Written Communications
Meeting of: May 07, 2024
Submitted By:

C. Eric Ray, Airport Director
Subject:

Approve Amendment Three to the General Services Provider Standard Agreement for Qualified Fence Contractor, Project CC23-028
Recommendation:

That the Southern California Logistics Airport Authority Board of Directors:
(1) Approve Amendment Three to the General Services Provider Standard Agreement to Dantin Enterprises Inc., DBA All American Fence Erectors, for Qualified Fence Contractor, Project CC23-028, increasing the total not to exceed compensation by $50,000 to $175,000.

Fiscal Impact:

This Amendment requires no additional budget appropriation. Funds of $360,000 are currently budgeted in Airport Operations Account 4500125-52440 for Infrastructure Repairs. $234,192.09 has been spent or encumbered to date on Infrastructure Repairs, leaving an available budget amount of $125,807.91, which is sufficient to accommodate the proposed Amendment Three increase of $50,000.

The budget is outlined below:

Current Budget
Revenue Expense
4500125-52440 Infrastructure Repairs 0 $125,807.91
Strategic Plan Goal:

Goal E. Invest in Infrastructure: Amendment Three provides for Airport infrastructure to be maintained.

3 Background:

As required by the TSA and FAA (CFR 139.335), the Southern California Logistics Airport (“SCLA”) follows Federal guidelines to restrict access to the Airfield Operations Area (“AOA”). SCLA utilizes badge-controlled access gates and perimeter fencing as part of its plan to restrict access to the AOA. The AOA comprises approximately 2100 acres, with fencing and badge-controlled buildings surrounding the entire AOA. Additional fencing is installed outside the AOA along Air Expressway and other areas in the vicinity of the Airport.

Portions of fencing that surround the AOA exist near roadways that are accessible to the public at all hours. When a vehicle collides with the fence that protects the AOA, the breach must be secured by the SCLA Operations team and the SCLA’s contracted security provider until the breach is repaired. Restoring an AOA fence breach becomes a top priority when an incident occurs, and having a qualified fencing contractor on call to perform the work is critical to maintaining AOA access restriction continuity.

At the start of fiscal year 2023-2024, the SCLA issued Amendment One to All American Fence Erectors (“All American”) to perform fence repair and installation services for a not to exceed amount of $100,000. A budgeted and planned fence relocation project was completed in July of 2023, and based on historical fence expenses, staff felt confident that the remaining funds on Amendment One would be sufficient to handle unplanned fence work for the rest of the 2023-2024 fiscal year. However, multiple traffic incidents occurred since July 2023 that breached fencing along Air Expressway and the AOA, which necessitated staff in January 2024 to request Amendment Two to the Agreement with All American to increase the not to exceed compensation amount to $125,000. Staff felt confident that this amount was sufficient to handle unexpected expenses for the remainder of the fiscal year.

However, further unprecedented incidents have since occurred that require fence repairs to be made that will bring the total compensation amount paid to All American near the $125,000 amount, thus leaving insufficient funds on the Agreement should a major incident occur before July 2024. Staff seeks to proactively amend the current Agreement amount to avoid a potential emergency where a fence breach needs repairs but the remaining funds on the Agreement are not sufficient to accommodate the repairs.

Discussion:

The requested Amendment Three compensation increase amount of $50,000 is within the City Manager’s authority to approve. However, Amendment Three brings the total compensation to $175,000, which requires the approval of the Southern California Logistics Airport Authority Board of Directors. Amendment Three presented herein is compliant with City of Victorville Municipal Code §2.28.060. Staff recommends that the Honorable Southern California Logistics Airport Authority Board of Directors approve Amendment Three to the General Services Provider Standard Agreement with All American for Qualified Fence Contractor, Project CC23-028, in the amount not to exceed $175,000.
