2.28.050(4), such contracts should only be awarded to firms or persons who have demonstrated an adequate level of experience, competence, staffing and other professional qualifications necessary for above satisfactory performance of the services required. Once the department requesting the service has determined that a firm has an adequate level of competence, the cost of the service may be considered, however, the lowest co st may not be the sole factor in deciding which firm or who shall be awarded the contract. It may be in the city's best interest to award the contract to a firm based on the scope of services available, unique skills, staffing levels, timing, prior experie nce, past working relationship or other factors required by the requesting department or proposed by that firm, and as such factors are set forth in the city's purchasing policies and guidelines. The information needed to determine that level of competence , other qualification's and the procedure for selecting such services shall be determined by the department requesting the service.
(b) Request for proposal/qualification. The acquiring of professional services shall be procured through Negotiated Contrac t and may include requests for proposals/qualifications. Contracting for professional services is centralized through the purchasing division unless prior approval to decentralize is given by the city manager. Decentralized contracting for professional ser vices shall be the responsibility of the department head requesting the service. The city manager may be contacted to assist in the formal request for proposal/qualification ("RFP/Q") process.
(c) Contracts—Informal process. The department head may recomm end professional service or consulting contracts with qualified consultants/firms on file with the city. The requesting department is required to contact a minimum of three consultants/firms, unless the city manager authorized the entering into or the award of a specific service contract. The department head shall recommend to the city manager the firm or person to be awarded the contract before awarding any professional service contract. Written justification shall be provided by the department head setting forth the reasons for recommending such firm or person awarded the contract. Professional service contracts should be on the city's standard form and shall be reviewed and approved as to form by the office of the city attorney. (d) Contracts—Formal RFP/ Q solicitation process. As an alternative to the procedures described in subsection (c) of this section, departments may utilize a sealed request for proposal process, administered by the city manager and subject to the following requirements:
(1) RFP/Q solicitation process. The city shall adopt a resolution describing the procedures for the formal RFP/Q solicitation process.
(2) Advertisement. The city manager shall advertise in appropriate publications and/or use the professional services listings, as a vailable, during the solicitation process. (3) Fourteen-day notice. Notice inviting RFP/Q's should be advertised at least fourteen calendar days before the due date of submission of the RFP/Q.
(4) Notice contents. The notice shall, at a minimum, describe the general type of service needed, how the RFP/Q minimum scope of work can be obtained, the requirement of a written sealed proposal, and state the closing date, place, and time for submission of the RFP/Q. (5) Solicitation procedure. Sealed request for proposals/qualifications should be submitted to the city manager. RFP/Q's need not be opened publicly. All proposals shall be analyzed by the city manager and the requesting department for compliance with RFP/Q requirements, value of total scope of servic es and a recommendation made to city council for selection, or for follow up interviews of those submitting a proposal.

Subject:
2022 CPRS Statewide Training and Funding Initiative, Brentwood Park Playground Replacement
Recommendation:

That the Honorable City Council award the purchase and installation of playground equipment to GameTime for the replacement of the playground at Brentwood Park.

Fiscal Impact:

The Brentwood Park play structure replacement is part of the City's scope of work approved under the Prop 68: Per Capita grant for Brentwood Park. The City was awarded $255,293.00 to complete select improvements at the park and Council accepted the grant funds at the regular meeting held on April 5, 2022. The estimated net cost to purchase and install the playground equipment is $157,682.08. No additional appropriation is required. Sufficient funds are available for this purchase in the following account:
•2706050 – 55070 – 81011 – Improvements not Buildings
No funding will be remitted to the City for the 2022 CPRS Statewide Training and Funding Initiative. Instead, a discount will be applied to the transaction as a fifty percent (50%) discount to the play structure, or $54,530.00 (see Attachment D). However, it will be necessary for the City to capitalize this asset at its full value, inclusive of the discount offered through the grant, which is currently estimated at $212,212.08.

Strategic Action Plan:

The City of Victorville Strategic Plan 2020-2023 identifies multi-year strategic goals and various strategies to work toward achieving those goals. Goal E, Invest in Infrastructure, focuses on creating a healthy and livable community by maintaining the City’s assets through investment in infrastructure and innovations. In accordance with one strategy 2 8
8 1
outlined within the plan, Council adopted the Parks and Recreation Master Plan on December 15, 2020, and staff have been working to implement recommendations therein.

This project will allow the City to address deferred maintenance at Brentwood Park, which aligns with the location-specific considerations outlined in the Park and Recreation Master Plan (Attachment A).

