Reduction of Securities for Tract Map No. 15598
Recommendation:

That the City Council:
(1) Approve the full release of the Water, Sewer, Drainage, and Landscape Maintenance Assessment District (LMAD) Faithful Performance Securities; and (2) Approve the full release of the Street Labor & Materials Security for Tract Map No. 15598.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

Tract Map No. 15598 (Tract 15598) consists of five phases that are made up of 458 residential lots located south of Rancho Road and east of Boh Lane. The Subdivision Improvement Agreement (SIA) with LGI Homes - California, LLC (LGI) that was recorded on January 23, 2019, is for the completion of Tract Map Nos. 15598-3, 15598-4, and 15598-5.

At the April 4, 2023, regular City Council Meeting, the City Council approved an 80% release of the Water, Sewer, Drainage, Landscape Maintenance Assessment District (LMAD) Faithful Performance securities and accepted the Water, Sewer, Drainage, 3 5
7 7
Landscape Maintenance Assessment District (LMAD) Public Improvements for Tract Map Nos. 15598-3, 15598-4, and 15598-5.

At the August 15, 2023, regular City Council Meeting, the City Council approved an 80% release and accepted the Street Improvements for Tract Map Nos. 15598-3, 15598-4, and 15598-5.

Discussion:

Per Victorville Municipal Code Section 17.64.070, the remaining 20-percent of the Faithful Performance security are to be held for a one-year warranty period and the Labor & Materials securities will be held for a 6-month period. Therefore, staff recommends the full release of the Water, Sewer, Drainage, and Landscape Maintenance Assessment District (LMAD) Faithful Performance Securities due to the acceptance taking place at the April 4, 2023, regular City Council meeting and there are no warranty items outstanding.

Staff also recommends the full release of the Street Labor and Materials Security due to the acceptance taking place at the August 15, 2023, regular City Council Meeting.

Staff remains available for any questions Council may have.
