Background:

The property owner for Tract Map No. 18980 (Tract 18980) has petitioned the City to annex the tract into the City-Wide Drainage Facilities Assessment District No. 1 (DFAD1) and the Landscape Maintenance Assessment District No. 6 (LMAD 6) to comply with the Conditions of Approval for Tract 18980 which is located on Second Avenue just north of Silica Drive. Tract 18980 is a proposed 17-lot single-family subdivision that includes drainage and landscaping improvements along Second Avenue. These annexations will provide for the perpetual maintenance and servicing of the drainage and landscape improvements by means of a new annual assessment to each property within Tract 18980.

At the February 20, 2024, City Council meeting, the Engineer’s Reports were preliminarily approved, the intent to annex Tract 18980 into DFAD No. 1 and LMAD No. 6 was declared, the public hearing was set to April 16, 2024, and the mailing of the public hearing notices and assessment ballots to the property owners within Tract 18980 were ordered by the City Council. The ballots were mailed on February 29, 2024, meeting the required 45-day period.

Discussion:

The testimony regarding the proposed annexation and assessments will be considered and the assessment ballots will be tabulated. Based upon the tabulation results provided by the City Clerk, the City Council shall determine if there is a majority protest. A majority protest exists if the number of ballots submitted in opposition exceeds the number of ballots submitted in favor of the annexation and assessments, as weighted in accordance with applicable law.

If there is no majority protest, the City Council may adopt Resolution Nos. 24-026 and 24- 027 confirming that no majority protest exists, adopting the Engineer’s Reports as final, ordering the annexation of Tract Map No. 18980 to DFAD No. 1 and LMAD No. 6, and the levy and collection of assessments on the parcels therein commencing in Fiscal Year 2024/2025.

Staff remains available for any questions the Council may have.