Background:

In April 2022, Council accepted Prop 68: Per Capita grant funds in the amount of $255,293.00 to replace the playground and shade structure at Brentwood Park.

In June 2022, staff became aware of a new grant opportunity with GameTime. Staff previously worked with GameTime on other matching fund grant projects, the most recent being the replacement of the playground structure at Eagle Ranch Park. Brentwood Park was one of three playgrounds identified as a good fit for this grant opportunity as it would reduce the cost of the base play structure, allowing the City’s to maximize use of the Prop. 68 grant funding awarded by the state. The play structure was installed in the early 1990s an currently has sand as the ground cover, which is not considered an ADA-compliant play surface.

Discussion:

In July 2022, staff applied for a matching funds grant known as the 2022 CPRS Statewide Training and Funding Initiative. The grant was developed between the California Park and Recreation Society (CPRS) and GameTime to support National Demonstration Sites across California to create outdoor play and recreation spaces that align with evidence- based best practices.

Staff was notified on September 16, 2022, that the Brentwood Park playground replacement was selected to receive funding through the initiative (Attachment B). Under the proposed playground design (Attachment C), there will be a fifty percent (50%) discount on the cost of the play structure (not including unattached features) in the amount of $54,530.00 to be covered by the funding initiative. The remaining balance of the play structure, the cost of the unattached features, installation, tax and freight (currently estimated at $157,682.08) will be covered by Prop 68 grant funding.

Consistent with the terms of the grant, the playground design proposed under the grant application was created in conjunction with Great Western, the designated sales representative for GameTime in Southern California. The design is based on best practices aimed at promoting physical fitness through outdoor play environments and creative playground learning activities. It incorporates multiple play activities with inclusive features with developmental benefits, such as adaptable and multi-user swings, merry- go-round and sensory areas. It also incorporates shade structures, which residents commonly request. Additionally, this project will expand the playground's footprint, allowing for the addition of swings and a merry-go-round. 2 8
8 1
GameTime will complete the installation associated with this award using a subcontractor.

This arrangement is permitted under section 2.28.120 of the Victorville Municipal Code based on the City’s participation in the Omnia Partners cooperative purchasing agreement. Omnia Partners competitively solicits local government contracts from world- class suppliers, such as GameTime, to help streamline the purchasing process.

GameTime offers discounted equipment to participants though this program, but is required to solicit three quotes from certified installers within the region of the purchasing agency to ensure a competitive bid is received for the installation of the play equipment and compliance with state and local playground installation standards.

To ensure the lowest installation cost, GameTime solicited the following three quotes (Attachment E) from their certified installers in the Southern California area:

Contractor Location Bid Amount
Ortco, Inc. Orange, CA $65,388.00
Pro-Tect Turf Orange, CA $68,507.00
Evergreen Environment, Inc. Riverside, CA $71,603.20
The GameTime quote (Attachment D) includes the installation cost based on the quote provided by Ortco, Inc. After the order is placed with GameTime, manufacturing will take up to 12 weeks, with installation to be scheduled following receipt of materials.

Updating the playground at Brentwood Park will enhance the positive interactions and recreational elements available to children that frequent the park, including those who attend Brentwood Elementary School. As part of GameTime's continued effort to illustrate how important recreation and outdoor play is to our communities, this site will be a National Demonstration site. National Demonstration sites provide researchers with additional data on the benefits of play and the impact play has on a community.

Staff recommends that the City Council award the purchase and installation of the playground equipment at Brentwood Park to GameTime.

Staff is available for any questions the Council may have.

Subject:
2022 CPRS Statewide Training and Funding Initiative, Eva Dell Park Playground Replacement
Recommendation:

That the Honorable City Council award the purchase and installation of playground equipment to GameTime for the replacement of the playground at Eva Dell Park.

Fiscal Impact:

The Eva Dell Park play structure replacement is part of the City's scope of work approved under the Prop 68: Statewide Park Development and Community Revitalization grant for Eva Dell Park. The City was awarded $3,325,171 to complete the revitalization of the park and Council accepted the grant funds at the regular meeting held on April 5, 2022. The estimated net cost to purchase and install the playground equipment is $380,938.22. No additional appropriation is required. Sufficient funds are available for this purchase in the following account:
•2707501C – 55070 – 80080 – Improvements not Buildings
No funding will be remitted to the City for the 2022 CPRS Statewide Training and Funding Initiative. Instead, a discount will be applied to the transaction as a fifty percent (50%) discount to the play structure, or $99,301.50 (see Attachment D). However, it will be necessary for the City to capitalize this asset at its full value, inclusive of the discount offered through the grant, which is currently estimated at $480,239.72.

