Carahsoft End User License Agreement-SecureWorks
Recommendation
A. Approve and authorize issuance of a Purchase Contract with Carahsoft, for a one-year term for an amount not-to-exceed $81,056.78, and authorize the City Administrator to execute the related End User Agreement with Secureworks, in substantially the same for as submitted, for managed network security services; and
B. Approve additional funds with Carahsoft in the amount of $50,000 for additional purchases that may be necessary from this vendor during the 2024-2025 fiscal year.
Background
The Information Technology (IT) Department is requesting the approval of Managed Network Security Services from SecureWorks for a one-year term. The agreement is for the service that will be used to monitor the City’s network for any Cyber Security threats. The service will provide 24x7 security operations center support and network monitoring. SecureWorks uses advanced data analytics and security insights via their Counter Threat Platform to provide complete network coverage, vulnerability management, monitoring, and analysis.
Secureworks offers government pricing through Government Contract No. AR2472 Participating Addendum No. 7-17-70-40-05 with the National Association of State Procurement Officials (NASPO). The proposed agreement with SecureWorks is exempt from competitive bidding in accordance with Vernon Municipal Code (VMC) Section 3.32.110 (A)(5)(b), which provides an exemption “for services that can be purchased in cooperation with other public agencies, associations or when supplies, equipment or services can be purchased from a vendor offering the same prices, terms, and conditions as in a previous award from the City or another public agency either by competitive bid or through a negotiated process. Pursuant to this Section of the VMC, the City’s Financial Services Administrator is of the opinion that it is to the City’s advantage to procure the desired services from SecureWorks through the NASPO government contract.
Additionally, pursuant to VMC Section 3.32.030(B), City Council approval is required if, in the 12 months preceding the effective date of the proposed new, renewed, or otherwise amended contract, the City has paid or awarded the proposed vendor more than $100,000 pursuant to contract(s) with the vendor. Within the past 12 months the City has paid Carahsoft approximately $101,613.57. Carahsoft is a reseller of various software products and solutions for state and local governments and can often provide government pricing and/or pricing that is competitive.
Accordingly, staff is requesting approval of $50,000 in funds to be utilized on this vendor as it is highly likely that IT may need to make future purchases from Carahsoft. Any purchases made in this manner would be procured in compliance with the City’s established purchasing processes.
The proposed End User License Agreement has been reviewed and approved as to form by the City Attorney’s office.
Fiscal Impact
The total fiscal impact is not-to-exceed $131,056.78. Sufficient funds are available in General Fund, IT Department, Professional Services – IT Account No. 011-010-110-529210 for the $81,056.78 to be spent on the Secureworks agreement and Repairs and Maintenance – IT Account No. 011-010-110-529210 for the $50,000 for additional purchases in the current fiscal year.
