Full Reduction of Faithful Performance Security for Case No. EWTR21-00264 Recommendation:
That the Honorable City Council approve the full release of the Water Faithful Performance Security for Case No. EWTR21-00264.

There is no fiscal impact resulting from this item.
Strategic Plan Goal:
This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.
Background:
Case No. EWTR21-00264 is a scattered single-family residential home located within unincorporated San Bernardino County and the Victorville Water District service area.
The Developer, Zab, LLC, was required to install 608-linear feet water main extension on Sunset Road for the Victorville Water District to provide water services. As a public improvement, the Developer provided bonds as security for the water improvements.
At the May 2, 2023, regular City Council meeting, an 80-percent release of the Water Faithful Performance Security was approved, and the water improvements were accepted by the City.
At the November 7, 2023, regular City Council meeting, the full release of the Water Labor and Materials Security was approved for Case No. EWTR21-00264, in accordance with Victorville Municipal Code Section 17.64.070(3).

Discussion:
Per Victorville Municipal Code Section 17.64.070(4), the remaining 20-percent of the Faithful Performance Security was held for a one-year warranty period that ended on May 2, 2024. Therefore, staff recommends the full release of the Water Faithful Performance Security as there are no outstanding warranty items.
Staff remains available for any questions the Council may have.
