Subject:
Amendment 5 to the Construction Agreement with Cal-Stripe, Inc. for Airfield Painting, Rubber Removal, and Paint Removal, Project #CC19-035-2
Recommendation:
That the Honorable Southern California Logistics Airport Authority Board of Directors:
1) Approve Amendment 5 to the Construction Agreement (“Amendment 5”) by and between the Southern California Logistics Airport Authority and Cal-Stripe, Inc. in the amount not to exceed $190,000, in support of the Airfield Painting, Rubber Removal, and Paint Removal Project #CC19-035-2; and
2) Adopt Resolution No. SCLAA 22-003 for an additional appropriation in the amount of $140,000.
Fiscal Impact:
Funds of $50,000 have been appropriated in the 450 Fund for this expenditure. Due to an unexpected increase in the volume of work required, an additional appropriation is required to fund this expenditure. Resolution No. SCLAA 22-003 is presented herein for the purpose of requesting an additional appropriation of $140,000. Cash reserves are sufficient to support the requested additional appropriation. The suggested budget adjustment is outlined in the table below.

0 Background:
The Southern California Logistics Airport Authority (“SCLAA”) operates the Southern California Logistics Airport (“SCLA”) under certain federal regulatory mandates, including those pertaining to airfield pavement, markings, and surface condition. Federal Aviation Administration (“FAA”) offers guidance regarding Federal Aviation Regulation Part 139 in the form of Advisory Circulars. FAA Advisory Circular 150/5340-1M states that airfield paint markings must provide an accurate reference to the airport user; meaning that the paint markings on the pavement must be clearly visible and offer accurate navigational guidance. Over time, paint markings require repainting due to fading and/or wear from aircraft, vehicle, and equipment traffic. FAA Advisory Circular 150/5320-12D offers specific details for regulatory compliance about the accumulation of contaminants and friction deterioration on and of runway pavement. “Contaminants” being any foreign matter on the pavement, which includes the buildup of aircraft tire rubber. As the rubber buildup accumulates, it decreases the traction between the affected pavement and aircraft tires, referred to as “friction deterioration” in the above referenced advisory circular. Regular maintenance of the pavement surfaces and paint markings are required to ensure the safe use of the airfield pavements and compliance with federal regulatory mandates.
The Southern California Logistics Airport (“SCLA”) airfield includes approximately 20 square miles of paved runways and taxiways, adorned with painted markings that offer navigation guidance to the various users. Regular maintenance of the pavement surfaces and markings is performed in accordance with Federal Regulation Part 139 and includes both rubber removal and repainting of faded or damaged paint markings. Because of the scale of the pavement and paint markings, and special skill and equipment required for the task, contractors supply the labor, equipment, and materials required for periodic maintenance of the pavement surfaces and paint markings.
Discussion:
On August 2, 2018, staff performed a competitive bid solicitation in accordance with City of Victorville Municipal Code §2.28.200 to obtain qualified contractors specific to the task of airfield painting, rubber removal, and paint removal. Staff posted the solicitation on the City of Victorville website, ebidboard.com, and directly solicited nineteen contractors.
Three bid proposals were received as a result of this procurement action. Staff evaluated and ranked the bid proposals based on experience, response time, and primarily, price.
The resulting bid proposal rankings are listed below:
Contractor Location Rank
Cal-Stripe, Inc. Colton, Ca. 1
PCI Azusa, Ca. 2
Sterndahl Enterprises, Inc. Sun Valley, Ca. 3
Following the evaluation and ranking of all bid proposals, staff selected Cal-Stripe, Inc. (“Cal-Stripe”) and PCI as qualified contractors. In accordance with City of Victorville 5 7
0 Municipal Code §2.28.200, each was awarded a construction agreement with a not-to- exceed compensation of $25,000. Cal-Stripe ranks highest of the two qualified contractors; therefore, they are called upon first when painting and rubber removal are required. Should Cal-Stripe be non-responsive or unable to provide the services within the time required, staff would then contact PCI to perform the work. These agreements ensure that qualified contractors are available when the associated services are required.
The Term of each agreement was for one year, July 1, 2018 through June 30, 2019 with four optional 1-year renewal periods. Subsequently, both agreements have been amended annually to extend the terms to expire on June 30, 2022 and increase the compensation to the current not-to-exceed amounts of $50,000 each.
This fiscal year, the FAA has identified a higher than normal quantity of paint markings for repainting. Painting and rubber removal work required for the current fiscal year is estimated at about $165,000. Amendment 5 to the Construction Agreement with Cal- Stripe proposes to increase the not-to-exceed compensation from $50,000 to $190,000 to accommodate the additional work and allow for additional on-call services through the remainder of the fiscal year.
