ORDINANCE NO. 2446
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VICTORVILLE REVISING AND ESTABLISHING SPEED ZONES UPON
CERTAIN STREETS IN THE CITY BY AMENDING TITLE 12, CHAPTER
12.20, SECTION 12.20.020 OF THE VICTORVILLE MUNICIPAL CODE, ENTITLED “DECREASE OF STATE LAW MAXIMUM SPEED”
THE CITY COUNCIL OF THE CITY OF VICTORVILLE DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Amendment of Section 12.20.020 of the Victorville Municipal Code Section 12.20.020 of the Victorville Municipal Code is hereby amended in its entirety to read as follows:
12.20.020 - Decrease of state law maximum speed.
It is determined upon the basis of an engineering and traffic investigation that the speed permitted by state law as applicable upon the following streets is greater than is reasonable or safe under the conditions found to exist upon su ch streets, and it is declared that the prima facie speed limits shall be as set forth in Table 12.20.020 on those streets or parts of streets designated in this section when signs are erected giving notice thereof.

SECTION 2. CEQA Exemption Finding
The City Council finds that this ordinance is not subject to review under the California Environmental Quality Act (“CEQA”) pursuant to Sections 15060(c)(2), 15060(c)(3), and/or 15061(b)(3) of the State CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3).
The adoption of the speed limit amendments is being made pursuant to the California Vehicle Code and supported by required Engineering and Traffic Surveys and therefore will not result in a direct or reasonably foreseeable indi rect physical change in the environment; is not considered a “project” under CEQA Guidelines Section 15378; and/or can be seen with certainty to have no possibility of a significant impact on the environment.
SECTION 3. Severability
The City Council declares that, should any provision, section, paragraph, sentence, or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive le gislation, the remaining provisions, sections, paragraphs, sentences or words of this Ordinance as hereby adopted shall remain in full force and effect.
SECTION 4. Effective Date
This Ordinance shall take effect thirty (30) days after its final passage.
SECTION 5. Repeal of Conflicting Provisions
All provisions of the Victorville Municipal Code as heretofore adopted by the City Council that are in conflict with the provisions of this Ordinance are hereby repealed.
SECTION 6. Certification
The City Clerk shall certify to the passage of th is Ordinance and shall cause the same to be published according to law.
