Reduction of Securities for Tract Map No. 16684
Recommendation:
That the Honorable City Council:
(1) Approve an additional 20-percent reduction for the Street, Water, Drainage, and Sewer Faithful Performance Securities for Tract Map No. 16884; (2) Approve the full release of the LMAD Faithful Performance and Labor & Materials Securities for Tract Map No. 16884; and
(3) Accept the Street, Water, Drainage, and Sewer improvements for maintenance.

Strategic Plan Goal:
This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.
Background:
Tract Map No. 16684 (Tract 16684) is a 35-lot, single family subdivision, located east of Cobalt Road between Dos Palmas and Luna Roads. Richmond American Homes (the Developer) is the current owner of Tract 16684. The Developer was required to install public improvements as a condition of approval per Planning Commission Resolution No.
P-03-264 and Case No. ADMN21-00015, the administrative approval for tract development. The required public improvements for Tract 16684 include improvement of the streets, water, drainage, sewer systems, and Landscape Maintenance Assessment District (LMAD) improvements along Eastview Lane.

Discussion:
Per the Subdivision Improvement Agreement recorded on May 1, 2021, the Developer was required to complete all the public improvements for the tract map. On April 5, 2022, the City Council approved a 60-percent reduction of the Street, Water, Drainage, and Sewer Faithful Performance Securities for Tract 16884.
On December 20, 2022, the City Council approved an 80-percent release of the LMAD Faithful Performance Securities and accepted the LMAD improvements for maintenance.
Since the warranty period was completed on December 20, 2023, the remaining 20% of the LMAD Faithful Performance Securities and the LMAD Labor & Materials Securities can be released in their entirety.
In December of 2023, the Developer completed all the Street, Water, Drainage, and Sewer Improvements for Tract Map 16684. At this time, staff is recommending the release of an additional 20-percent of the Street, Water, Drainage, and Sewer Faithful Performance Securities for Tract 16884 and that the improvements be accepted for maintenance. Per Victorville Municipal Code Section 17.64.070(4), the remaining 20- percent of the Faithful Performance securities are to be held for a one-year warranty period and the Labor & Materials securities will be held for a 6-month period. The only outstanding improvement is the required monumentation for the tract.
