, 2022, the City Council adopted the 2021 -2029 Housing Element. The Housing Element requires the rezoning of eight properties to ensure the City can meet its required Regional Housing Needs Assessment (RHNA) allocation. There were several new housing sites that were identified in the Housing Element, one on Telegraph Road and seven on Johnson Drive. These sites are required to be rezoned to allow housing and the density and capacity identified in the Housing Element.
As part of that rezoning effort, text amendments to the Zoning Ordinance are necessary to amend the M-X-D (Mixed Use Zone) and create new form -based code overlay. The City’s current zoning districts, outside of the form -based code Specific Plan areas such as the Downtown Specific P lan or Midtown Corridor Plan, have limited development regulations and do not include sufficient design standards to ensure that buildings will be high quality and well -designed. The Form -Based Code Overlays were developed to be placed on these sites to pr ovide objective design standards to achieve the community’s design goals.
The attached Zoning Text Amendments amend the Mixed-Use Zone and creates a new Residential and Mixed -Use Overlay Development Code for these rezoned properties.
These Zoning Text Amendments will be presented to the City Council on July 10, 2023, in conjunction with applications to rezone the subject properties , and are being provided in advance of the hearing to allow time for the Council and community to review the documents.