This project will allow the City to address deferred maintenance at Eva Dell Park, which aligns with Objective 3.1.a in the Park and Recreation Master Plan due to the playground having been identified as a low scoring amenity (Attachment A).

Background:

In April 2022, Council accepted Prop 68: Statewide Park Development and Community Revitalization grant funds in the amount of $3,325,171 to renovate Eva Dell Park. One of the amenities included in the scope of the improvements is replacement of the play structure located near 3rd Street with an all-inclusive playground.

In June 2022, staff became aware of a new grant opportunity with GameTime. Staff previously worked with GameTime on other matching fund grant projects, the most recent being the replacement of the playground structure at Eagle Ranch Park. Eva Dell Park was one of three playgrounds identified as a good fit for this grant opportunity as it would reduce the cost of the base play structure, allowing the City’s to maximize use of the Prop. 68 grant funding awarded by the state.

Staff was notified on September 16, 2022, that the Eva Dell Park playground replacement was selected to receive funding through the initiative (Attachment B). Under the proposed playground design (Attachment C), there will be a fifty percent (50%) discount on the cost of the play structure (not including unattached features) in the amount of $99,301.50 to be covered by the funding initiative. The remaining balance of the play structure, the cost of the unattached features, installation, tax and freight (currently estimated at $380,938.22) will be covered by Prop 68 grant funding.

This will be Victorville’s first all-inclusive playground that will enable play amongst children of all abilities. Inclusive play in the playground industry surpasses the minimum requirements for an ADA-compliant playground. All-inclusive playgrounds utilize a universal design that allows children with and without disabilities to play and interact with one another in one location.

The playground design allows those with physical, social emotional, sensory, cognitive, communicative or no disabilities to play and develop alongside one another. The playground offers ramp access, dramatic play, cooperative play, accessible playground surfacing and shade. The ground cover will consist of a combination of rubberized surfacing and engineered wood fiber (EWF). Key elements of the playground include the 2 8
8 1
inclusive whirl, expression swings (commonly referred to as Mommy & Me), musical and interactive play panels, sensory rock n’ raft, slides, climbing elements, musical tubes, shade and seating.

Consistent with the terms of the grant, the playground design proposed under the grant application was created in conjunction with Great Western, the designated sales representative for GameTime in Southern California. The design is based on best practices aimed at promoting inclusive play and physical fitness through outdoor play environments and creative playground learning activities. This project will expand the playground's footprint, allowing for a larger play structure, the addition of more swings and a merry-go-round.

Ortco, Inc. Orange, CA $147,177.00
Western State Builders, Inc Escondido, CA $153,769.00
Evergreen Environment, Inc. Riverside, CA $167,935.74
The GameTime quote (Attachment D) includes the installation cost based on the quote provided by Ortco, Inc. After the order is placed with GameTime, manufacturing will take up to 12 weeks, with installation to be scheduled following receipt of materials and completion of plans by the City’s landscape engineering firm for the Eva Dell project.

Updating the playground at Eva Dell Park will enhance the positive interactions and recreational elements available to children that frequent the park. Being our first all- inclusive playground, the park will also be a destination point for residents. As part of GameTime's continued effort to illustrate how important recreation and outdoor play is to our communities, this site will be a National Demonstration site. National Demonstration sites provide researchers with additional data on the benefits of play and the impact play has on a community.

Staff recommends that the City Council award the purchase and installation of the playground equipment at Eva Dell Park to GameTime.

Written Communications
Meeting of: December 6, 2022
Submitted By:

Jenele Davidson, Deputy City Manager

Subject:
2022 CPRS Statewide Training and Funding Initiative, Center Street Park Playground Replacement
Recommendation:

That the Honorable City Council:
(1) Adopt Resolution No. 22-125 accepting a donation of funds from Benefit Everyone, Assist Recreation and Sports (B.E.A.R.S.) for the purchase and installation of a playground at Center Street Park and amending the annual budget for Fiscal Year 2022-2023; and
(2) Award the purchase and installation of playground equipment to GameTime for the replacement of the playground at Center Street Park.

Fiscal Impact:

Taking action to adopt Resolution No. 22-125 (Attachment A) in accordance with the staff recommendation will amend the Fiscal Year 2022-2023 budget to include revenue and expenses in an amount equal to the net cost to purchase and install the playground equipment, currently estimated at $132,018.25. The City will remit payment for the net cost of the playground equipment and installation to GameTime, and B.E.A.R.S. will remit payment to the City for the donation in the same amount, up to $135,000.