Amendment 5 presented herein complies with City of Victorville Municipal Code §2.28.180(b) which defines the change order requirements for public works projects and facilitates compliance with Federal Aviation Regulation Part 139. For these reasons, staff recommends that Your Honorable Southern California Logistics Authority Board of Directors approve Amendment 5 to the Construction Agreement with Cal-Stripe for Airfield Painting, Rubber Removal, and Paint Removal, Project CC19-035-2 in the amount not-to-exceed $190,000, and Adopt Resolution No. SCLAA 22-003 for an additional appropriation in the amount of $140,000.
Staff remains available for any questions or comments you may have.

Meeting of: February 1, 2022
Submitted By:
Jeff Armstrong, Fire Chief
Subject:
Award of Contract to Air Exchange, Inc. for Plymovent Vehicle Exhaust Extraction System.
Recommendation:
That Your Honorable City Council: (1) Approve the award of contract to Air Exchange, Inc., in the amount not to exceed $277,376.14 for project CCT22-072.
Fiscal Impact:
Acceptance of a Federal grant at a previous Council meeting on August 17 th, 2021, increased the revenue in the 2020 AFG Revenue fund (275508S-43120-20237) by $252,160.13. Award of contract to Air Exchange, Inc. will increase the expenditure appropriation in the 2020 AFG Equipment fund (2754508S-55040-20237) by $252,160.13. The ten percent (10%) or $25,216.01 of federal funds, required by the grant, have been budgeted in the General Fund Fire Capital Equipment AFG Match (1002010-55040-20237) per Resolution No. 21-090. No additional appropriation is required to this account.
Background:
The Victorville Fire Department, in searching avenues to fund the replacement, upgrade and/or repair of current vehicle exhaust removal systems throughout all six (6) Victorville fire stations, applied for the Fiscal Year 2020 Assistance to Firefighters Grant (FY2020 AFG), a grant through the Department of Homeland Security.
The Fiscal Year 2020 Assistance to Firefighters Grant (AFG) Program is one of three grant programs that constitute the Department of Homeland Security (DHS), Federal Emergency Management Agency’s (FEMA’s) focus on enhancing the safety of the public and firefighters with respect to fire and fire-related hazards. The AFG Program accomplishes this by providing financial assistance directly to eligible fire departments, nonaffiliated emergency medical service (EMS) organizations, and State Fire Training 2 3
3 1
Academies (SFTAs) for critical training and equipment. The AFG Program represents one part of a comprehensive set of measures authorized by Congress and implemented by DHS.
After submission of the grant application, an Award letter was received approving the funding opportunity in the amount of $252,160.13 requiring a ten percent (10%) match in the amount of $25,216.01. The replacement, upgrade and/or repair of current vehicle exhaust removal systems Further, on August 17, 2021, staff recommended approval of the acceptance of the FY2020 AFG grant, adoption of Resolution 21-090 approving additional revenue and expenditure appropriations in the Federal Grants fund and authorization of budget transfer for matching funds. Council approved same.
Discussion:
Hazardous vehicle exhaust emissions in a fire station are a health risk to Victorville firefighters. The U.S. Department of Labor, Occupational Safety and Health Administration (OSHA) states, “Workers exposed to diesel exhaust face the risk of adverse health effects ranging from headaches to nausea to cancer and respiratory disease.” A report entitled “Carcinogenic Effects of Exposure to Diesel Exhaust,” prepared by U.S. Department of Health and Human Services, National Institute for Occupation Safety and Health (NIOSH), states that, “human and animal studies show that diesel exhaust should be treated as a human carcinogen (cancer-causing substance).” Eliminating this hazard from our fire stations with code compliant vehicle exhaust capture and removal systems is of the utmost importance. Currently, all six (6) stations are equipped with outdated exhaust extraction systems that range from 10 to 19 years old and have required costly repairs over the past few years. Due to the age of the systems, it has been difficult to get parts in a timely manner. Some vendors offer used parts due to lack of availability. Air Exchange Inc. is the exclusive dealer and is the sole source of Plymovent vehicle exhaust extractions systems for most areas in California. Therefore, they are the most qualified for the replacement, upgrade and/or repair of current vehicle exhaust removal systems and they have a local vendor in Ontario where parts are readily available.
Staff is recommending approval of award of contract to Air Exchange, Inc., for project CCT22-072, for a total not to exceed $277,376.14. Staff remains available for any questions or comments you may have.

