Third Amendment to the Memorandum of Understanding (MOU) with the Los Angeles Gateway Region Integrated Regional Water Management Joint Powers Authority (GWMA) Recommendation
Approve and authorize the City Administrator to execute the Third Amendment to the MOU with GWMA, in substantially the same form as submitted, to update and continue implementing the Watershed Management Program (WMP) and Coordinated Integrated Monitoring Program (CIMP) for a total amount not-to-exceed $170,000 for a 3-year term.
Background
On April 16, 2013, the Vernon City Council authorized staff to participate in the WMP and CIMP Plans in cooperation with the Los Angeles County Flood Control District (LACFCD) and neighboring Watershed Permittees: City of Bell, Bell Gardens, Commerce, Cudahy, Huntington Park, Maywood, Vernon, cooperatively known as the Los Angeles River Upper Reach 2 Watershed Management Area Cities (LAR UR2 WMA Cities).
On June 4, 2013, the Vernon City Council approved the MOU with GWMA for the administration and cost-sharing to prepare the WMP and CIMP Plans as required by the Regional Water Quality Control Board, Los Angeles Region (RWQCB), National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Permit.
On December 9, 2014, the Vernon City Council approved the First Amendment to the MOU to add the implementation of the WMP and CIMP Plans to the scope and purpose of the MOU and to provide a separate cost-share formula for the implementation of the Plans. The First Amendment to the MOU expired on December 31, 2019.
The City Council approved the Second Amendment to the MOU on December 3, 2019, extending the terms to December 31, 2024, to continue implementing the WMP and CIMP Plans.
The proposed Third Amendment will further extend the terms of the MOU through December 31, 2027 to continue the implementation of the WMP and CIMP Plans. The Third Amendment also includes the following:
• Revised cost-sharing formulas for GWMA members and non-members o Fiscal Year 2024-2025 cost share fee is $55,027.12 (Attachment 2) • New procedures for invoicing, payments, and delinquency fees • Updated budget processes and expenditure authorization • Reference to the MS4 Permit to be updated to reflect the latest version The Third Amendment to the MOU has been reviewed and approved as to form by the City Attorney’s Office.
Fiscal Impact
The fiscal impact is estimated at $170,000. Sufficient funds are available in the General Fund, Health Department, Professional Services Technical Account No. 011-020-200-529225 for the current fiscal year and will be budgeted in subsequent fiscal years.
