Subject: Hearing Panel Certification Maintenance Requirements for the City of Vernon Solid Waste Local Enforcement Agency (LEA)
Dear Mr. Agyin,
In reviewing the LEA hearing panel information in the SWIS database, one of the Government representative positions of the City of Vernon hearing panel will expire in six (6) months on April 1, 2025. Please ensure this appointment is communicated to CalRecycle in a timely manner to avoid a lapse in certification maintenance requirements pursuant to Title 14, California Code of Regulations (CCR) Section 18081.
In recognition of the difficulty of maintaining hearing panel appointments, a statutory change to the Public Resource Code (PRC) in 2004 allows for a hearing officer, which does not require terms or term limits. More information is available online on CalRecycle's Hearing Officer webpaye. The governing body can appoint a hearing officer once procedures and qualifications are adopted pursuant to PRC 44308(d). It is highly advisable that CalRecycle review and comment on the procedures and qualifications before adoption by the local governing body.
Be aware that adequate planning is necessary to update the hearing panel or switch to a hearing officer. The expiration of hearing panel appointments can jeopardize LEA certification. Please provide the LEA Evaluation staff with a timeline for appointment of the hearing panel members or hearing officer with supporting recruitment documentation from the Clerk of the Board of Supervisors for placement in the Enforcement Program Plan until the appointment is complete. 1001 I Street, Sacramento, CA 95814 ~ P.O.