PREVAILING WAGE PROVISIONS
1. State Wages - In accordance with the provisions of California Labor Code Sections (1720,1770-1776, 1810, 1813 and 1815, as amended and applicable) , the State Director of Industrial Relations has determined the general prevailing rates of per diem wages in the locality where the Project is to be done. Copies of the updated Wage Determination rates are available from the CITY and the State of California via the internet at www.dir.ca.gov. Additionally, copies of the prevailing rate of per diem wages and federal wage decision rates are on file at the City of Victorville Finance Department and shall be made available for review to any interested party on request. Notwithstanding anything in the Contract Documents to the contrary, Contractor and all subcontractors shall pay not less than said specified State of California rates to all workers employed by them in the execution of the work contemplated by this Contract. Contractor shall be responsible for using the correct and current prevailing wage rates.
2. A
B219 (as applicable) adds Section 1720.9 to the Labor Code, the hauling and delivery of ready-mixed concrete to carry out a public works contract, with respect to contracts involving state agency or any political subdivision of the state. Section 1720.9 defines the term “ready-mixed” concrete and specifies that the rate of pay shall be the current prevailing wage “for the geographical area in which the factory or batching plant is located” as determined by the DIR. The statute also requires a written agreement between the party hauling or delivering the ready-mixed concrete and the party that engaged its services. Nothing in Section 1720.9 shall cause any company to be treated as a contractor or subcontractor for any purpose other than the application of this chapter of the Labor Code.
3. The del
ivery company shall provide certified payroll records under Labor Code section 1776(a) to the party that engaged its services and to the general contractor within five working days after the employee has been paid, accompanied by a written time record within five working days after the employee has been paid, accompanied by a written time record. The time record must be certified by each driver for the performance of job duties.
4. C
ontractor shall be solely responsible for using the correct wage decision or determination and performing accordingly. An error on the part of any awarding body does not relieve the Contractor from the responsibility for payment of the correct State prevailing wage and compliance with the maintenance and inspection of payroll records, posting of prevailing wage rates at work site, employment of apprentices, and other requirements of California Labor Code Section 1720, et seq.; California Code of Regulations, Title 8, Section 16000 et seq .; and all other applicable State labor laws. Contractor further acknowledges and agrees that it will be independently responsible for reviewing the applicable laws and regulations and effectuating compliance with those laws. Contractor will require the same of all its subcontractors.
5. C
ontractor shall provide completed WEEKLY CERTIFIED PAYROLL with each invoice presented to the CITY, substantially in the form and containing the information set forth on the sample Weekly Certified Payroll.
29 General Services Provider Standard Agreement/Air Exchange, Inc./Project CCT22-076 NOTE: This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR). Confirmation of certified payroll submittal to the Department of Industrial Relations (DIR) is required with each invoice to the City. Payment of the invoice may be delayed when proof of certified payroll submittal is not included with the Contractor’s invoice.

Written Communication
Meeting of: February 1, 2022
Submitted By:
John Wickum, Captain
Subject:
Body Worn Cameras
Recommendation:
This item is informational only.
Fiscal Impact:
There is no fiscal impact associated with this item.
Background:
In 2017, the San Bernardino County Sheriff’s Department (SBCSD) deployed a successful yearlong Body Worn Camera (BWC) pilot program at our Apple Valley and Highland stations. Although the program was a success and well received by the deputies utilizing the cameras, factors such as cost, storage needs, infrastructure and the sheer size of the county geographically hindered a department wide deployment.
Fortunately, in June of 2021 the County Board of Supervisors approved $5.2 million in funds to establish a body worn camera solution for the SBCSD. A Body Worn Camera Committee selected and began working on the project. In July of 2021, the department released a Request for Information (RFI) and by August had received eight (8) responses from various BWC vendors. Those vendors were Axon, Digital Ally, GETAC, Lenslock, Motorola, Safe Fleet and Utility Associates. In September 2021, the department concluded the RFI portion of the project, with the eight (8) vendors providing a demo of their BWC product.
Discussion:
On December 7, 2021, the Victorville City Council requested an update regarding the implementation of body worn cameras for deputies. With funding for the body worn cameras secured, the department is evaluating internet service providers and wireless data coverage areas across the County’s geography in preparation for the BWC 2 4
0 9
deployment. We are working to realize a viable network solution to consistently provide reliable connectivity to body worn devices while capturing events in real time or uploading from a station or patrol vehicle. At present, a wide area network diverse core implementation to directly interconnect all Sheriff’s facilities is the frontrunning solution being architected. The implementation will specifically address the geographic challenges as well as large video consumption rates, whether the chosen vendor provides an on premises or Cloud solution. The Sheriff’s Department is entering the Request for Proposal (RFP) phase of our Body Worn Camera (BWC) Project Implementation. We expect the RFP process to be in full swing by February and a decision should being made shortly after the RFP process is complete.