There will not be a net impact to the Fiscal Year 2022-2023 budget associated with the recommended action as expenditures will be offset by additional revenue. The following account codes have been setup for this project:
•1006000-47410-80085 – Center Street Park Playground, Donation •1006000-55070-80085 – Center Street Park Playground, Improvements not Buildings
2 8
8 2
No funding will be remitted to the City for the grant. Instead, the discount received through the GameTime/CPRS initiative will be applied to the transaction as a fifty percent (50%) discount to the play structure, or $54,067 (see Attachment B). However, it will be necessary for the City to capitalize this asset at its full value, inclusive of the discount offered through the grant, which is currently estimated at $186,085.25.

In accordance with one strategy outlined within the plan, Council adopted the Parks and Recreation Master Plan on December 15, 2020, and staff have been working to implement recommendations therein.

This project will allow the City to address deferred maintenance at Center Street Park, which aligns with Objective 3.1.a in the Park and Recreation Master Plan (Attachment C).

Background:

In June 2022, staff became aware of a new grant opportunity with GameTime. Staff previously worked with GameTime on other matching fund grant projects, the most recent being the replacement of the playground structure at Eagle Ranch Park. Through staff assessment and the Master Plan process, play structures have been identified throughout the City that are in need of updating. Center Street Park was one of three playgrounds identified as a good fit for this grant opportunity. The existing playground equipment was installed in the early 2000s and, though safe for use, needs modernization.

Staff was notified on September 16, 2022, that the Center Street Park playground replacement was selected to receive funding through the initiative (Attachment D). Under the proposed playground design (Attachment E), there will be a fifty percent (50%) discount applied to the cost of the play structure (not including unattached features) in the amount of $54,067.00 to be covered by the funding initiative. The remaining balance of the play structure, the cost of the unattached features, installation, tax and freight (currently estimated at $132,018.25) will be covered by a donation from B.E.A.R.S. (Attachment F).

Consistent with the terms of the initiative funding, the playground design proposed under the grant application was created in conjunction with Great Western, the designated sales representative for GameTime in Southern California. The design is based on best practices aimed at promoting physical fitness and fun through outdoor play environments 2 8
8 2
and creative playground learning activities. It incorporates multiple play activities with inclusive features with developmental benefits, such as adaptable and multi-user swings, merry-go-round and sensory areas. It also incorporates shade structures, which residents commonly request.

Site preparation work for this project will be completed by City staff, which will include the demolition and removal of the existing playground structure and removal of the engineered wood fiber ground cover. GameTime will complete the installation of the new playground structure using a subcontractor. This arrangement is permitted under section

2.28.120 of the Victorville Municipal Code based on the City’s participation in the Omnia Partners cooperative purchasing agreement. Omnia Partners competitively solicits local government contracts from world-class suppliers, such as GameTime, to help streamline the purchasing process. GameTime offers discounted equipment to participants though this program, but is required to solicit three quotes from certified installers within the region of the purchasing agency to ensure a competitive bid is received for the installation of the play equipment and compliance with state and local playground installation standards.

To ensure the lowest installation cost, GameTime solicited the following three quotes (Attachment G) from their certified installers in the Southern California area:

Contractor Location Bid Amount
Western State Builders, Inc. Escondido, CA $46,559.001
Evergreen Environment, Inc. Riverside, CA $63,555.60
Ortco, Inc. Orange, CA $65,938.00
The GameTime quote (Attachment B) includes the installation cost based on the quote provided by Western State Builders, Inc. After the order is placed with GameTime, manufacturing will take up to 12 weeks, with installation to be scheduled following receipt of materials.

Updating the playground at Center Street Park will enhance the positive interactions and recreational elements available to children that frequent the park. As part of GameTime's continued effort to illustrate how important recreation and outdoor play is to our communities, this site will be a National Demonstration site. National Demonstration sites provide researchers with additional data on the benefits of play and the impact play has on a community.

Staff recommends that the City Council adopt Resolution No. 22-125 to accept the donation from B.E.A.R.S. and amend the Fiscal Year 2022-2023 annual budget for the associated revenue and expenses; and award the purchase and installation of playground equipment to GameTime.
1 Quote 1 reflects the demo and removal of existing playground equipment & engineered wood fiber, which has been removed from the final scope as illustrated on Attachment B. 2 8
